A CARD.
To the Speaker and Members of the House of Repre
sentatives
GENTLIMEN:—.I. see by a synopsis of the report
Of the investigating committee on the tonnage
tax question that my name has been used in a
manner that does me great injustice. It is not
agreeable to me to appeal in my own defence;
but the nature of the charges of the committee
against me leaves me no other alternative.
The report alleges that the committee had
tried but failed to procure my attendance before
them. There is evidently a mistake somewhere.
I came to. Harrisburg unsubpoened, and went
voluntarily before the committee, and answered
every question propounded to me by them ; and
it was not until I read it in the papers that I
understood the nature of Mr. Marshall's testi
mony.. And knowing the
.statements therein
set forth to have no foundation in fact, I has
tened here bringing Mr. Marshall with me,
and reported myself to the chairman of the
committee. He informed me that the labors of
the committee had ceased. I then availed my
self of the only means of vindication, and ob.
tabled the following affidavit of Mr. Marshall:
Mr. Marshall swears:
The impression 1 wished to convey to the
committee with regard to my visit to Mr. Davis'
room, and the facts in the case are substiantial
ly as follows : Since giving my testimony to
the committee, I recollect why I went to Mr.
Davis' room to borrow forty dollars, having a
considerable sum of money. Ido not recollect
the amount. He said he would lend roe the
money,. providing I paid it back as soon as we
arrived in Pittsburg, stating at the time that
the money belonged to another gentleman, and
that he (Mr. Davis) was instructed to deposit it
in Kramer and Bahm's bank in the city of
Pittsburg. He (Mr. Davis) said he had about
five hundred dollars of his own . money, and
that he would like to have it exchanged for
gold. I went with him to the bank, when we
arrived in the city of Pittsburg, and assisted
him (I having an acquaintance with the batik
officers) to get about two hundred dollars. We
had a good deal of conversation in a -jocular
manner, but these are to the best of my recol
lections, the facts in the case. Mr. Davis at
no time stated to me in a manner that I could
suppose or- believe that he ever received any
money from the Pennsylvania railroad company
or from Thomas A. Scott, although it was not
mammal , at that time to pass a joke in reference
to the accusations made by the enemies of that

peace of the city of Harrisburg, the above na
med-Kennedy Marshall, who, being duly sworn
according to law, says that the facts set forth
in the above statement is true and correct, ac
cording to the best of his knowledge and belief.

Mr. Marshall swears to my having in my pos
session a considerable sum of . money, (but has
no idea of the amount,) and that I then stated
that the money did not belong to me, but that
I was instructed to deposit it in a certain bank
in the city of Pittsburg. Any person , that will
take the pains to examine will find that on my
going to Pittsburg I so deposited the money at
the banking house of Kramer & R dun to the
credit of the parties to which it belonged.—
The amount was less than one-third the sum
guessed at by W. Marshall, as reported by the
committee, and was in my possession two
months before the passage of the commutation
act. The money was given to me for a partic
ular purpose and having failed in the object
for which it was attained, I returned it to
where it belonged. And here I will state that
from . time to time I had sums of money
placed in my hands. There being a great ex-
citement in my district with regard to paten
ting oil lands, and this was the , purpose for
which I had the two thousand dollars referred
to by Mr. Marshall when he says he does not
know how much money I had.
I make this statement in self-vindication,
.and submit the facts to the public. The impu
tation of fraud has been public. The vindica
tion should be the same. Being sworn by the
committee,T desire this statement to be consid
ered under oath. And I take this occasion to
say that neither Thos. A. Scott, nor any other
person, ever approached me in connection with
the commutation act with any improper propo
sition. And I never, before nor after its pas
sage, received any corusideration whatever for
my vote or influence. I was khown to be •in
favor of theibill from the commencement of the
session, and I never cast a vote of which lam
more proud. I voted for it from principle,
having no understanding with any person than
I was to receive a consideration for my services.
I make this statement only to answer the tes
timony of Mr. Marshall, as given before the
committee, and to submit his own statement of
what he says he wished the committee to un
derstand. Mr. Marshall never accompanied
me up the Allegheny river, nor did, he ever
carry any money for me. Palau' as it is to be
thus drawn before the public, : I have felt it my
duty to say this much. lam going into no
argument, but declare the foregoing statement
to be true and correct.

