Sze. 2. And be it farther enacted, That
it shall bo the further i duty of the said
officer, before making hid return, according
.to the first section of tiffs ?aot, to affix to
the made his affidavitin ihe following form;

contraet hereto annexed is an exact copy

clude all those relating to the said con.'
tract, as required by the statute in such
case made and provided." And any officer
convicted of falsely and corruptly swear
ing to inch affidavit, shall be subject to all
the' pains and penalties now by law in
flicted for wilful and corrupt perjury.'!
Soo. 8. And be it further enacted, That
any officer making contracts, as aforesaid,
and failing or neglecting to make returns
of the same, accordineto the provisions of
this act, unless from unavoidable aebident
and not within his control, shill be dam-
ed, in every case of each failure or neg
lect, to be guilty of a! misdemeanor, and,
on conviction thereof; shall bb punished
by a fine of not less than one hundred dol
lars, nor more than five hundred dollars,
and be imprisioned for not more than six
months, at the discretion of the court try
ing the same.
Sec. 4. , And be it further enacted, That
it shall be the clay of[ the Secretary of the
Interior, immediately !after the passage of
this act, to provide a fit and proper apart
ment in his Department, to be called the
"Returns Office,' within which to file the
returns required by this act to be filed, and
to appoint a clerk to !attend to the same,
who shall be entitledi to an annual salary
of twelve hundred dollars, and whose duty
it shall be to file all returns made to said
office, so that the same may be of easy ac
cess; filing all returns made by the same
officer in the same place, and numbering
them as they are made in numerical order.
He shall also provide and keep an index
'book, with tho names of the contracting
parties, and the number of each add every
contract opposite to the said names ; and he
shall submit the said index book and se
turns to any person desiring to inspect the
same; and he shall also furnish copies of
said retains to any person paying for said
copieo.to said clerk, at the rate of five cents
for every one bundled words; to.which
said copies certificates shall be appended
in every case by the clerk making the
same, attesting their icorreetness, and that
each copy so certified is , a full and ,eom
plete copy of said return; which return, so
certified under the seal of tha Department,
shall be evidence in all prosecutions under
this act.
Sea. 6. And be it further snacted, That
it shall be the duty of the Secretary of War,
of the Secretary of the Navy, and of the
Secretary. of the Interior, immediately after
the 'passage of this act, to furnish each and
every officer severally appointed by them
with authority to make contracts on behalf
of the Government, with a printed letter
of instructions, setting forth the duties of
such officer under this act, and also to
furnish therewith forms, printed in blank,
of contracts to be made, and the affidavit*
of, returns required to be affixed thereto, so
that all the instruments may be as nearly
uniform as possible.

Representatives of the United States of Amer
ica in anuresis - assembled, That - all the lands
belonging to the United States to which
the Indian title has bean or shall bo ex
tingiiished shalt be subject, to the opera
tions of the pre-emption. ast of the fourth
of September, eighteen hundred and forty
one, and under the Conditions, restrictions,
and stipulations therein mentioned:.Pro
vided, however, Tiust when unsurveyed
lands 'are claimed;by pre-emption,, notice
of, the specific' tracts claimed shall be-filed
within six months after the.. survey has
been made • in'the ifield ; and on failure to.
1 1 file such notice, or to pay for the tract
claimed within twelve months from the-
filing of such notice, the parties claiming
such lands shall ferfeit all right thereto,
provided said notices may be filed with the
Surveyor .General,; and to be noticed by
him on the township plats, until other ar
rangements have been. Made' by law for
that purpose. I
See.. 2. And be it further enacted. That
the.publio hinds within: the Territory of
Colorado to which the Indian title is or
shall be extinguished shall 'constitute
new land district" to be called the Colorado
district; and the President is hereby au
thorised to appoint, by and with the ad
vice and consent • Of the Senate, a register
and receiver of public moneys for said dis
trict, who shall be required to reside at the
place at which • said office shall be located,
and they shall haVe the tame powers, per
form the seine duties, and be entitled to the
same compensation as are or may be pre
scribed by law in relation to land offices of
the United, States in the State of Kansan.
