ty street, in tb* city of Pittsburgh,’extending from
Grant street eastwardly totbe line between the Fifth
and Ninth ward* of said city, by the Pennsylvania
Railroad Company for its .track* and roadway, ren
ders the use thereof for all other and ordinary pur
pose of travel exceedingly dangerous apd inconten

lute the best and most practicable outlet eastward
from the said city, it is deemed imperatively necessa
ry to again secure the free and unobstructed use of
that portion of Liberty street, so occupied by said
Railroad Company. And

uate on the south side of Lilterty street and Quarry
street from the line between the Fifth and Nlntn
wards aforesaid, to Washington street, whereon its

Therefore, Be it ordained and enacted by the
Mayor, Aldermen and citizens of Pittsburgh in Select
aad Common Councils assembled, and >it is hereby
ordained and enacted by authority of the same.
Section Ist. That in pursuance of the power dele
gated to them by on Act of the General Assembly of
the Commonwealth of Pennsylvania, approved the
fifth day of April, A. D-, 1860, they do hereby vacate
and surrender to too Pennsylvania Railroad Compa
ny the following streets, alleys, passage ways and
foot way in the city of Pittsburgh running through
and adjoining the promisee and Tots of land intended
to l>o purchased and occupied as aforesaid by the
said Railroad Company as follows, to wit:
All those portions of -O'Hara, Factory, Adams,
Walnut, Mechanic and Harrison streets lying on the
south side of the present south curb-line of Liberty
street.
Abo, all that portion of Elm street lying on the
south side.of the present south curb lino of Libery
street to Its point of intersection with Faber street.
Also, all that portion of Quarry street from tbo
point of intersection with Elm street eastwardly to
the liue between the Fifth and Ninth wards aforesaid.
Also, all that footway or pavement, twolve feet
wide, lying on the south side of Liberty street and
extendi ug from the east line of Washington street to
the line Imtween the Fifth and Ninth wards afore
said. 4
Also, all public alleys and passage ways located or
being in or upon the squares or’blocks bounded by
tbe streets ana footways hereby intended to bo vaca
ted and surrendered.
Provided nevertheless that no street, alley, passage
way or footway, or portions thereof herein mentioned
shall be closed or obstructed until said Railroad Com
pany bos obtained possession of 'the property or lots
of groufld respectively fronting or abutting thereon.

and surrenders as Aforesaid, tho said Pennsylvania
Kullr.ud Company shall and will immediately upon
the passage of this to obtain In le
gal and proper manner possession of the promisee and
lots of ground fronting on the said streets, alloys, pas
sage wuys and footway, os specified and included iu
Ibe preceding section, and shall and will continue dil
igently to obtain as aforesaid the possession of the

said Railroad Company, shall, after such acquisition
