pailp Eilet4f.4., IiARR.I.kiBURG Friday Afternoon, March 29 , 1861. A Boom AT IiARBISTIIIIIG.—This morning a bill was read in the Senate for the incorpora tion of a company to construct a boom in the river Susquehanna at or near this city. I=l TEE UNION PRAYER ?JESTING will be held in the Presbyterian church, corner of Market. Squire; to-morrow (Saturday) afternoon, corn mencink at four o'olock, as usual. =I CmNos of LOCATION.—The City Fathers this afternoon vacated the Walnut Street Exchange and took possession of the new Council,Cham bar in the Court House, where their future meetings will be held- Palm .F.tatemor.—The bill to establish a law library in the city of Harrisburg, recently published in this paper, passed the Senate fi nally yesterday. No doubt it will pass the House, and become a law. VIOLATING OHDINANCeS.-- N111:110r01:113 eoM plaints are made of the violations of ordinances. They will be attended to as soon as the Chief of Police, now prostrated by illness, resumes his official post. I=3:=l ANOTITER. MAIL AMT. -Mr. Solomon pooth, of Mifflin, has been appointed a mail agent on the Pennsylvania Railroad between tl* city and Altoona. He takes the place of Mr. Ser geant, and is said to be competent for the position =l= MAuxur HAVRE. —At the meeting of Common Council last night, the only appointment made was that of Frederick P. Keehnlen for Market Master. The new ordinance goes into effect on and after Wednesday next, and the people ex pect that Mr. Ilaehnlen will faithfully and fearlessly enforce its provisions. FAST DRIVING. —Wm. Reigle, employed b y the Adams Express Company, was before the Mayor this morning, charged with a violation of the ordinance prohibiting fast and reckless driving within the'city limits. He was fined one dollar and costs, which he paid and was discharged. LAHORNR.—lnformation was made before the Mayor this morning against two colored men named James Dorsey and Wm. Bender, for lar ceny of a store box from Cyrus J. Reese. War rants were issued for them, but at the time of penning this item they have not been captured. APPROPRIATION TO THE FIREMEN.—This morn- - lug, pending the consideration of the appro priation bill in the House, the section offered by Dr. Heck, giving each of the fire companies of this city the sum of seventy-five dollars, was adopted by a vote of forty e yeas to thirty-six nays. We have no doubt the Senate will con- cur in this action. CORNER erns LkYING.—The corner stone of the Odd Fellow's Hall at Lykenstown will be laid, with appropriate ceremonies, to-morrow afternoon at two o'clock. Arrangements have been made for a parade of the order on the oc casion, which we presume will be participated in by Odd Fellows of this city and the various towns in the upper section of the county. -.- Tux following is supposed to describe the "Dixie" whose praise is growing universal: Oh. is not this a happy land— 'With wine upon the lses? Where pot-pies smoke is six quart pans, And dumplings grow on trees? Where Nature's lessons may be read In every babbling brook? Where bumblebees don't sting a chap, And muty cows don't hook? THAT PITTSBURG PARDON.—The item in yes terday's paper, relating to a pardon, copied from a • Pittsburg paper, was incorrect. The facts are, as we learn from an official source, that a young man named Daniel Mitchell was, on the thirty.first of January, pardoned for the offence of a trifling larceny, upon representa tions made by a large number of prominent citizens, which were conclusive as to its propri ety. He was intended to be pardoned, and the papers were made out accordingly. TER "SOAP MAN" DRIVEN OUT ON Rocmt. The public career of the distingnished vendor of that "unrivalled New England Soap," Pro fessor Gardner, who flourished extensively in this city some two years ago, has come to an ignominons conclusion. He fled from Roches ter a few nights ago to, avoid prose9ution, or a what was quite as bad, dogging, from partiee who detected him in some infamous acts. The "Professor" was obliged to leave Harrisburg-for similar reasons, and we presumed the lesson he learned here might lead to his reformation ; but in this we have been disappointed. Gard ner,has had a sort of reputation before the pub lic for ten or twelve years, and in his way was regarded as a pretty clever as well as shrewd fellow. We regret his having done that which thus disgraces him. Allier—the developments made, whioh ire too disgusting for recital, the probability is we shall no more hear of him as a lecturer and soap vendor. =I THE FUNERAL or PROFESSOR WASZOSI, peter day afternoon, was largelyattended., The re ligious exercises were conducted by the late pastor of the Locust Street Methodist chnich, Rev. Dr. Bishop, who came here from l'hilatfel phla for that purpose. It is pleasant to linger over the memory of a true man—one who by his knowledge has tended to leave the world wiser, and by his conduct has helped to make it better, than he found it. To those who