Vallerchamp against the company for injuries she received when she n'as struck by the car. The accident occurred, it was set forth, when Mrs. Vallerchamp tried to board a pay-as-you-enter at Reservoir and Whitehall streets. The street had been excavated to some extent to al low feu- removal of car tracks and Mrs. Vallerchamp says she was standing beside the rails on a pile of earth when the car approached and knock ed her down. The traction company raised the question ax to whether she was standing on the earth or on the tracks. Mrs. Vallerchamp says the motorman didn't use proper caution under the circumstances. While Judge Henry was sending this case to the jury, President Judge Kun kel was hearing the closing testimony in the case of Mosea vs. John Minsker, the ejectment proceeding brought by Moses, a TS-year-oUI Powl Valley farmer, against his son John to recov er possession of the former's farm.
