Joshua K. Giddings eommunicates to the
New York Independent a very interesting his
torical Tact, showing bow and when the dis
cussion of the question of property in man
arose. And those of our readers who have
been wont to look upon the venerable &Haim
Whittlesey as fogyish in his principles involv
ing theanti-slavery issues, will be surprised
to learn that he, in Congress, in 1828, was the
leader of those who denied that slaves are
property. Mr. Whittlesey hold the same
views upon that question as have been advo
cated by Mr. Ewing. Those extreme anti
slavery men who have fancied the ides that a
person cannot be property is an original idea,
with them, can see how easy it is to be mis
taken.
Mr. Giddings, in his article, says that In
1828 a discussion upon that question was
brought on in the flouee ; and but once before
had it been presented, when, with great unan
imity, the principle that slaves are property
was rejected. The case in '2B arose thus t In
the war in 1814 a horse, cart and slave of
hfarigny D'Anterive were impressed at New
Orleans, the cart destroyed, the horse killed,
and the slave wounded. A traits:was presen
ted to Congress ; the committee reported in
favor of paying for the horse and cart, but as
to the elave'said "the Government had not
regarded slaves as property, noripaid furthers
when lost in the public service." Wben . the
bill came up an amendment was offered grant
ing eompensation for the slave..
Mr. Whittlesey, of Ohio, a member of the
committee on claims, had repotted the bill, and
he was 120 w expected to. defend and vindi
cate the action of the committee. He was a
lawyer f reputation, a man of :facts and 13gz
urea, rather than a rhetimician. 'The indomita
ble industry gave hint no somillnflnence, par
ticularly in the department of private claims.
Possessing great integrity ofeharacter,,he was
at all times unassuming, and bedcover aspired
to the position of a "speaking member,"
But

hesitate meet the distinguished gentleman
who moved the amendment...lle spoke like a
lawyer who had prepared his case for a hear
ing. Avoiding all reference to fundamental
principles, be applied , himself to the i,,w of the

tion of the Constitution. Ile Cited every re
port that had been made, either in print or in
manuscript, and showed that one undeviating
rule had governed them all, land that was a
constant rejection of every similar claim. He
went further back, and showed:that during the
Revolution, although many slaves were lost Mt
the public service, none bad been. paid for.
The question had only once beans presented to
the House of Representatives. In-418, when
passing a bill to indemnify persons:Tor prop
erty lost is the Oldie service, a gentleman
from South Carolina ,moved -an authdment ,
authorising payment for slaves, but the prop
osition was rejected by en overwhelming ma
jority.
t was now clearly seen that serious work

was before the House. But Mr. Whittlescy
was sustained by Mr. McCoy, a slavehOlder of
Virginia, also a mamber.of thecommittee; the
only man whu spoke against the amendment
attempted in 1816. It was also knoisn that
'Mr. Williams, of North Carolina, a mail of
great experience, and chairman of the commit
tee, concurred in the report. These .
stances added much weight to the argument
of Mr. Whittlesey. •
The slaveholdert, with the abeeeirZeeptiOD a,
argued that slaves were property,. end the
debate continued with great warmth for two
weeks. Thb ablest men of the nation en
gaged in it. The most breathiest attention
was bestowed on every speaker. A pro
found Interest and even deep solemnity rest
ed on every countenance, whin suddenly
John Randolph, o f Virginia, sprang to the
floor. His ofibminate voice, now raised to
its utmost volume, rang shrilly through
the hall, and pointing his long finger to,
ward the speaker he exclaimed, Lex im seri:au.

Or religion ; and when pint deny that davits
are our property, we shall not be found in this

'our hands." HIS trioeeeded to lecture Southern
members for consenting to argue the question,
and declared it to be that true policyito hold
no controversy on the - subject. This policy
was 'inippated by-ether Members, ;who pro
. claimed the solemn determination oftlitientha
South not to permit Ulla question 'Witte dis
cussed. Perhapeno incident bitter illustrates
the "madnessof the hoar" than the solemn
assurance by Mr...Drayton, of South Carolina,
that when this question should be agitated,
the slave Stamm would "consider ti, batik of
the Mimi." The vote 'was taken on the
amendment and it carried by three - votes, and
the bill' went to its engrossment, coming up
the meat day for final passage. The debate
was renewed, and a Northertrmember moved
the reooturnitment of; the bill - to thecommittee,
.in order to strike out the amendulqt. That
motion carried, and the elitim for that slave
was no more heard.