were' associated with him in his labors it is a source of peculiar gratification to record their sense of his services at a time when his eyes are closed and his eloquence is stopped for ever, when praise cannot be mistaken .for flattery, nor the expression of grateful regard be tortur ed into selfish motives. Such a true man was Beverly R. Waugh, esteemed and beloved by all who enjoyed the pleasure of hie acquaintance, In his death a truly good man haa fallen, and he will be sadly missed in the domestic circle, in the church, in the Sabbath-school, and in society at large. May we all be as well pre pared as was the deceased, for the summons of the-pale messenger. Au Amman SartLa Vroxoartne was lost 'last evening between Omit's Hotel and Felix's Con fectionary store. The finder will be suitably rewarded by leaving it at the bar of tbp Hotel above named. =I Tax CAVALRY SQUADRON will meet on the Park grounds to-morrow afternoon at half-past one o'clock; t'or dull exercise, and the election of permanent officers. All desirous of •joining the company will then be required to advance therm= of rive dollars towards the purchase of material for uniforms. Tau Imams VALLEY Ransom) has had a sup plement to its charter passed by the Legislature. By this supplement it is empowered to extend Ra vi. oad up Williams Valley eastward, as well as westward around the end of South Mountain, and thence eastward to Bausch Gap. It is also empowered to increase its capital stock to $BOO,OOO. = Imesovnio.—The weather to-day is delight ful. From present indications, old Winter, who has been lingering in the lap of Spring for three weeks past, is about to take his de parture. No doubt all our readers are anxious to bid the stormy old chap farewell, and wel come the advent of smiling April with her balmy south winds and genial showers. Naw Use von hums Rumen.—One of the uses to which India Robber is put, is that of furnish ing the material for business cards. Besides the. various convenient forms which may be given to the material, it'may also so be im proved with any ornament or design suitable to any particular business. The material makes light and prettily molded business cards, one advantage of which is that they cannot be de faced easily, and are almost Indestructible. ANOTHER EDITOR RICWARDND.-Our young friend Mr. Carriden, editor of the Shipensburg News, has been appointed Postmaster for that town. He is a clever gentleman and will make a first class officer. The members of the edit orial fraternity in this State are being well provided for by the new affiffinistration. We (the local) are still "ont in the cold," but hope to be taken in shortly. HionwAr Rozasarr.—A man named Peter Shaeffer was recently attacked on the highway in Westmoreland county, and robbed of some $360. It appears at he had sold his farm to a Mr. Hoffiey, anu was returning home with part of the proceeds in his pocket, when two men, with their faces blackened, sprang from the road aide, and while one of them seized his horse's bridle, the other demanded his money or his life. He refused to part with his cash for the mere asking, whereupon one of the ras cals discharged a pistol at him, the ball passing through hie hat. They then dragged him from his horse and abstracted his wallet, after which they fled, and hare not since been heard of. CHANGE ON MARKET Houas.—The summer arrangement for the city market goes into ef fect on Wednesday next, the first market day occurring after the first of April. The maiket will therefore open at fide o'clock and continue, until eight. We now give notice ofthe new arrangement for the benefit of such country people as read the TXLIOBAPEr. Many of our rural friends, however, do not take newspapers, and of course axe ignorant of the enactment of the ordinance by which they are hereafter to be governed. In consideration of this fact, we would suggest to Council the propriety of hav ing the ordinance printed in slips and exten sively circulated among the country people who attend market. A BABY Fouls IN A BAGOAGY Roos.—The bag gage master, of the Pittsburg, Fort Wayne and Chicago Railroad, found in the baggage.room at Crestline, ou Thuraday last, a female child, apparently about six days old, dressed in a pink frock and with a limiter:shawl around it, the face being left exposed, doubtless with a view to prevent Its being 'thrown aside as a bundle, or perhaps to make it more readily no ticed. When found life was nearly extinct in the little waidrom cold and want of sustenance perhaps, but careful nursing soon restored its natural vitality. The child was adopted by a family in Crestline, and a number of railroad men intend raising a fund for its maintenance. It is supposed to have been purposely left by a passenger on either the Southern or. Western' train on Wednesday night. HOLY Wass:.