they have lie controlling influence. Congress
may adopt such Slate laws directly by substan
tive ennetment, or they may con tide the author
ity to adopt them to the Courts of the United
States. (9 Peters, 259.)
Examples of both sorts exist in the national.
legislature. The process act of 1789 (Ch. 21)
expressly adopted the forms of writs and words
of process of the State Courts, in suit's at corn,
mon law. The act of 1792 permanently con
tinued the forms of wrils, , execulion s and other
process then in use in the Courts of the United
States under the net of 1789 ; but with this re
markable difference, that they were subject to
such alterations and additions as the said ()Mirth
should, in their discretion, deem expedient.
The Constitutional validity and extent of the
power thus given to the Courts of the United
States, was fully considered by the Supreme
Court of tho United States, in the crises re
ported in 10th NV heaton," 1 and 51. It was
there held, that this delegation of power by
Congress was perfectly Constitutional ; that
the power to alter and add to the process and
modes of proceedings in a suit, embraced the
whole progress of such suit, and every transac
tion in it front its commencement to its termi
nation, and until the judgment should be satis
fied ; and that it authorized the °Outs to pre
scribe and regulate the conduct of the officer
in the execution of final process, in giving
effect to its judgment. (9 Peters, 329.)
But the present case does not depend simply
upon the Acts of 'B9 and '92, but is directly
within and governed by -the process Act of

ency of adopting which, they could well judge
