A somewhat similar bllqinvss is retried nn between Ere:And and Zealand. Thl., latter country, at psrticulm seasons, is invaded by armies of caterpillars, which clear off the Olin crops as completely as if mowed down by a scythe. With ii view of counteracting this plague, a novel importation has boon 11111110. It ie thus noticed by the Souilicni (.'ease., , Bolin has shipped :MO sparrows on board the Swordfish, carefully scleeteil from the best hedgerows in England. The food alone, he informs us, put on board for theta cost £ll4. This sparrow question Imes been a long-standing joke in Auckland, but tic he comity to farmers of small birds to keep down the rubs, is admitted on all sides. There is „no security in Now Zealand against the in vitsion of myriads of caterpillars, which de- Valuta the crops." The most singular branch of such traffic is the toad trade. On some of the'market gar dens, near London, as many as live :nips arc raised in one year, the principal object being, however, to raise the finest possible specilllOnti for high prices. Under such a system of culture, slugs and other . insects are very for midable foes, and to destroy thorn, toads have boon found so useful, as to be purchased at high prime. The whole efficacy of 6tickija:w6 in the Courts of the United States depends upon the enact ments of Congress. So fur as they lire adopted by Congress they are ohlikontory. Beyond this they have lie controlling influence. Congress may adopt such Slate laws directly by substan tive ennetment, or they may con tide the author ity to adopt them to the Courts of the United States. (9 Peters, 259.) Examples of both sorts exist in the national. legislature. The process act of 1789 (Ch. 21) expressly adopted the forms of writs and words of process of the State Courts, in suit's at corn, mon law. The act of 1792 permanently con tinued the forms of wrils, , execulion s and other process then in use in the Courts of the United States under the net of 1789 ; but with this re markable difference, that they were subject to such alterations and additions as the said ()Mirth should, in their discretion, deem expedient. The Constitutional validity and extent of the power thus given to the Courts of the United States, was fully considered by the Supreme Court of tho United States, in the crises re ported in 10th NV heaton," 1 and 51. It was there held, that this delegation of power by Congress was perfectly Constitutional ; that the power to alter and add to the process and modes of proceedings in a suit, embraced the whole progress of such suit, and every transac tion in it front its commencement to its termi nation, and until the judgment should be satis fied ; and that it authorized the °Outs to pre scribe and regulate the conduct of the officer in the execution of final process, in giving effect to its judgment. (9 Peters, 329.) But the present case does not depend simply upon the Acts of 'B9 and '92, but is directly within and governed by -the process Act of 19th-May, 1828. (COI& 401) • This course was no doubt adopted, as onobet ter calculated to meet the views, and wishes of the several States, than for Congress to have framed an entire system for the Courts of the United States,. varying from that of the State Courts. They had in view. however, State systems then in actual operation, well known and understood, and the propriety and expedi ency of adopting which, they could well judge and determine. Hence the mitriction in the Act, now used and allowed in On, several States. There is no part of the Act, however, that looks like adopting prospi .itively by possAiw t , provision, the various changesthat might hcrcnftci• bo innde in Ow Stnto.(.7nurls. such been the intention ofCongre , s, the phrase ology of the Aet would doubtle , s have been adapted to that purpose.
