The plaintiff* are publishers of the 'Daily Dim 1 patch,’ add bring thin action against tbe defendant, the Postmaster of Pittsburgh, tor refuting to give them the advertising of tbo uncalled-for letters, alleging ibht their paper lias the largest circulation ' of any in the place, «fcc. The defendant demtjrS generally.' , r-- OPINION OF THK COURT. Tbe purpose of advertising ttneal!ed*for letters, is lu give notice to tbe persons lowborn they are that they may come and get them, and the regulation is tor their benefit. If it should re sult in any benefit to the publishers of newspapers, this is incidental merely, and is not at all within tbo design of the acL It is provided that the ad* vertisements shall be inserted in the newspaper having tbe largest circulation; but this is for the 1 benefit of the receivers of letters, that-they may more certainly, have notice of them; and in no tense aa a patronage cf newspaper publishers, by> the general government, or as a role for the .dis* 'tribution of such patronage. Tbe repeal of the law, requiring advertisement*, would be no.injury ito newspaper publisher*, though it certainly woald be to the public. Tbe receivers of letters might possibly b>e Injured by a breach of the act, and might therefore have a remedy. But surely none bat those intended to be benefitled by tbe act can .claim any benefit font it U was not passed to cure any grievance of theirs, and they cannot be .aggrieved by its infraction. Tbe dnty enjoined is no doty owed to them. They might make profit by. its performance; but. they sustain no lots by its non-performance. Every man is bound to have the deed* of his land recorded; * but ibis is not a duty owed to tbe.recorder of deeds, and be can sustain no action for its omission. The cause of action is claimed to arise from tbe statute by Ita plication; l but there can be no implication of a right of action, on a statute, on any person, where .tore is no implication of a benefit intended bus )jr the statute. > : And so is the low laid down in the very do* tisions which one would expect to hear cited in' inch cases:— I “Where an act prohibits or com*' moods the doing of a thiog for the advantage of any person, «e£ person, if injured by disobedience to ,tbat low, is entitled to an action, though the situate does not give one.”—l9 Via. In the first instaope, I infer, tbe postmaster is left to tbo largest legal discretion in his decision, sou may act upon presumptions and repotation, as to tbe feet. Until tbe feet 1* decided, the right to tbe advertising exists la no one, The postmaster alone has tbe power u> bearand dedde that question. Be can nave no supervisor over him. In tbe performance of that doty be ams a* judge, and is responsible to to State authority for the manner or result of bis judgment. Even if done corruptly and maliciously, no common law iajory nrises, it is a breach of an official slaluteary doty by an officer of tbe general government, in volving no invasion of common rights, and is therefore a duty not enforceable here. The piaratifls declare for a breach of dnty in refniing them tbe advertising; bat they show no right to it They cannot show it, but by the de cision of the postmaster, that their paper has tbe largeii circulation. They do not aver that be ho* decided this fact. If be refused-to decide it, tku is tbe breach'of dnty which he has committed, and taicr is the injury, tf any. But the declaration is not for this. He may be compelled to perform this duly, and then, the one consequent upon it; bat not by this court, nor in this form of pro* eeeding. U may lie, that the plaintiffs are entitled to bare it decided, that they have, tbe'largest.dresdatioa, and therefore,that they are entitled to the adteitis ing. Bat this decision leaves that question to the judgment of the defendant's proper, official su periors. . And I do not think that the Stale Court* ought to have any jurisdiction over officers of the United Slates, to enforce sorb a doty. U wight be found difficult to obey so many masters. A direct ooTuftnn as to perform this duty, we could not issue; and this is very like to an indirect one.
