of th© first hour Canadian Pacific liatl
extended its loss to over four points,
and other high-priced shares, particu
larly specialties, were affected In simi
lar degree. American Tobacco, Inter
national Nickel. General Motors, Willys-
Overland and Mackay Companies were
three to 6% points under yesterday's
final quotations. Crucible, as well as
other early strong features, yielded to
moderate offerings. Leaders, Including;
United States Steel and Coppers, reced
ed more moderately. Selling appeared
to be largely of professional origin, but
certain issues suggested a recurrence of
last month's liquidation. Bonds were
lower.

Brewers Lose Out in
Their Subpena Fight

Pittsburgh, Pa.. Feb. 16. United
States Attorney E. Lowry Humes, for
the Government, won the first skirmish
in the brewery probe, through the re
fusal of Judge Thomson in a decision
handed down yesterday afternoon to
quash subpenas issued ten days ago.
Judge Orr dissented in the following
memorandum:
"I do not think I should dissent from
the foregoing order, because the mat
ter is one for Judge Thomson alone
to decide. However, as I said on the
bench during the argument for the mo
tion, it is proper that I should express
my dissent from the views of the Court.
If the matter were for me to decide, I
would quash the writ of subpenas duces
tecum."
Following the handing down of the
opinion by Judge Thomson and the note
of dissent by Judge Orr. It was an
nounced by P. P. Hlbhard, of counsel
for the brewery association, that none
of the latter'f) witnesses would be per
mitted to testify before the Federal
grand jury until the opinion in the
case had been examined.

At the annual meeting of the Penn
sylvania State Association of County
Fairs, in Philadelphia yesterday, h
resolution offered by Abner Deysher, of
the Reading; fair, was adopted calling
for an additional assessment from each
fair, to be used in testing the law rela
tive to a State appropriation allowing
each fair $2,000 and not over $4,000 for
any one county, in some cases the
county commissioners have paid SI,OOO.
where there is two fairs in one county,
and in other counties the commissioners
have refused to pay more than $2,000
A test case will likely be made In York
county, where there are six fairs held
annually, and the result of this case
will decide the standing of the remain
ing ones. All State appropriations ar<*
exclusive of amounts paid for the trot
ting, pacing or running races held by
the fair receiving same.
In approving this act. Governor
Hrumbaugh wrote: "Approved the 18th
day of June. A. D. 1915, in the sum of
$50,000. X withhold my approval from
the remainder of said appropriation be
cause of insufficient State revenue." The
proposed test will show Just where the
Pennsylvania fair associations stand in
this matter.

Poisoned Girl Not in
Condition That Threatened

Will Orpet. the University of Wiscon
sin student, held at Waukegan since
the death of Marian Lambert, will set.
up as one of the mainstays of the de
fense the allegation that the girl knew
two weeks before she died of poison
in the woods at the edge of For
est tlint she was not in a condition that
threatened disgrace.
This announcement threatens to
change the entire aspect of the legal
battle upon which hangs the fate of
the young collegian.
It has been the theory of the State,
that Orpet gave the girl cyanide of
potassium on the pretense that it was
medicine meant to relieve her condition.
Tt is the contention of the defense thai
if Miss Lambert knew she was all right
It is unreasonable to believe Orpet could
have persuaded her to take the fatal
draught.