Exodus of Contraband;
Tare seems to be an amazing exodus of
Slaves from Virginia to within our lines. A
large number of contrabands 'have come into
Winchester and Leesburg claiming the pro
tection of our troops. In no case has one of
them been delivered up. At Winchester,sixtir
of these people came in in one day, and there
aro several hundred of them at that point.
All the reliable information respecting the re
treat of Jaelron in the possession of General
Banks was obtained from fugitive slaves, and
he, at least, needed no new article of war to
prevent him from returning-the poor fellows
toy their masters, whether rebel or loyal.
A letter to the New York Woridifrom a
correspondent' who has spent mine time in
the neighborhadof Manassas, makes the fol
lowing remarkable 'statements:
The "contraband," form an item swhich is
certainly not among the least interesting. I
saw, during my absence, bundreds#.-I think
could truthfully say thousands—of both sexes
and all ages,.bound toward Washington. I
talked to many . of the negroes ' and I must
alf 2 justice, that they are decidedly the
.most intelligent and beet informed residents I
found in. Virginia, and, they certainly convey
ed :eatable information, making due allow
ance for the extravagance and superatitien of
theirrace. A'party came into Manasias early

of triumph, to express his joy. A fioek of
nearly a hundred were stopped by Bull Run,
the water being too high to admit of crossing.
Every one had a package of motley contents
slung arose his shoulders, but, beyond this,
true to the improvidence which they have been
taught by slavery;_tliey " tOok'no thought for
the morrew," but were jolly and full of sag,

about six miles from Fayetteville, Ark., the
owner of a tract of six hundred acres of land,
with comfortable dwelling,strick, rim. Obnox
ious to the secessionists, his property was
plundered by. their foraging and other parties
during the Winter, his place being about a
mile from McCulloch's headquarters. Tho
consisted' of Mr. Smith, his wife and
child, his mother-in-law, and also a brother-
James Watkins and wifo„,married less
than a year ago. Besides these, Charley, the
slave of Mr. Smith.
Upon news of the approach of Curtis' forces
to Springfield, the Secessionists began purse-.
leg -all the Union men to hang them, and"
Smith and Watkins fled, hoping to make their
way to some of the Federal camps. The wo
men thus left, in fear of 'outrage and torture,
on their husbands' - account—if not death
left their home on the night of the Sith of Feb
ruary, with Charley as their guide and pro
teotor, leaving the aged mother and ehild, who
were unable to amore. On foot they wended
their way, sleeping what they did sleep in the
open air, upon such straw or litter as Charley
could gather for them, and covered by the-sin
gle blanket which he carried, and, subsisting
upon the food which he carried in a . pair of sad
dle-bags. He would have been se ised as mar
ketable property belonging to a Union man,
and the women regarded - theirown jeopardy
as something more than that of their lives, if
'met Sr caught by the secessionists.' They
travelled, he „thinks, about eight miles the
.first day, (the women being feeble, and one of
them in a delicate situation,) fording' creeks
and avoiding the travelled roads. On one
occasion, crossing a creek upon a log, one of
the ladies fell in, and' was with dif fi culty ex
tricated by Charley, who, as he said, "(mimed
it on do leg," so that his mistress got hold of
him, and when she reached this bank, he
pulled her out. Thus, for nearly a week,
foot sore, and with short and painful jour
neys, having no shelter, and not seeing • fire,
subsisting on the scant provisions which
Charley carried, their slowly made their way
until they first 'mot the advance guard of the
Federal threes of Mudtown. Here the ladies
were at .once oared for by the Colonel, while
Charley was taken some miles on horseback to
"Mister Sigel," who eistained him at great
length, comparing his stories' with his own
maps of the country. He was satisfied of
Charley's' truthfulness, and Rave him a pass
for himself and two !sties:

Charley is , a preacher; he trays, and seems
intelligent for his:condition, and manly in his .
bearing. His wife, belonging to another
master, was sold off tints 'Louisiana some

Charlej is anxious now to get into Illinois,
where ho can find work to support these two
Indies:' Says hb is stout and has a good trade
—"can lay brick or rock, or work, on do farm,
and airn enough to keep them." They are

Charley's narrative is artless and exceedingly
'interesting. Speaking of Mr. Smith, in an
