■worn, doth depose and say that he ii a practical

of Jacob Towns* nd, who'at that time was a book and
pamphlet peddler, callod own deponent, at the house
ofMr. Thompson. No. 43 Jludsoo-street, where depo
nentboardfd. and requested deponent to write him a
‘ recipe hr which to make a Syrup of Sarsaparilla.

with said Tqyrnsend at the office of Theodore Foster,
' Book Publisher, with whom said Toworend
deut. That saidTowwendbad had frequent conreraa.

Jacob Townsend. ~ .
That said Townsend stated bo was an old man, aod
poor, and was. not fit for bard labor—and wished if
make some monev, In order to live easy in his old
days, and that. If SinapariUa under the name of Town
send sold so Veil, and so much money was made by
it. be could doe no reason why he might not make
some til ug out of it too, (hi* name being'Townsend.l
if he could gw a capable person to prepare a recipe,
and manufacture It for him..' Deponent In one of the
eonvertationj asked said Townsend if be was related
to Dr. S. P. Townsend, to which he replied, that he
knew Dr. B. P. Townsend would be down ors him after
he commence. But that he did not care tor
him, os hajtind formed * co-partnership with men who
could furnish Hie requisite omonnt of capital—and was
• W ell prepared: to dele ml himrclf agilnst any attack
that might be made on him.
Deponent further says, lhat pursuant to the request
of sard Jwnb Townsend, he wrote a recipe for the
manuCictpro of a Syrup of Sarsaparilla, ami gave it to
him. Raid Townsend observed that he wanted to

bushels of sand or earth in a day, without the loas of *
