Gazette says:
"The amount of the whole thing, sitiord-
log to - the latest advice' is, that Col. Tyler
was leisurely enjoying himself it,brinikfut,
when. by means of 'surprise, that can only
be accounted for on the theori of terrible
carelessness in the pickets and sentries, be
was suddenly surprised and attacked by •
superior force of the etiainy. There was no
fighting eicept the single rush. Oar men,
sating under the orders of Col: Tyler, from
Gen. Gm fell back, but did so in great' dis
order, losing fifteen men.. Major casement,
who. with four hundred men, bad been sep
arated from the main body of the regiment,

the whole regiment was mustered and found
to have but the 'fifteen above mentioned
missing. No serious evil is apprehended
from the affair, but it is mortifying that the
r ime should have been "surprised" in such
a manner, and that the lose of fifteen should
have been experienced without any conse
quent gain."

It teems to be doubted by some whether
Gen. Fremont had the sanction : of the Govern
ment in taking the important step of proclaim
ing Inertial law, andtringing,lltimouri under
the Operation ofitui Ac.(kaseed at the late ses
sion of Gamut's, commonly tailed the Con
futation Act.
Why should such a question arise f unless
it is implied that snob Acts were to remain
without force—mere brute= fin—and that
the Government should withhold its hand till
Rebellion had done its utmost and attained its
tallest strength. What folly of thought; what
pusillanimity of action !
Clearly the time had come-rfully _ come—to
bring Missouri under the operation of the
Confiscation Act, passed by Congress to
strengthen the hands of the Government for
the suppression of this Rebellion; and if we
suppose that General Fremont has not directly
had instructions from Washington, can_ we
reasonably doubt that the general instructions
under whieh he assumed the command of his
department did not from the first 'authorize
this important step
Be this as it may, the hips] prers of the
Country, without an eaceptioti in the Northern
States, will stamp the with public appro
bation. And even if the loypl, but peculiarly

FREMONT'S PROCLAMATION

Sr. Lours, Sept. I.—The subjoined ex
tract from the Republican, the leading
democratic paper in this city, is a fair ez
pression of the feeling with which the
proclamation of Gen. Frehiont is regarded
by the citizens of St. Lou.:s, many of
whom I have seen to-day, and all of whom
declare that the decided action of the
commanding General is timely and right.
The Republican says:
-The proclamation of Major General
Fremont, which appeats in another co!-
, umo, is the • most important . document
which has yet appeared In the progress of
the war. Let it be read with careful
consideration by every citizen., The
prompt visiting of the extra:mit penalties
of martial law upon all rebels' within the
established military lines; the, confiscation
of the properly of fictions who stall — take
up arms against the government; and the
declaration of absolute freedom to the
slaves of all each persons; the extreme .
penalties to be visited upon bridge burn
era, railroad and telegraph destroyers,
treasonable corressondence and libels, and
peace destroyers-of all kinds„ are meas
ures of the mosteztriordinary stringency;
bat the wisdom of their promulgation by
the supreme officer in 'the army of the
West we are confident orilk-bo conceded
by every just and loyal citizen.
-- There is no longer any middle ground
or room for traitors where the lawful goy
ernment has sway. Gen. FreMont strikes
boldly and fearlessly.. The cimsolidated
patriotism and. he hominess resources of
the great Northwest are at his beck.. Let
every faithful man, by word,and deed,
mead and encouragement to this grand.
