And be it further enacted, That each and every collector, or his deputy, who shall exercise or be guilty of any ex tortion or wilful oppression, under color of this act, or shall knowingly . demand Other or greater sums than shall bo authorized by this act, shall be, liable to pay arum not exceeding double the amount of dam ages accruing to the party injured, to be recovered by and for the nee of the party injured, with stets of suit, and shall be .dismissed from office, and be disqualified from holding such office thereafter; Land each and every collector, or his deputies, shall give receipts for all MIMS by them collected and retained in pursuance of, this act. Sec. 27. And be itfortAcr enocto4 That a collector or deputy ,collector, assessor or assistant assessor, shall be authorized to enter, in the daytime, any brewery, distil lery, manufactory, building, or place where any property, articles, or objects, eubject to duty or taxation under the provisions of this act, are made, produced, or kept, with in his district, so fares itmay beneceseary for the purpose of examining said property, articles, or , objects, or inspecting the, ao; counts required by this act from time to time to be made. And every owner of such brewery, distillery, manufactory, building, or place, or persons having the agency or superintendence of the same, who shall re fuse to admit such officer, or to suffer him to examine said property, articles, "or ' ,' or toinspect sai4 accounts, shall; for every such refusal, forfeit and'pay the eum of five hundred dollars. Sec. 28. And be it further enacted, That if any person shall forcibly obstruct or hinder a collector or deputy collector in the execution of thia act, or of any power and authority hereby vested in him, or shall forcibly rescue, or cause to be rescued, any property, articles, or objects, after the imp shall have been seized by him; or shall attempt or endeavor so to do, the per son so offending shall, for every- such of fence, forfeit and pay the sum of five•htin deed dollars. Ssc. 29. And be it further enacted, That in case of the sickness or temporary disa bility of a 'collector to discharge such of his duties as cannot under existing laws be discharged by a deputy, they may Ds devolved by him upon ono of hLi deputies: Provided, That information thereof be im mediately communicated to the Secretary of the Treasury, and shall not be disap proved by him: Andproticledforther, That the 'responsibility of the collector or his sureties to the United States shall not be affected or impaired thereby. Sec. 80. And be it further enacted, That in case a collector shall die, resign, or be removed, the deputies of ouch collector shall continue to act until their:Successors are appointed ; and the deputy of such col lector longest in 'service at the. time imme diately preceding may and shall, until successor shall be appointed, discharge till the duties of said collector; and for the official acts and defaults of such dep uty a remedy shall be bad on tho official bond of the collector, as in other cases; and of Awe or more deputy collectors, ap. pointed on the same day, the ono residing nearest the residence of the collector at the time of his death, resignation, or removal, shall in like manner discharge the said duties until the appointment of a successor; and 'any bond or security taken of such deputy by such collector, pursuant to the fifth section of this sot, shall be available to his heirs or representatives to indemnify them for loss or damage accruing from any act of the proper deputy so continuing or so surceeding to the duties of such collector. Sec. 81. And be it further enacted, That it than be the duty of the collsetors afore. Ant ke;,it Idea? r enacted, 'That if any person, in any cape, matter, hearing or other pro ceeding in which an oath or affirmation shall be_ required to betake n or administered under and by virtue Ofthis act; shall, upon the taking of such 411th or affirmation, knowingly and willingly swear Or affirm . falsely, every person so offending shall be deemed guilty of perjury, and shall, on conviction thereof, be subject to 'like punishreent and penalties now pro ,iided by the laws of the United States for the crime of -perjury. Sec. 33. And; be it further enacted, Thmt separate isecounts shall be kept at )the Treasury of all moneys received from in ternal duties or taxes in each of the re4iec live States, Territories, and 'collection die trieta ; and that separate accounts shall be kept of the amount of each species of duty or tax that shall accrue, so as to exhibit, Fifer as maybe, the amount eollected,ftrom each source of revenue, with the, moneys paid to the collectors and deputy colleetors, and to-the other officers employed ` in each of the respective States"; Territories, and collection districts, an abstract id' tabular form of which accounts it shall be the duty of the Secretary of the Treasury, annually, in the month of December, to lay before Congress. SEC. 34. And be it _farther enacied, That there shall be allowed to the collectors ap pointed under this act, in fall odmpensa tion for their services and that.; of their 'deputies in carrying this act into effect, a commission of four per centum upon the first hundred thousand dollars, and two per centum upon all sums above , one bun tired thousand dollars; such commissions to be computed upon the amounts by them respectively paid over and accounted for under the instructions of the Treasury Department: Provided, That in no case shall Buell commissions exceed the sum of ten thousand dollars per annum, except 'as hereinafter provided. And there shall be further allowed to each collector his :meet eary • and reasonable charges for' station ery and blank books used in the peifor utance of his official duties, which, after being duly examined and certified by, the Commissioner of Internal Revenue, shall be. paid ant of the