Jeflerson Davis, made a motion to
quash the indictment against Davis, on
the ground that the fourteenth amend.
ment prescribes the mod of punishment
for participation in rebellion, which 18

ment is preseribed. The prosecuting
attorney moved to postpone the motion
until the latter part of the term.
