Mr. Knox had been arrested and committed to prison by the Mayor of Allegheny, on a charge of conspiracy and anon. Messrs. Barka and Stew art, on the pun of the relator, maintained that the commitment was irregular, and defective, and that the prisoner ought to be dischnrged. As, however, Mr. Knox wished the matter inquired into, ranee he leafed no investigation, they, (the counsel), had no wish to take any technical ad. vantage, and would only insist on his being ad mitted to bail. Mr. Darragh on the part of the commonwealth, wished that the bail should be reeponrible, es the offence was clearly bailable. His honor Judge Hepburn remarked that the violation of all law and just.ce at the late fire in Allegheny, had been very flagrant, and that, as Mr. Knox stood charged on the oath of respect able citizen, of a heinous offence connected with it, be felt it his duty, thongs he hoped that Mr. K. was innocent, to require heavy bail. He would therefore direct that Mr. Knox should give bail to the amount of three thousand dollars, conditioned for his appearance al the next court of quarter sessions., and himself enter into recognizances, to a like remount. Dr. Dickson, of Allegheny, immediately entered intn the required rerognizanees, and Mr. Knot was discharged.
