State Supreme Court decided here
yesterday in denying his application
for a new trial.
The court decided there was no
reversible error in the proceedings
which led to Mooney's conviction and
serttence to death.
Mooney still lias a chance for life
through executive clemency of Gov
ernor Stephens. Some time ago a
special mediation commission ap
pointed by President Wilson and
headed by Secretary of Labor Wilson
investigated the Mooney case and
i recommended to the President that
| Mooney be given a new trial.

New York, March 2.—Stocks were
freely offered soon after the uncer
tain opening of to-day's short ses
sion, activity increasing as losses
became more extensive. No part of
■ the list escaped the selling move
ment, but equipments and specialties
proved most vulnerable. Recessions
of two to four points were made by
Baldwin Locomotive, Crucible Steel,
Marine preferred, Atlantic Gulf,
Texas Company and Airbrake. U. S.
. Steol, Bethlehem Steel, coppers and
high-grade rails forfeited one to one
and a half points. Irregular rallies
marked the later dealings. The clos
ing was heavy. Sales approximated
250,000 shares.

Gunner Who Sunk U-Boat
Commended by Daniels

Washington, March 2.—Benjamin
H. Groves, a chief gunner's mate,
has been commended by Secretary
Daniels for his zeal and efficiency
on January 13, when the American
ship Nyanza, on which Groves was
commander of the armed guard,
sunk a German submarine in a bat
tie lasting two hours and a half.
Groves' home is in New Bedford,
Mass.
After the Nyanza had fired ninety
two rounds and the submarine ap
proximately 200 rounds. Groves got
