The Webb! resolution proposing a national pro- , hibition constitutional amendment was j ; reported to the House with a majority committee report in its favor and a I minority report opposing It. Demo- cratic Leader Kitchin said it would be taken up in the House within a week. He predicted it would pass the House by the necessary two-thirds, but prob ably would not be acted upon in the Henate before adjournment of Congress, March 4. J. M. McCarrell. Abram H. Reider, foreman of the Jury, stated in court that the twelve men were about equally divided as to the guilt of Frazer. who is accused of stabbing Charles Smith, last October. A request was made that part of the testimony in the case be read, but the court told the jury that the testi mony should be remembered. The frame of mind in which Frazer was said to be in when lie left the Wash ington hotel on the night of the mur der was one of the things which the foreman explained, some of the jury men could not agree on, and also whether Frazer actually lay in wait i I for Smith while the latter was in the saloon. i Autoist on Stand William C. Fickes, of Newport, took the stand this morning: in his own de- i fense, and declared that he was not running his automobile at a fast and ' dangerous rale of speed when he ran ! down and killed little Joseph Ilusek, aged 10, in an accident near Jednota. Witnesses for the Commonwealth expressed opinions that Fickes was - driving at a rate of at least 30 miles an hour when he struck the boy. The case is expected to reach the jury thia afternoon. Among the witnesses who may be called to testify are ex-Judge James Shull, of Perry county, Senator E. E. Beidleman and Arthur H. Hull, are attorneys for Fickes. i Woman Released Mary E. Washington, who was ac- quitted last week on a charge of mur der, was released this morning. Habeas corpus proceedings had been started, but District Attorney Michael E. Stroup who asked last week that the woman be held, stated that he had no further charge against her. With the closing of the Fickes case, the special uesslons of criminal court will end.
