8 SUPREME COURT OPENS SESSIONS HERE Potter County Court Mandamus Up; Coal Tax Continuance; Dinner For Justices Application was made to the Su preme Court to-day for a writ of mandamus on Judge A. G. Heck, of the Potter county courts, requiring him to show cause why he should not rec ognize the act of the legislature in attaching Clinton county to the Pot ter county district. The Governor on j May 15 signed the bill detaching Clin ton from Elk and Cameron and at taching it to Potter and a petition was presented to Judge Heck by a Clinton , county citizen for action in an estate. . The judge declared that the aut was | unconstitutional and declined to rec ognize It. When the petition wag pre sented to the court to-day by W. M. Hsrgest. Deputy Attorney General, ap pearance was entered for Jtidge Heck by Jesse E. B. Cunningham, who filed 1 an answer, and argument will be held before the ejid of the week. It Is a question of law only, the attorneys stated. Hard Coal Oa.«cw Up The court wajs asked to continue the ar.' hracite coal tax cases and a date will be fixed for July or October. The Penn Mutual cases, involving Insur ance taxes, were also continued. Xo action was announced in the ap peal of Perry county license oases which was filed laat weak. Captain G. P. Lumb, Harrisburg: E. Ross Kauclc, Lnxujaster; T>»vi F. Mercer, Me ch.mlc.sburg. and C. J. Stahle, Gettys burg. were, admitted to practice. The Carlile-People's Bridge Com pany rase, from this county, was non prossed and continuances granted to a number of Dauphin county cases. The first case argued was that of D. W. Cox vs. the Pennsylvania Railroad, in volving damages for car service. The case was tried in this county in 1908 nnd Mr. Cox recovered. John G. John son appeared for the Pennsylvania Railroad with Oharles H. Rergner. Flettz. former Deputy Attor ney General and prominent in the affairs of Pennsylvania, will give a dinner at the Harrisburg Club to-mor row evening in honor of Justice John P. Elkin. of the Supreme Court, with whom as Attorney Genarai Mr. Flelta was associated in the legal depart ment of the Commonwealth for sev eral years.