Treasury.: Avoided, That the Secretary of the Treasury bel au thorised to make such farther allowan4e ae may be reasonable in cases which, from the territorial extent of the district, or from the amount of internal duties collected, it may seem just to make such allowance; bgt the whole compensation shall not; ex ceed ten thousand dollars, except , in col lection districts embracing more than one Congressional district Sec. 35. And be it farther enacted, That when any duty or tax shall have been paid by levy and distraint, any person or per sona or party who may feel aggrieved - thereby may apply to the assessor of the district for relief, and ex.Mbitsuch evidence as he, she, or they May have of the wrong done, or supposed to have been' thine, and after a full investigation the assessor shall report the case, with such parts at the evi dence as he may judge material, including also such as may be regarded material by the party aggrieved, to the Commissioner of Internal Revenue, who may, if it shall be tirade to appear to him that such duty or tax was levied or collected, in *hole or la part, wrongfully or unjustly, certify !the amount wrongfully and unjustly levied or collected, and the same shall be refunded and paid to the person or persons or pirty at aforesaid, from any moneys in the Treas ury not otherwise appropriated, upon ;the presentation of such certificate to the pro.' per officer thereof. in all cues Of distraint and sale of goods, or chattels, for non-payment of taxes pro sided for in this act, the bill Of. sale of such goods, or chattels given by an officer making such sale to the purchaser thereof shell be conclusivii evidence of the right of the officer to make such sale, , and of :the correctness of his proceedings in : selling thO same. Sec. 37. And be it further enacted, That if for any cause, at any time after this act goes into operation, the laws of the; United States cannot be executed in a State or Territory of the United States, or any part thereof, or within the District of Columbia; it Shall be the duty of the President, and be is hereby authorized, to proceed to er emite the provisions of this'act within'the Itmits of such State or Territory, or part thereof, or District of ColuMbia, so soon as the aathority of the United States therein GUN be reestablished, and to collect)the sums which would have been due from the persons residing or holding property; goods, wares, or merchandise, objector article liable to any , duty, license, or tax, With in tartlet at the rate of six per centimt per annum thereon from the time such duty, Hoehn, or tax ought to have been paid until paid in,the .manner and underthe regelations prescribed in this act, so far as, kpplizable, and where not applicable the assessment and levy shall be made and the time and manner of collection regnlated by the instructions and directions of the Commissioner of Internal Revenue, under the direction • of the Secretary of the Sec. 88., And he it further enacte4 That the officers who may be appointed under this'act, except within those districts *Rh in any State or Territory which have` been or May be otherwise specially provided for by law, shall be' nd hereby are authorized, in all cases where the paymeit of such tax has hot been assumed by the State, to per for * all duties relating to or regarding the assessment and.chUection tittle direct tax imposed by an act entitled "An act to Provide increased ,r43Y013120 from imports, to pay interest on the public debt, and for other perposes," approved August fifth, eighteen hundred and 'sixty-one, or any direct tat which maybe hereafter enacted: Provided, That the - BUM of. nineteen 'thou sand!threeltundreti and twelve dollars, di rect tax,laid upon the Territory of Nebras ka by said act, shall be paid and satisfied by deducting said amount from the appro priation for legislative expenses of the Territory of Nebraeka'for the year ending thirtMth of- June, eighteen hundred 'and Sixty4hrSie ; and' no' further' laim shall be Madelby said Terrihiry for legislative ,ex pauses for - said Year: ;Tiedided ; furthir; That the State of Tennessee shall have until the first, day of Deeember !next to assume the payment ck her portion-of the tax , , 4P111.1111, ALINDSPORTER. And at the time of applying for said Items°, and before the same is issued, the person ,so applying shall give band- to the United States in such sum as shall be required by the collector, and with one or more'snretiet to be approved by said col lector, oondltaoned that in erase any addi tional still or stills, or other implements to be ueed as aforesaid, shall be erected . by him, his agent or superintendent, he will before using, or causing or permitting the same to be need; report 'in writing to the the said collector the capacity thereo4 and information from time to time of any change in the form, capacity, or oernershlp, agency, Or 'superintendence, which all or either of the said stills or other implements may undergo; and that he will, from day to day, enter, or cause to be entered in a book to kept for that purpose, the number of lens of spirits that may be distilled by Ladd still or stills, or other implements, And, also of the quantities of, grain or other vegetable productions, or otbe substances put into the mash tub, or- otherwise used byldm, his agent, or superintendent, for the ppeortupsoaee of• producing spirits, 'which said t 6sskibW bee . tit W times &Ding the v.