The Inn case taken up this =Dialog, was that
of the Commonwealth vs .I.lkr. Mot Gray
was the prosecutris, and alleged that the defen
dant threatened to use violence towards her. lie
was sentenced to pay the costs.
Commonwealth vs David Prosser—Surety of the
Peace. This was a sort acme. action between '
Mrs. Brindle and Mr. Prosser, caused by that
abomination—two families baking in one oven.—
Prosser, it seems, from Mrs. Brindle's testimony,
shook bin ringer at her, and threatened to "give
her enough: . On the other hand lo,appeared Gem
the testimony of some witnesses, that the amiable
Mrs. Brindle threatened to split Mr. Presser's
head with a poker. There was a good deal of
hard swearing on both sides, and both parties were
sentenced to pay the costs of their own witnesses,
and Mrs. Brindle the docket costs.
Commonwealth vs Ann Wilhams—Surety of
the Pence. Mrs. Edmonds on ptosecutris, and
vie• versa. This was a very trifling case, and
each party was sentenced to pay the costs of their
own witnesses, and Mrs. Edmonds., the docket
Jerry Down Derry was discharged from the
custody of the Sheriff, the prosecutor having for
feited Ms recognmances.

—Surety of the Peace. Joseph Lytle Prosecutor
The Osgood. are fishermen, and the quarrel arose
on account of the defendants tying their boats on
Lytle's property, and quarreling with one of his
tenants. The court directed each party to pay the
cost of hut owu witnesses, and the tick-odes:lts to
pay the docket costs.

Commouwealth vs. Was. Munta—lndiatment
Larceny, committed in stealing a purse and five
dollars is monei.
Anson Woods sworn—l was an officer on bond
the steam boat Swiss Boy. I saw somebody In
my stateroom on the morning the money was ta.
ken. He searched my pockets,md took my purse.
I caught hold of him, and took it from him. The
man who did it is the prisoner in the box. The
jury returned ailar an absence of a low minutes
with a verdict of "guilty.'
Commonwealth vs. William Frich, and Com
monwealth vs. Robert & Mclntyre—Cron ECl4ons
of assaults and battery.
From all the testimony in thin urge it appeared
that Mclntyre had been imposed upon. Fetch
having quarrelled with him respecting her putting
a pair of aweepr in a coal boat, which were bad.
but in doing which he acted according to the di.
rem:ions of hisemployer. Fnch made three dis
tinct 119/3[11L9 upon him, and Mclntyre acted wholly
upon the defensive. He did not indeed make any
attempt even to defend himself until the last at
tack, when, in the melee, a hatchet which he bad
in his hands streck Frich in the forehead, and in
the arm, wounding him slightly. Mclntyre was
severely cut on the arm, end condeed to his house
for some time. The Court charged maims Friel
and, after a short absence, the Jury brought in a
verdict o f "guilty."
Commonwealth v. Rudolph Saltzer—ladict
meat, Aasanli and Battery. Commiurd of Joanna
Profferd and Mary Crocow,
In this case it appeared from the evidence that
the defendant w. beating Mrs. Froffenrs child •
and ane threw a basin of water upon ham to make
him stop. Upon this he left the child, and after
same time made at her. He beat her with his
fists, and seising a buteher'd knife, was about to
stab her, when Mrs. Crocow, her mother, inter
feted. Seltzer then fell on her. bet the neighbors
came in and saved the (emotes from tardier vie
lence. 3fry. Profferd was confuted to bed for
several weeks from the effects of the injuries she
hid received in the needle. Mrs. Crocow was also
hurt and her hand severely cut to trying to take the
knife from the defendant. •

alt. The cholera had subsided at that point, but it
Is said to be making fearful devastations on the
Plains. Smell pox, measles, cholera. doe., are said
to he among the diammesamong the emigrants, bat
we muss, at the same time, remark, that this ac
count differs from others we have from the same
quarter. Our correspondent stales, that of a com
pany from Louisville, numbering 27, only seven
of their number were left. Of these, fear left at
Boonville, the remaining three are the sole survi
vors of those who started from Independence.
Oar correspondent says—"A relport in prevalent
here, that a company of man, numbering nearly
100, from Pittsburgh, Pa., and who paned through
this place some four or aye weeks ago has bees
completely broken op. They are said to have kill
ed five Indians, of the Kansas tribe, and wounded
some others, without any provocation on the part
of the Indiana. A party of U. S. troops was de
tailed to punrue them. They were overtaken at
110 mile creek—some made their escape, but more
than 40 were takeu prisoners, and are in custody."
This corresponds With a letter which we have al
ready published from Fort Kearney, and there is
little room to doubt its troth. Such conduct can•
not be too severely repreliepded, as it may cost
the lives of hundreos of Junk:ern persona, by way
of retaliation.