LETEST Rouyn...LE ITEMS.—We noticed yes
terday, says the Nashville Patriot, of the 3d
inst., that General Washington Barrow had
been arrested and placed under parole. At the
expiration of his parole, yesterday, he appear
ed at the office of the Provost Marshall, and
was sent to the State Prison for confinement
in the Superintendent's quarters. He was re
fused either bail or liberation on parole. We
learn, however, that he will be permitted to
leave his confinement, when absolutely neces
sary, for brief visits on business to his office
or to his family. We are not informed as to
the specific charges made against him.
A citizen of Nashville was arrested in Hunts
ville, Ala.,last week under peculiar circum
stances. ome time in the past Winter he
purchased some cotton there, and had it sent
to Winchester, where he sold it. He was
suspected of having it conveyed to that place
under the expectation that the Federal troops
would occupy the town, and then he could
ship it North. He was accordingly • arrested

The weather still continues unfavcrable for
military operations.
It has been raining for two days. The creeks
are much swollen and low grounds covered with
water, making the roads almost impassable for
empty wagons.
Information received here shows that the
rebels have a force of sixty thousand, which is
rapidly adding up by troops from the neighbor
rood of Richmond, which is one day from
Yorktown by railroad and river, they having
four steamers and sixteen transports iu use,
and by the time the roads are in condition for
the Union army to move, the rebels may be
able to meet them with one hundred thousand
men.
The flower of their army, with their belt
arms, ware in a strongly entrenched position
previous to our troops occupying their present
position.
The military authorities had no meads of
ascertaining the extent of the rebel works.
Information ottained through deierters, COO
trabands and other sources, show that the
enemy have nearly five hundred guns, some
of them of the largest calibre. "
The rebel Gen. Johnson, with some of his
forces, has arrived and taken command In per
son, showing that they intended making a des.
perate resistance to the advance of our troops
at every point.
Their entrenchments extend entirely across
he peninsula from James to. York river. •
The cheering news from the western depart
ment arrived here yesterday, and our troopa are
wild with enttiusiam over the result, and are
anxious to be led to action and similar deeds of
valor.
XXXVIIth Congress--First Session.
Mr. SHERMAN, (Ohio,) presented the petition,
of the American wine growers association, in
regard to the proposed tax on native wines.
The confiscation bill was taken up.
Mr. SavameN offered a substitute.
Mr. Mussy, (Va.,) offered an amendment to
the original bill, making an appropriation of
five millions for the colonization of the negroes
made free by this bill or otherwise.
Mr. Rows, (Wis.,) by common consent, in
troduced a bill to incorporate the Northen Pa
cific railroad.
Mr. Denims, (Wis.,) moved to go into Ex
ecutive session.
Agreed to.
After an Executive session, the Senate
Adjourned.
HOUSE OF REPRESENTATIVES.
The amendment was adopted.
Mr. STETRDIS reported back from the Commit
tee on Ways and Means a resolution that, the
Senate concurring, Congress adjourn sine die on
the third Monday on May. Agreed to.
Mr. APS.tuourr (Pa.) had unsuccessfully pro
posed an amendment, extending the time to the
first Monday in June ; and Mr. WADSWORTH
one limiting to the first Monday in May.
The Pacific railroad bill was postponed till
to-day week, in order to afford members au ( p
portunity of examining this measure.
Mr. WRIGHT, (Pa.,) from the Military Com
mittee, reported a bill to facilitate the trans
portation of troops, mails and stores of the
United States between the cities of Washing
ton, Baltimore, Philadelphia and New York.
Re-committed.
The House then went into committee of the
whole on the state of the Union, on the bill re
gulating the franking privilege.
Mr. WEIGHT, (Pa.,) hope the latter hilt
would, as it ought to, die in the Senate. He
was opposed to any further action upon the
subject.
The committee then rose and the further
consideration of the bill was posponed till
Tuesday.
The House again went into committee of the
whole on the State of the Union. Mr. Dawes
in the chair. Mr. Stevens, (Pa.,) moved to take
up the Senate bill abolishing slavery in the
District of Columbia.
Mr. Wmorsa, (Md.,) and several others, ob
jected, when Mr. Stevens moved to lay aside
the first bill on the calendar. This was agreed
to, and so on till all of them thereon were sev
erally laid aside until the bill for the abolition
of slavery in the District of Columbia was
reached.
Mr. WEBSTER moved to lay it aside. gatigh.,
