John Miller, a poor fellow whose mind is .disor dared, and who has begn for the last ex months confined In jail on a charge of committing an as• . mutt on Squire Ross, of Upper Saint Clair Town. ship, was brought into Court, and after solemnly promising not to injure Mr. RO3/11, and pledging himself not to drink any more intoxicating liquors, he was discharged. His case affords another proof of the necessity of our having a Lunatic Asylum established in this city. Miller is at present, scarcely sufficiently sane to be allowed to go at large, and yet it is herd, that he should be confined in jail, and dieted on the bread and water fare which he would receive there. Solitary confinment is surely not the best means of restoring a shattered mind to health. _ - The Court then adjourned, having gone through the criminal calendar, so tar as the cases were ready far trial. The weather during the cession, has been exceedingly warm, yet the court has punctually sat from eight A. M., to between six and seven,P. M. every day. Commonwealth vs George H. Bell—ludictemat —Assault and Battery committed on Michael Mc. Math. The witnesses in ibis case were Mr. Me. Math, Mr. Norton, a boarder at the Perry house, and the barkeeper of that establishment (Mr. Knox, we:believe). Mr. MeMath's testimony was to the effect, that he had meth friend able, ?dz. Rhine_ hart, who was stopping at the Perry House, one eight at a fire, and he told him that Mr. Norton, smother friend of Mr. MoMath's was also stopping them, and wished to see hint. The next day (Tues• day) he went around, and stepping up to the bar keeper, asked him if Mr. Norton were in. He said that he area not in the bar room, and was probably either up stairs in the parlor, or in his room, at the same time desiring him to step up. In going along the passage which led to the stairs, he met and nodded to Mr. Bell, with whom ha states he had several conversations previously, and with whom he had never quarreled. When first at the toot of the stairs, Bell called mt, in an imperious tone, "what do you wantr Exceedingly surprised, and some what startled at the retainer in which these words were spoken, he turned around, and said that he "wanted to see Mr. Henna." You "can't I see usehing hens," said Bell. "I did not tray I wanted to see nothsng: I went to see Mr. Norton.' leffyrorybrt - ard - stionxas-wum-ea- to iretroothlng. This was ogee denied by the one and asserted by the other, with the addition of tame opprobrious language, on the part of Bell, when Mr. MeMatb, feeling himself somewhat aggrieved, timed to lee ye the house, but stopped on seeing Me. Norton com ing towards him, and went up to that gentleman to shake hands. He was explaining to Mr. Norton how the mistake occurred, when Bell came up to them and insisted that h e had said tusAing. and not Norton. Mr. Norton told hie friend to say nothing more boot it, but step to the door, us he ■nw that both artles were somewhat excited Mr. Bell th. them, but returned as they snood on the do. 11, talking about the magularity of the oecurren and again said that McMath had said norkiog, and not Norton. That gentleman declared that he bad not, and Bell, with an oath said, if you again say that yea did not way nothlug, 111 kick you out el doom. The gentleman declared that ho had and Norton, and Bell, who is a large, powerful . !aught him by the collar of his coat, and with one kick, seat him, as Mr. Norton testified, doom tan feet down the slaps and on to the pave . . meat. This is the substance of Mr. McMaui's tes timony which was corroborated by Mr. Norton, who caw the whole proceeding tram the point at whieh he shook bands with that gentleman. Too bar-keeper swore that Mr. McMath had asked for Mr. Norton, and that he requested him to go up stairs to see him. Ric whole deportment, no far as he saw, was that of a gentleman. Both Mr. MeMath, and Mr. Norton appear to be gentlemen of the utmost respectability: The Court charged she jury anima the defend ant. The assault wow committed wholly without provocation, and no testimony whatever had bee. produced to Justly it or impeach the character of the witnesses.
