Coroner{ Bostwick investigated the matter
• folly, which has resulted in, the commitment
of Fortner to the county jail, : to answer a

The witness, with, three others, stood about

which he fired. There' were no Moan thrown
until after the firing. Some of the party were
under the influence of liquor.
Mrs. Jade - Fortner', was of the defendant,
testified that she was is bedyrith her husband,
and they were wakened by noise _outside the
house, &oilstones thrown "through the window.
They both got up, and found two men at the
door. ' They ume rushing in, swearing that
uther would. kilt him and .all lus' ',family.'" I
Fortner shot three times,' etandhtg id his own

were rushing in at the gate. - Mr. and Mrs.
Fortner ran out at the back door, and when

Samuel- Leech testified that he was called }

Drs. J. Et Vidikirk and John E. Shafer made

Charge. ALcommitment was therefore made
out against im by a Justice of the Peace, and
he was tent'down tothis city in outody of an
officer. -
The commitment was radically defective in
not desiguallog the-ellanse with 'which the se
eased stood 'Charged, and the jailor refused to
seedva the body..
At the unread= of Mr. Haihrouek, counsel
for Mr. Fortner, he delivered himself into the
custody of the Coroner, who }committed him
upon a charge of murder, on oath of the jury

On Thursday aftemoa, about four

_The report:that two genuine Secessionists
bad been captured, spread like wildlire, and
the Mayors. Mlles wu presently Nudged by a
Lugs and indignant crowd; who • manifested
an itching desire to - ase them as they - are wont
to use Northern men who fall into their bands.
This feeling assumed each a pitch that Mayor
Wilson deemed it prudent to clear the office,

When order was restored the men were in.

he belonged to Richmond; Vs., where he had
been employed as steward in a hotel. lie also
stated that he was on his way to New York ;

Clevelind and Baffalo • that their baggage bad

Wellsville and came to this city by the Ohio
river.

telegraphed to in regard to the baggage of

Capt. Fonts left this city as First Lientenant
in Company K., Seventh Regiment, and was
pion after promoted to the Quartermaster's De
partment, a position which he filled with cred
it to-himxell and satisfaction to the entire Reg
iment His recruiting office (a temporary
Wooden structure on Smithfield street, near
Filth) Ins been opened bat a single day, and .
he, now hu forty.five recruits.. Uniforms,
conaisting.ol jacket, pacts and cap, of regular
army cloth, are now being provided for the
intim, and as soon as fifty are enrolled they
Will be clothed and quartered in the city un
til the company is made up. They will not
be required to go into camp, but will move at
imee to the seat of war, under the company
officers which they may select. This is a rare
Chance for good men wishing to - enlist . for se' iirar. A better is not offered.

-The Captain of the Dayton Light Guards,
Miss Adah Isaacs Menken, has 'a benefit to
night, and as it is the last but one of the ses

succeeded in drawing fashionable eudiencet
at tbe Theatre - for the past four night,, and

Henderson, we learn, has a strong company
engaged for the fall season, when be will pro-
