Moran Y. Bekaa, the veteran proprietor of the
New York Sun, retired frost that paper on Friday,
and has transferred his interest la that ' great reg
ulator' to his two sons. The public will lose no
thing in this change, his sons having managed the
business for several years, and to whom the peo
ple:l:if New York are much indebted for many im
provementa in newspaper enterprise. The
member, of Sin- Press partook of a magnificent
supper, prepared by Mr. Beach, which passed ofi
with the utmost good feeling by the Salons of
'scissors and pen.'
Beneditti, the celebrated singer was hissed off
the stage in this city last sight, because he, on a
former occasion, !erased to sing in Fry's Opera,
Norma' The monsieur is of Spanish birth—Fry

This morning the robbers ofCr.fDarlington, Pre
sident of the Chester county Batik, Whitehouse
and Thompson, were brought before Judge Par
sons, who sentenced each to two years and eleven
months solitary confinement in the Eastern Peni
tentiary, and at the time of their service expiring,
to pay a fine of $lO,OOO.

A general quietness prevailed in the market on
Saturday, but in the way of general sales a fai r
amount of business was done.
FLOUR—There were no receipts of couse•
queoce. and the wharf was clearer of the article
than any previous day of the season. The market
was very dull, and scarcely any thing transpired
worth noticing. We note small sales from store
at 4,12e04,18, and from wagon at 4,10011,12 c per
barrel
GRAIN—of grain the recetpts were &leo ex.
tremely light, and very little wee done in the way
of sales. Prices generally are unchanged.

GROCERIES—The market generally was very
quiet, showing no material change from former
quotations. Of N U sugar we notice limited sales
by the hhd nt sc, and by the bbl at 51.0.50 as in
quality. In molasses the market is less active,
showing a slight dispnathon to decline, with mode
rale sales at 291030 c is gall; no change in sugar
house. Sales SO sacks Rio coffee in different lots
at short time. Sale. of rice at 5 cents
pound.
PROVISIONS—For every thing under this
bead, the market is rather dull, but no change from
last quotations.
GREEN APPLES—,SaIes from first hands at 75
and from store at 87511, to 81,18 as in quality
FEATHERS—Large quantities continue to an ,
rive, and supplies are quite abundant. Sides from
store in lots of 1000 to 2000 - 18, at 33(10.1 eta per
pound.
SOAP—Sales of Pittsburgh rosin at 41c
and of variegated at iciaaki. p ! b.
CANDLES—Sides of city dipped at 9c,
mould at wienic, mid of star at 21V2.2 cents
pound.
CRACKERS—No change in prices; regular sa:es
are effected at the fallowing usual rates,

CHARGE OF THE JUDGE. AND VERDICT
41 Saturday morning we gave the whole of the
evidence in this case, which, on Friday night, had
closed, leaving nothing to be done but the speech
es of the counsel for and against the pnsoner.
Mr. Bigham addressed the Jury on Friday even
ing, and was followed by Mr. Magehan. On Sat
urday Mr. Heidleburg, Mr. Irwin, and Mr. Darr
ragh, addressed the jury on behalf of the prisoner,
and Mr. Boyd concluded on the part of the prose
cuton.
The prisoner was well defended, the learned
gentlemen leaving nothing undone—no stone un
turned—no supposition unillustrated, that could
possibly be of avail to the him.
, ur attention was particularly attracted by the
speeches of Mr. Irwin and Mr. Darragh—the latter
especially, whose thrilling, rapid eloquence more
than once brought tears to the eyes both of the ju
ry and the audience. But the facts were too much,
too apparent, and Mr. Boyd, in winding up the
case, did not fail to present them in all their horror
to the jury, and to dissipate all the sympathy that
had been created by the hon. and learned counsel
for the defence. We do not remember ever to
have witnessed a case in which counsel exerted
themselves more strenuously to save a criminal,
than in this.
About four o'clock on Saturday afternoon, the
learned. Judge charged the pry. We give, be .
law, the charge, as it was delivered, omitting noth.
ing except the law quotations and authorities read
by Jade Patton, and which he said were a compi•
lationfitinvhe best authorities.

case is easily comprehended. The allegation in
that the defendant indicted certain wounds on the
body of the deeeased, with a knife, on the eleventh
of September, Of which she died on the 16th of
September. Some of the main facts ere admitted
in this case—euch as that the wounds were in.

dam: that they were inflicted with a knife: that
they were the cause of death, and that the death
took place at the time and place mentioned in the
bill of indictment. The locality, the date, the cha
ranter, the means, the cause, and other circumstan.
ces of the death are matters not diaputed in this
case, and you are therefore relived from what, in
many other cases, is a:senous and great perplexity
to a Jury, in making up their verdict. It is nano
cessery (or us to dwell upon all the degrees of ha.
micideat all SYMMS upon the lower degree. of it
—for it has probably struck you, as it hes the court,
that this defendant to either guilty of murder in the
first or second degree, or he is guilty of nothing.
Still it may be neceasary to point out to you the
distinction between manslaughter and murder, and
also between murder of the first, and murder of
the second degree.
We may say, gentlemen, that the general
unction between manslaughter and murder is that
manslaughter proceeds from a sudden heat of the
passiona under the excitement of the moment—
that murder proceeds from the wickedness of the
heart, and a deliberate purpose of the mind. The
rook ordinary cases of manslaughter are those in
which two men, under the influence of passion,
meet and quarrel, and both becoming excited, fight,
and one kills the other in the course of the fight,
without having manifested any vicious intention.
Or having armed himself with any such intention,

ces mentioned in the act defining this crime which
would go to show premeditabon, such as lying in