•..?; • : =Si --day (Sundays excepted) tn the inspection of the said collector, who may mate any memorandums for 'transcripts therefrom: and that he will-rendertothesaid collector, on the firet, tintli,initt lweitieth days of each month, or within - five days thereafter, during the continuance af - said linear; an 'exacraecantit,' in Writing, 'taken - from Ma hooks, of the number - of gallons - of apiriti distilled; and sold,. or removed for, COUSWEip- Lion OPitiric by him , hie agent; or superin tendent, and the proof thereof, and also of the quantities of - grain ''or other vigetable prodnetiqn,•orothor • sebstances, put into the mash Cub, ,Or otherwise used by him, hisagent, or superiniehdent, forthe,pur poe of producing . spirits, for the period or fractional parf'of it' month then next' prii cedin the date Of said rOpint, which said repor shall be verified by affidavit in the ma r prescribed by this act; and that ho w' I not'sell or permit. to be sold, or re mov" I for consumption or site, any spirits distilled by him under' and by virtue of said license, until the same shalt have been inspected, gauged, and- proved; and the quantity thereof duly entered upon hie books as aforesaid ; : and that he will, at the time of rendering said account, pay to. the said collector the duties which by this act are imposed on the spirits so distilled; and the said bond may be renewed or changed, from time to time, in regard to the amount and sureties thereof, according to the discretion of the collector. Sec. 40. And be it further enacted, That the application in writing made by any person for a license for distilling, as afore saidohall state the place of distilling, the number and capacity of the still or stills, boiler or boilers, and the name of the per son, ; firm,. company, or corporation using the seine; and any person making a false statement in either of the said particulars shall forfeit and pay the sum of one hun dred dellais, tube recovered With costs of suit. Seo: 41. And be it further enacted, That it addition to_ the duties payable for licenses herein provided, -there shall be paid, on all spirits that mg be distilled and sold, or removed for consumption or sale, of first proof, on and, after the first day of'August, eighteen hundred and sixty two, the duty of twenty cents on each 'and every. gallon, which shall be paid by the owner, agent, or superintendent of the still or other vessel in which the said spirituous liquors shall have been distilled; which duty shall be paid at the time'of rendering the accounts of spirituous liquors so chargeable with duty, required to be ren dered by this act: Provided, That the duty on spirituous liquors and all other spir ituotfit beverages enumerated in this sat shall be collected at no lower rate than the basis of first proof, and shall be increased in proportion for any greater strength thai the strength of proof. Sec. 42. And be it further enacted, That the term first proof used in this act and in section six of the act of Match second, eighteen hundred and sixty-One, entitled "An act to provide for the payment of out-• standing Treasury notes, to- authorize a loan, to regulate and fix the duties on im ports, and' for other purposes," shall be construed and is hereby declared to mean that proof of a liquor which 'corresponds to fifty degrees of TralleS contesimal hy drometer, adopted by regulation of the Treasury Department, of• August twelfth, eighteen hundied and fifty, at the tem perature of sixty degrees of Fahrenheit's thermometer; and that in reducing the temperatures-to the standard of Sixty, and in levying duties on liquors above and be. low proof, the table of commercial values, contained in the manual for inspectors of spirits,' prepared by Professor AlcCulloh, under the superintendence of Professor Bache, and adopted by the Treasury De partment, shall be used and taken as giving the proportions of absolute alcohol in the liquids gauged and proved according to which duties'shall be levied. Sec. 48. And be it further enaeud, That there shall be designated by the collector in every assessment district where the same shall be necessary one or more inspectors, who shall take an oath faithfully to per form their duties in such form as the Com miseioner - of Internal 'Revenue shall pre scribe, and who shall be entitled to receive such fees as may 'be fixed and prescribed by said commissioner. And all spirits dis tilled as aforesaid by any person licensed as aforesaid shall, before the same is used, or removed for consumption,, or sale, be inspected, ganged and proved b'y .soms per son so as aforesaid'desigiated for the per formance of such datieti, and who shall mark upon the cask or package containing such spirits, in a manner, to be prescribed by said commissioner, the quantity and proof of the contents of such cask or pack age, with the date of inspectiOn and the name of the inspector. ; And any person 'who shall attempt fraudulently lo evade the payment of duties upon Zany spirits dis tilled as aforesaid, by changing in any manner the mark upon any such cask or package, shall forfeit the isum of five hun dred dollars for each cask or -.package so altered or changed; to be recovered as hereinbefore provided. And the. fees of such inspector shall in all cases.be paid by • the owne r of the spirits so inspected, ganged, and proved. And any stich inspector who shall knowingly put open any such cask or package any false or fraudulent mark shall be liable to the same penalty herein before provided for each cask or package so fraudulently marked. And any person Who shall use any cask or packade so marked, for the purpose of selling spi r it s of a quality different from that so inspect ed, shall be subject to a. like penalty for each cask or package so used. Sec. 44. And be it 'entity enacted, That the - owner or owner& of any distillery may erect, at his or their owwespentie, aware house of iron, stone, brick, with Metal or other fire-preef roof, to be contiguous to such distillery; and such warehOuse, when approved "by. 'the collector, is hereby de clared a bounded warehouse of the United Ste*, and ishall be used' only for storidg diritilled spirits, and to be under, the custo dy .of the , collector or his deputy. And the duty on the spirits stored in such ware house shall be paid when'and as it is sold or removed from suish warehousefor sale. Sec. 45.
