AN ACT, for the protection and preserva-
tion of trout in the streams of Elk creek,
Pine ereek, Penn's creek, and other
streams in the counties of Centre, Clear
field end Forest. }
Section 1. Be it enacted by the Senate
andH ouse of Representatives of the Com-
monwealth of Pennsylvania in General
Assembly met, and it 1s hereby enacted by
the authority of the same, That it shall not
be lawful to take, catch or kill trout in any
of the waters of the counties of Centre,
Clearfield and Forest, only between the
first day of March and the first day of Sep-
tember in each and every year.

AN ACT, Declaring Pino creek, in the
county of Centre, a public highway.
Section 1. Be it enacted by the Senate
and House of Representatives of the Com-
monweanlth of Pennsylvaniain General As-
sembly met, and it is hereby enacted by
the authority of the same, That Pine creek
in the township of Haines, in the county of
Centre, from the mouth thereof, at Penn's
creek, up to six miles above Motz's, be and
the same is hereby declared a public high-
way for the passage of logs, rafts, arks,
boats and other vessels; and it may be Inw-
ful for the inhabitants desirous of using the
navigation of said creek to remove all na-
tural and artificial obstructions from the
bed or channel of said creek, excepting
dams for mills and other water works, and
to erect such slopes or locks, and to keep
the same in repair, at the mill dams now
built, as may » necessary for the passage
of logs, rafts, arks, boats and other vessels:
Provided, Such slopes or locks be so con-
structed as to do no injury te any of said
dams: And provided also, That any per-
gON OT persons, awning or possessing lands
on said creek, may construct or erect any
dam or dams across the same, agreeably
and subject to all the restrictions and pre-
visions of an act, entitled “An Act to au-
thorize any person or persons owning land
adjoining navigable streams of water, de-
clared public highways, to erect dams upon
such streams, for mills and other water
works,” passed the twenty-third day of
March, 1808.

AN ACT, to prevent hunting of deer with
dogs in the county of Centre.
Section 1. Be it enacted by the Senate
and House of Representatives of the Com-
monwealth of Pennsylvania in General
Assembly met, and it is hereby enacted
by the authority of the same, That from
and after the passage of this act it shall be
unlawful for any person or persons to
chase, hunt or run deer with dog or dogs
in the county of Centre; and any person
or persons who shall violate the provisions
of this act, shall be subject to a fine of
twenty dollars, one half to the use of the
informer, and one-half to be paid to the
treasurar of the school fund in the town-
ship where said offence may be committed,
to be recovered as debts of like amount are
now by law recoverable: Provided, That
the informer may be a witness, notwith-
standing his right to a part of the penalty.
Bection 2. That it shall be lawful for
any person to shoot or kill any dog or dogs
on may be found running or chasing
deer in violation of the provisions of this
act, and the owner or owners of said dog
or dogs shall not recover any damages
therefor.

AN ACT, to exemt the Pennsylvania State
Agricultural Society and certain county
agrieiltural societies from taxation.
Section 1. Be it enacted by the Senate
and House of Representatives of the Com-
monwealth of Pennsylvania in General As-
sembly met, and it is hereby enacted by
the authority of the same, That the Penn-
sylvania State Agricultural, the Allegheny
County Agricultural and the Adams Coun-
ty Agricultural societies, and the agricul-
tural societies of Lehigh, Northampton,
Erie, Crawford, Chester, Lancaster, York,
Berks, Monroe, Beaver, Somerset, Bed-
ford, Fulton, Fayette, Westmoreland,
Greene, Dauphin, Lebanon, Carbon,
Wayne, Philadelphia, Delaware, Montgo-
mery, Lycoming, Union, Snyder, Blair,
Mifllin, Juniata, Mercer, Venango, War-
ren, Luzerne, Washington, Centre, and all
real or personal estate owned by them, for
the purposes of said associations, shall not
be subject to taxation for state, county, mu
nicipal or other purposes.

AN ACT, relating to appeals and trans-
geripts from the judgments of justices of
the peace in and for Centre, Blair, Le-
high, Clinton, Scyuylkill, Allegheny,
Indiana, Northampton, Luzerne, Leba-
non, Berks, Perry, Mifflin and York.
Section 1. Be it enacted by the Senate
and House of Representatives of the Com-
monwesith of Pennsylvania in General As-
sembly met, and it is hereby enacted by
the authority of the same, That from and
after the passage of this act the justices of
the peace, in and for the counties of Cen-
tre, Blair, Lehigh, Clinton, Schuylkill, Al-
- legheny, Indiana, Northampton, Luzerne,
Lebanon, Berks, Perry, Mifflin and York,
shall be entitled to Tonand and receive
from the appellant and from the plintaiff
desiring a transeript for entering in the
common pleas or other transcripts, in any
case tried before him, before giving a tran-
script of appeal or other transcript, all
costs that may have accrued in the said ac-
tion: Provided, That the payment of the
costs in the first instance, by the appellant
or plaintiff, shall not eo of his right
to receive the same from the appellee or
defendant in the same manner and to the
same extent as is now provided in an act
approved the ninth day of April, anno do-
mini one thousand eight hun red and thir-
ty-three, entitled ‘‘An Act to abolish im-
prisonment for debt, and other purposes:
And provided further, That any party to
suits shall have the right to appeal and de-
mand transcripts, without payment of costs
aforesaid, by their making and filing with
the said justice an affidavit of their inability
~ to pay such costs.

AN ACT, relative to the compensation of
the treasurer of Centre county, the safe
keeping of the eounty funds, et cetera.
Section 1. Be it enacted by the Senate
and House of Representatives of the Com-
monwealth of Pennsylvania in General As-
sembly met, and it is herehy enacted by
the authority of the same, That from and
after the first day of January, anno domini,
one thousand eight hundred and sixty nine,
the treasurer of Centre county shall receive
a salary of two thousand dollars per an-
num in full eompensation for his services
on behalf of the county, in lieu of the am-
ount per cent, now fixed or allowed by the
laws of this commonwealth.
Section 2. That the treasurer of Centre
county shall, whenever requested so to do
by the county commissioners or county au-
ditors, answer upon oath or aflirmation res-
pecting any and every investment or dispo-
sal of the county funds, the name of every
person or institution and place with whom
and where he keeps the said funds, and on
what terms, without eriminating himself;
and all benefit, profit or gnin made by any
investment of the county funds shall be for
the use of the county : Provided, That no-
thing herein contained shall be construed
to prevent the prosecution of the treasurer
of the county for any violation of the exis-
ting laws of this commonwealth in relation
to making profit on moneys received by
him as treasurer, or for the misapplication
of the county funds. ;

AN ACT, to authorize the commissioners
of Centre county to sell and convey cer-
tain real estate.
Whereas, The commissioners of the coun-
ty of Centre have erected a new county
prison, thereby rendering the use of the old
Jasl unnecessary for county purposes; there-
fore,
Section 1. Be it enacted by the Senate
and Houte of Representatives of the Com-
monwealth of Pennsylvania in General As-
sembly met, and it is hereby enacted by the
autherity of the same, That the commission-
ers of the said county of Centre, or any
two of them, are hereby authorized and
empowered to sell at public sale the old
jail und lot of ground upon which it stands
| and to execute and deliver a deed, in fee
{ simple, to the purchaser or purchasers
| therefor: which said deed shall beacknowl-
| edged by the said commissioners, or a ma-
| jority of them, before the court of common
| pleas of said county, after said sale is ap-
| proved by said eourt,
Section 2. That the proceeds of the sale
of the real estate, hereinbefore authorized,
| shall be paid into the county treasury and