We repeat to you that there are circumstances
of premeditation and preparation; and that the re
lationship between the parties. and the difficulties
in the family would go to impart to this transac
tion the character of deliberate murder in the first
degree. under the act of Assembly. unless you be•
here the situutton of the defendant in relation to
his mental faculties, should give to a o dttlerent
chancier, and that is the question for the jury to
determine.
[The learned Judge tben gave a long descrip•
tion of the different classes and degrees of insanity,
and observed that there was a wide difference be
tween such tnsanity as would disqualify a man for
the periormance of civil duties, and that which
would render h m responsible Gar the commission
of cnme, that if a man was not able to take a
reasonable care of his property, he would be de
elated insane, under a commission of lunacy, but
that Ile man was only partially insane, this partial
insanity would not relieve him from the respond'
bility of crime.l
He proceeded—Gentlemen. You have heard
much about insanity, and the effects produced by
the indulgence in the use of intoxicating liquors.
The Court would remind you that the pnnmple of
the law ia.that drunkenness is no excuse for crime,
and that it does not encase a many from the pun ,
ishment of crime. Bllt it is In go to the Jury in de
termining the question of malice and premeditation.
Where constant habits of intemperance result in
insanity, this is a sufficient excuse for an offence;
but when an offence is committed under the pre,•
ent effects of drunkenness, although a man may in
some measure be said to be insane, this is not the
kind of insanity which would excuse his crime.
But when it has assumed a permanent character.
as shown in efeiiriiirs 'rerun, or manta a poru, it is
an excuse, provided the offender is incapable of
distinguishing between right and wrong in relation
to the net he commits
We need not say that this is a ease of great mag
nitude. The community at large are interested in
having a full and fair investigation of a charge, the
mere relation of which is calculated to excite a
feeling of the deepest horror; and the prisoner in
deeply concerned, as his life is involved in the is
sue. I need not, therefore, invite your calm and
dispaaelonate consideration to a case of such map
nitride nod of such a thrilling character.
The charge in thin cane is fur murder, and is for
the pry to say whether it is murder in the first, or
second degree, or manslaughter, or not guilty.
The caw, it seems to us, is either murder in the
first or second degree, or a is nothing, and we nay
again that in all these calms there 115 a discretion
lodging with a jury of honest intelligent men to say
what the character of the offence is—whether il
is murder in the brat or second degree, or man
slaughter, or whether the plea of insanity ban been
fully and satisfactonly made out, and it in nothing
at all—that no charge is established. But we rev
if the jury are satisfied that this defendant was in
a state of permanent mental insanity, ouch as would
be recognised by the km as making him an irreg..
possible being, the verdict of the jury will be "not
guilty"—a conclualon which we think they will,
hardly arrive at. If, however, the circumstances
be such as to induce the jury to believe that the
defendant was irrenponsible, the jury may in their
discretion take that matter into their consideration,
and metre their verdict murder in the first or se
cond degree, or "not guilty."
In former cases, it has often been said out of
door, that a man was guilty of murder in the first
degree, or he was guilty of nothing. We say in
all these case, the jury have a discretion, and
nothing which the Court may now say is to be held
by them as influencing their decision further than
relates to the evidence.
If you believe that this is a caw of wilful and
deliberate killing, you must say so, uninfluenced
by any lellings of sympathy far the prisoner. You
must do your duty to society and to the hats of
your couniry. Yon must not be Influenced on the
one hand by any feelinga of indignation towards
the prisoner, on account of the fearful enormity of
the act, nor mum you sutler any feelings of sympa.

of duty to the commonwealth, and of law.
LOCAL MATTERS.
OF THE JFRY
We have said once, perhaps twice, that there
'are circumstances of premeditation—of delibera
non—and other circumstances conneeted with this
case to give it, to say the least, a /sulfa! character;
but you. gentlemen, are judges of the law and the
Acta. We have endeavored to give you what aid
we have been able to assist in arriving at a correct
conclusion.
We do not wish to influence your minds. You
have heard the evidence both on the part of the
prosecution and the defence . the ease has been
argued with great ability, and at great length, and
upon your judgment, and your verdiet,depends the
fate of the prisoner at the bar.
, The Jury then retired—the hour being half past
four. Between seven and eight they returned with
verdict of ' GUILTY OF M URDIZR n 1 TUX FIRST
We understand that a motion will this morning
be made in arrest'of Judgment.
Mr. Hiedleburg not wishing to communicate the
verdict of the Jury in persona, kindly requested the
intermediation of a priest of the prisoner's religious
persuasion, who informed him, yesterday morning,
of the position in which be stood.—We have not
heard what effect this visit produced.

the watch house. On Saturday night, we were
quietly smoking one of Wilson's best segars in our
sanctum, and ruminating over past events, when
our attention was aroused by a loud noise, as of
some person in a state of great excitement in the
street. We listened. the noise continued; and
feeling somewhat lazy, we ' puffed' away until the
noise assumed a somewhat serious tone. Sum
. atoning to our aid all the courage and coolness we
posiseased, we quietly laid down our cigar, and
walked into the street, supposing there was a `fight,'
and feeling a little anxious to ascertain the cause
of 'the row.' We sale nothing, bus the noise cons

thought some eminent divine was delivering an
excellent sermon. Being religiously disposed, sad
anxious to rub of the contagion of the week's ho•
suicides and murders, we stepped up—opened the
door very gently' heard speaking, saw lights,
bens and desks in admirable order, but sow no
body. Could'nt tell what to make of it. Listened
awhile, but .did'nt 'peep through the key hole,'
when by and bye a very polite door keeper came
and invited us in. Net understanding what the
nature of the "internal operations" might be, we
took a seat as near the door as possible, so as to
be prepared for an exit if occasion required. We
