Strond—Mervine vs. Sailor et al. This
ease, which has been before reported on the
two occasions in which it was before the
Court, is an ; important one to the many
mground -rent landlords in this city. It arises
ni-this wayr The plaintiff conveyed to the
deifthitlants- a lot of ground in 1839, reserving
a ground rent of $570, lawful-silver money of
the - United States, each dollar weighing 17
p ennyweights and 6 grains at least. .
A: year ago, when the half-yearly •
.payment
became= due, , the defendants tendered the
amount'thereof, $285 in Treasniry Notes. The
plaintiff, refused to receive it and brought snit.
The defendants pleaded this tender, and to
this plea the plaintiff filed a replication; aver
-o,kg that -the defendants did not tender in
Biker dollars, each dolle,r weighing seventeen
penny-weights and six grains at least, but in
promissory notes or paper money of the
,Uirited StatesUf the nominal valie of 40 per
Cent., less exchangeable value.
To this replication the :defendants. filed a
special demurrer, stating as cause that the
promissory notes so tendered were lawful
money of the 'United States and a legal ten-
Her in payment of all debts. The ease was
re-argued at the present term of the Court by
George M. Wharton, Esq., for plaintiff, and
George W. Harkins for defendmits. This
morning .Ih.dge Hare delivered the opinion of
the Court rendering judgment for the defend
ants in the demurrer, thus asserting the law
that the tender of United States notes was
sufficient. JUdge Shammed delivered a dis
senting opiniOn.
About midnight on Wednesday a fire broke
out in Oil City, on Main street, beloW the
Post Office which destroyed a block and a
;half of buildings, . Among the properties de
'atroyed were Windsors's hardware, sheet-iron
!sand tin'ahnp • the St. Nicholas restaurant and
part of the blocks known as the Arcade and
the Michigan.
No efforts were made to stop the pr . ,QC;
tof the fire, except by pulling down. buil,
and oil shed's, and putting wet blankets on
the Rical. The Post Office wassaved'by
ing dawn the adjoining building above or.to
wards the - Petroleum House. The amount,
of damage and insurance is not ascertained.
