and 10 o'clock in the forenoon, and shall conliimo
without interruption or adjournment until 7 o'clock
in the evening, when tho polls shall bo closed,
Tho qualified citizens of the several districts and
towiuhips shall meet on the Fridiy next preceding
the second Tuesday of October next, to wit: on
Friday tho 4th of October, 1839, at the several pla
ces now' prescribed by law for holding tho district
and township elections and each of said qualified
citizens shall olo by ballot for one person as Judge,
and also for ono person as Inspector of election, and
the person hiving the crcatwt number of votes for
Judge hall Le publicly declared td be Judgo of elec
tions, and llio two persons having tho greatest num
ber rif votes for Inspector shall b6 pnblicly declared
to bo Inspectors of elections. Hut when any town
ship lias been or shall be divided in forming an elec
tion district, Judge and inspectors of tho election

has been or shall bo divided iu foiming an election
district, the qualified citizens of cadi part of buch

In pursuance of on Act of the General Assem
bly of tho Commonwealth of Pennsylvania, enti
tied " An act relating to the elections of this Com
monwealth," pasted tho 2d day of July A. D. 1833,
Notice is hereby given,
"That every person, except justices of the peace,
who shall hold any olHco or appointment of profit
or trust under the government of the United States',
or of this State, or of any city or incorporated dis
trict, whether a commisuoned ollicer or otherwise,
a subordinate officer or agent, who is, or shall be
employed under the legislative, executive or judicia
ry department of this State, or of the United States,
or of any city or incorporated district, and also, that
every member of Congress, and of the Statu Legis
lature, and of the select or common council of any
nty, or commissioners of any incorporated District,
is by law, incapable of holding or exercising at tho
same time tho oflico or appointment of Judge, In
spector, or Clerk, of any election of this Common
wealth, and that no inspector, Judge, or other officer
of any sucii election, shall bo eligible to any office
to be then voted for."
And tho said Act of Assembly, entitled " an Act
relating to the elections of this Commonwealth,"
passed July Md, lH3U,lurtlicr provides as follows, to
wit:
" That the Inspectors nnd Judges chosen as afore
said, shall meel at the respective places appointed
for holding tho Election in the District to which
thoy respectively belong, btforo nine o'clock in tho
morning of the Second Tuesday of October in each
and every year, and each of said inspectors shall ap
point one clerk, who shall bo a qualified voter of
sucli district.
"In case the person who shall have received the
second highest number of votes for inspector shall
not attend on tho day of any election, then tho per
son who shall have received the second highest num
ber of voles for judge at tho next preceding election,
shall act as an inspector iu his place, and in caso
the person who shall havo received thehighest num
ber ol votes lor inspector shall not attend, the per
son elected a Judge shall appoint an inspector in his
place; and m caso tho person elected a Judge shall
not attend, then Uio inspector w ho received tho high
est number of votes, shall appoint a judge in his
place; and if any vacancy shall continue in tho
board for the since of one hour after the time fixed
by law for the opening of tho election, tho qualified
voters of the township, ward or district, for which
such officer shall have been elected, present at the
place of election, shall elect one of their number to
fill such vacancy.
" It shall be the duty of said assessors respective
ly, to attend at the place of holding every general,
special, or township election, during the whole time
said election is kept open, for the purpose of giving
information to the inspectors and judge, when cal-
hxl on, in relation to the right of any person assess
ed by them to vole at such election, of such other
matters in relation to tho assessment ot voters as
the said inspectors or judge, or either of them, shall
from timo to ttmo rfffjuirc.
"No person shall be permitted to rcti dt fitly C
lection as aforesaid, other than a white freeman ol
the ago of twenty-one years or more, who-shall havo
resided iu this state at least one year, and m election
district where ho ollirs to vote at least ten days im
mediately preceding such election, and within two
years paid a state or county tax, which shall havo
been assessed at least ten days before the election.
But a citizen of the United States, who had previ
ously been a qualified voter of this state, and re
moved tucrclroin and returned, and wno siuu nave
resided in the election district, and paid taxes as
aforesaid, shall bo entitled to vote after residing iu
this state six months. Provided, That the white
freemen, citizens of the United Slatas, between tho
ages of twenty-one and twenty-two and having ic
sided in this stato one year and in tho election dis
trict ten days as aforesaid, shall be entitled to vote,
although they shall not have paid taxes.
No persons shall be admitted to vote
whose name is not contained in the list of
taxable inhabitants furnished by the commis
sioners as -aforesaid, unless, First ; He pro
duco a receipt for tho payment, within two
