This morning, the ease came up on the rule
to show .cause for contempt
should not issue against the Commissioners,
for not obey tog tbe mandatory, writ of the
Court, directing theni to bause Judgments
in question to be paid. “Messrs- Hamilton
and Acheion appeared in support of the rule;
and Messrs. Carnahan ana Geyer for tbe
Commissioners. 1 ,
Mr. Hamilton, in opjsalng his argumeni
stated that the Supreme Court had deoideaj
upon the validity of these railroad subacnp

The Cemmissionere (or 1 some of them) had
disobeyed the order, had been fined and im
prisoned for oontempt, had served out their

levied the tax, designating one portion of it mb
“railroad tax, "therebyrendering it as odious
as possible, and virtnaily inviting a refusal to
pay it. 'He was informed that, while the
taxes for the ordinary expenses of the county
were collected, as asutl,tbe duplicates for

Mr. Goyer followed on behalf of the Re
spondent*. Betook the ground that the Ux,
as levied; was a lien upon tho property of the
tax-payers, and that there was no escaping
from its payment. He alluded - to the onerous,
hardens of the tax-payers, and intimated
that if the connscl for the bondholders had
been as efficient in aiding tbe city and county
in effecting a compromise, as they have been
