PASSAGE OF THE MILITARY BILL.
The bill entitled an Act to create a loan and
to provide for arming the State, passed lINAN-
Esiouns in the House yesterday afternoon. It
will at once go to the Senate, and will no doubt
pass that body finally in a day or two. We
hope the Secessionists will soon learn the fact
that they have no friends in the north.
WHO IS THE COMMANDER-IN-CHIEF?
Under this head the Daily News of yesterday
ably deals as follows with the factious opposi
tion which has lately been manifested in the
Legislature to the practical designs of the Gov
ernor in carrying out Pennsylvania's share of
assistance to the general Government :
WHO IS THE COMHANDER-IN-OHISE ?
We notice by reference to Legislative pro
ceedings that there is a disposition on the part
of some members of the Legislature to raise the
question as to who is the Commander-in-Chief
of the forces raised by our Commonwealth for
the protection of the •Government against the
rebels who have assailed it? The Constitution
provides that the Governor of the. State shall
be the Commander-in-Chief of the military de•
partment of the State. It is somewhat singu
lar, however, that under such circumstances,
such as those which now invest us, there should
be any difficulty as to a proposition of this kind.
The Government of the country is now men
' aced, and the President has called upon the
States for their respective quotas of men and
arms which are necessary for its defence. There
is an old.and very trite saying, that what is
everybody's business is the business of no one,
and there is no doubt about the practical proof
of this suggestion.
If the members of the Legislature, at their
will and pleasure, are to be allowed from time
to time to express their judgment as to who
shall exercise Executive function, it is not like
ly that much good will be done even by their
own action. It may be that since the war
which has been commenced against the Gov
ernment of the country, many things have been
done which, to say the least of, were of an im
proper character, and yet this fact cannot jus
tify a proposition, such as has been submitted
in the. Legislature, and which is in direct' op
position to the Constitution of the State. If
the Governor of the Commonwealth has trans
cended his duties, there is a remedy provided
by the Constitution, and if such be the case,
:those . who now. seek to thwart his authority
should have the manliness to state their com
plaint in, plain and decided terms.
the Governor of our State, although. a gen
, &man -of great intelligence, may have com
'anitted errors, in the military appointments
which he has made. We think he has, and
yet this fact will not warrant a proposition
such as that which has been made, and which
proposes to ignore the Conetit Won, and take
from him the power vested in him by, it. It
would, of course, be idle for the members of
the Legislature to attempt the passage of any
act such as that to which we have referred.
If the Governor of the Commonwealth were
not capable to perform the duties imposed on
him by the Constitution of the State, the prop
er remedy would be to impeach him. No such
proposition, however, is made, and it is there
tore that the suggestion to restrain the authori-

ty reposed in him by the Constitution of the
Commonwealth is simply ridiculous. Let the
members of the Legislature turn their atten
tion in another direction. -Let them look after
the conduct of those who have, unfortunately,
been appointed by the Governor, and see to It
that whilst they are shrouded in the mantle of
the Commonwealth, they shall not be permit
ted to swindle its treasury.
INTERESTING FLA(} RAlSlNG.—Decidedly one of
the most interesting "flag raiaings" we have
witnessed in our city since the general display
of bunting commenced, was that which took
place last evening at the boarding house of
s.lrs. Espy in Front street, in the presence of
several hundred persons, including a large
number of ladies, and members of the Legisla
ture.
The, flag—a large and handsome one— is at
tached to a pole projecting from the roof of the
house, and shows to good advantage.
It was urfurled to the breeze by Mr. Lichten
wallner, a member of the House of Representa
tives, from Lehigh county, and as its stars and
stripes came into view they were greeted with
hearty cheers and a rousing "tiger" from the
assembled multitude.
Mr. Woodhouse, Postmaster of the House of
Representatives, then favored the assemblage
by singing the solo part of the "Star Spangled
Banner," a hundred voices joining in the
chorus.
The ceremonies concluded with eloquent
speeches by Gen. Wm. F. Small, of Phil
adelphia ; Mr. Armstrong, member of the
House from Lycoming county, and Hon. Jacob
E. Broom, of New Jersey, all of whom were
frequently interrupted by shouts of applause.
AMONG the visitors to West Point, Just ap
pointed by the President, are Richard Tilgharn,
ox Maryland ; Senator Crittenden, of Kentucky;
Senator Johnson, of Tennessee ; Hon. John
Minor Butts, of Virginia ; Hon. F. P. Stanton,
of Kansas, and Gen. John Garland, United
States Army..
Tam Danville Appeal learns that la-Governor
Morehead, of N. U., was dangerously assaulted
in his chamber, recently, by a uegro man, and
that the villain who committed the outrage
was immediately arrested and summarily dis
patched.
THE Cincinnati Gazette cruelly proposes to
cut off the whisky from our "Southern breth
ren, as au article offering "aid and comfort to
the enemy." We can't say about the i "aid,"
and for the "comfort," by all means let
,them
have it, so far as liquor goes.

sacola was completed last week.

WASHINGTON, May 9
A great urgency has been applied to the
Secretary of State to induce his consent to pub
lish his instructions to Mr. Adams, United
States Minister at London, but he declines.
The recently published letter to Mr. Dayton, is
well understood to be an Index to the entire
European correspondence. The temper, spirit
and purpose have been the same in all cases
from the beginning of the Admiministration.
It is understood that Government has receiv
ed froni Mr. Dallas the minutes of his interview
with her Majesty's Minister for foreign af
fairs, and on these the instructions to Adams
are predicated.
The result of careful inquiry justifies the
assertion that there is no indication or prospect
of a recognition of the Confederate States by
any foreign power against the protest of the
administration.
Mr. Preston's next dispatches from Spain in
reply to a demand for explanations relative to
San Domingo, and also about the recognition
of the Southern Confederacy, are looked for
with much interest. Preston, alLhough a Ken
tuckian, is loyal, and is understood to he act
ing in such a manner as to meet' the approba
tion of the administration.
All the foreign ministers are anxiously mak
ing inquiries daily about the application of the
blockade, but not one word of complaint has
been uttered, by any of them.
• Flundreds of ladies of various parts of the
country, evidently, ELI appears from their let
ters, of character, and refinement,and actuated
by motives of charity and patr s iotistn, have of
fered their service to the War D6partment as
nurses, etc. Numbers of them have been ac
cepted. It may be of interest to such volun
teers to learn that on this subject they are re=
ferred to the acting surgeon, G-enl. Wood, who
will direct the proper answer.
Capt. Ellsworth'a regiment of Zonaves will
to-morrow encamp on the Government Insane
Asylum heights overlooking the Potomac.
The popular commander speaks in commenda
tion of their general conduct and improved
discipline. Not more than Borlo of the en
tire number have been deemed unworthy of
soldierly association.
The President has conferred on Colonels
Thomas and Mansfield the brevet title of Brig,
General. The former is Adjutant General and
the latter Commandant of the military de
partment at Washington.

The steamer Mantarizas sailed this afternoon
for Washington, with two hundred, and fifty
barrels of provisions, and sixty-five men of the
Seventh Regiment to act as an escort.
The steamer Delaware will sail to-night with
provisions and fifteen pieces of cannon for the
Philadelphia Navy Yard.
The steamer D. F. Hart sailed this morning
for the same Yard, with provisions.
The Second Regiment will leave on Saturday
by steamer for Washington.