years, of a state or county tax assessed a-
grceably to the constitution, and givo satis
factory evidence either on his own oath or
aflirmation ol another, that he lias paid such
a tax, or on failure to produce a rcceipt.shall
rnako oath to tho payment thereof, or Sec
ond : If he claim a right to vote by being
an elector betsvecn the ages of twenty-one
and twenty-two years, he shall depose on
oath or affirmation, that he has resided in
the state at least one year next before .his
application, and make euch proof of resi
dence in the district as is required by this
act; and that he does verily believe from tho
accounts given him that he is of the age a
foresaid and gives such other evidence as is
required by this act, whereupon the name
of tho person so admitted to vole shall bo
inserted in the alphabetical list by the in
spectors and a note made opposito thereto
by writinir the word tax," it ne snail do
admitted to voto by reason of having paid a
lax, or the word "age," it he shall bo ad
mitted to vote on account of his age, and
in either caso the reason of such vote shall
be called out to the clerks, who shall make
the like notes in the list of voters kept by
them.
In all cases where tho name of the per
son claiming to vote is not found on the list
furnished by the commissioners and assess
or, or hi3 right to vote whether found there
on or not, is objected to by any qualified
citizen, it shall be the duty of the inspec
tors to examine such person on oath as to
his qualifications, and if he claims to have
resided within the stato for one year or more,
his oath shall bo sufficient proof thereof,
but he shall make proof by at least ono
competent witness, who shall bo a qualified
elector, that he has resided within the dis
trict for more than ten days next immedi
ately preceding said election, and shall also
himself swear that his bona fide residence,
in pursuance of his lawful calling, is within
the district, and that he did not remove in
to said i'distrlol for (tic humosd of Vbllfff
therein.
Every, pqrson qualified as aforesaid, and
who shall make duo proof, if required of
his residence arid payment of taics, as a
foresaid, shall be admitted to vote in tho
township, ward or disttict in which hbthall
reside.
If any person shall prevent or attempt to
prevent any officers of an election uiUlcr lliitf
act from holding such election, or use or
threateh any violence to arty such officer, of
shall interrupt or improperly interfere with
him in the execution of his duty, or shall
block up, or attempt to block up the window
or avenue to any window wheie the sarad
may tie holden, or shall riotously disturb
me peace at such election, or shall use or
practice any intimidation, threats', fotce, or"
violence, with design to influence unduly
or overawe any elector, or to prevent him
from voting, or to restrain the freedom of
choice, such person on conviction shall bd
fined irt anystirri not exceeding five hundred
dollars, and be imprisoned for any tiino nof
icss man one or more than twelve months.
And ir it shall be shown to the court where
the trial of such i lT.nco shall bo had4 that
the person so offending was not a resident of
the city, ward, district, or township wero
the said offence was'cominillcd, and noten-
titled to vote therein, then, on conviction
he shall be sentenced to pay a fine of not
less than one hundred nor more than one
thousand dollars, and be imprisoned not
less than six months nor more than two
years.
If any person or persons shall rhako antf
bet or wager upon the rcsuit of any election
wiium us commonwealth, or shall oiler to
make any such bet or wager, either by ver
bal pioclamalion thoreof, or by any written
or printed advertisements, challedga orin-
vito any person or parsons to make such
bet or wager, upon conviction thereof he or
they shall forfeit and pay three times thd
amount so bet, or offered to be bet.
If any person( not by law qualified,
shall fraudulently vole at any election with'
in this commonwealth, of being othorwiso
qualified, shall vote out of his proper dis-
trict, or if any person knowing the want off
such qualification shall aid or procure such
person to vote the persons co offending
shall, on conviction; be fined in any sum!
not exceeding two hundred dollars, and b
imprisoned for any term not exceeding threa
months
"If any person shall voter at mora than
one election district, or otherwise fraudu-
lently voto more than once on the same day
or shall fraudulently fold and deliver to tlitf
inspector two tickets together' with the in
lent to illegally vole, or shall procure anoth
er so to do, he or they so offending, shall
on conviction be fined in any sum not less
than fifty nor more than five hundred dol
lars, and be imprisoned for any term not
less than three nor mora than twelvo
months,
'If any petsoa not quahncf fo Vote in
this commonwealth sgeeable to law, (except
the sons of qualified citizens) shall appear1
at any place of election for the plfrposff of
issuing tickets, or of influencing the citi
zens qualified to vote, he shall, on convic
tion, forfeit and pay any sum not exceeding'
one hundred dollars for every such offence,
and be imprisoned for any term not exceed-'
ing three months."

the county of Columbia, at the Court
House in Danville on Friday the lllh da