—The present week in the cal endar has long been regarded by several denom inations of Christians as the Holy Week, and religious services of a solemn and impressive character are daily conducted in their churches during its continuance. The Passion of the Blessed Savior is commemorated, and a host of believers are no doubt refreshed and invigorat ed spiritually by its observance. Such occa sions have been set apart by the Church in all ages for the commemoration of some Saint, or some remarkable occurrence in the life of the Redeemer. It has been a question agitated by divines whether it be proper to appoint or keep any holidays, the Sabbath excepted. The advocates for holidays suppose that they have a tendency to impress the minds of the people with a . greater sense of religion and of the ac quisition and victories of Christianity, always celebrated with the highest joy ; also, those events which relate to the salvation of man, such as the birth; death and resurrection of Christ. On the other side, it is observed that if the holidays had been necessary under the present dispensation, Christ would have ob served something respecting them, whereas he was silent about them ; also, that it is calcu lated to bring Christians into that bondage to ceremonial laws from which Christ delivered them, and that it is a tacit reflection on the Head of the Church in not appointing them ; and that such days, on the whole, are more pernicious than useful to society, as they open the door.for indolence. That objections may have preiailed in those countries and in those periods of . Chinch history ,when feasts weie very numerous slid observed,; there fano doubt, but in latter dais•tbe great difficulty is to Wive them observed even by members of the Church. As far as this country is concerned, the general improadon is that they are productive of good. Pennsylvania flatly telegrap4, irtbaD 'Afternoon, ittlarc4 29, 1861. [For the Daily Telegraph.] The Harrisburg Firemen and the Legis Drumm :—My attention was called to a communication in the Patriot and Union, headed "The Harrisburg Firemen and the Le gislature," in which the writer makes an un provoked attack upon me. So far as that com munication relates to me; it is an unmitigated, premeditated.lie, from beginning to end, and has been written by no other than a low brag gart. That I have opposed the appropriation asked for by the firemen, either before the Le gislature or any single member thereof, is . equally untrue. Whatever may have bee'n my faults, I have never been accused of being afraid to stand by my own acts. Of this the author of tbe communication referred to can fully satisfy himself if he will come out from his lurking hole, purge himself of the filth and slime which must necessarily envelope the carcass of such a creature, put on what little manhood nature may have endowed him with, and try the experiment. As a citizen and property-holder in this city, I must necessarily feel it my duty to contribute my share to the support of the Fre Department. What motive could I have to oppose an appro. priation from the State, which would necessari ly be an advantage to me as well as to the firemen? I have no petty squabble with .the firemen, as such. lam not]aware of the fact, if there are three men in the whole depart ment who are my personal enemies; but what ever their number, if they are not such fellows as are beneath my notice, if I do not get eden with them singlelanded or in pairs, without striking at,the whole department, with whom I have no quarrel, I will charge them or either of them nothing for what they make of me. But why ibis attempt to prejudice the fire men against men who have been among their best friends? I procured for them the first ap propriation they ever received from the State, when a member of the Legislature in 18564, and I have since that every year used all my personal efforts to get similar appropriations. Ia 1869, when Mr. Lawrence, our member, was on his death.bed, and couldrnot attend to it, I went to the Chairman of the Committee of Ways and Means, Mr. Strong, and succeeded it getting him to put the-appropriation in the bill, which was secured that year. In addition to this I have always, when called on, contri buted as liberally as any other man in the city, in proportion to the amount of property own ed, in support of the Fire Department. These facts are well known to many of the firemen, and cannot be successfully contradicted by any one. What, then, can be the motive of the few persons who are making this desperate ef fort to get up an issue between the firemen and myself? Certainly not the good of the former alone. The writer of the communication re ferred to says, I "had so bitterly denounced them (the firemen) in a speech in a recent campaign." The reiteration of this contradict ed falsehood may throw some light upon this singular persevering effort to prejudice the fire men against me. That my vote may have been wrong on that occasion, may be possible ; but that the speech referred to was made, is false, as will appear by the following. DAVID MIIRDA, Jr. DAVID MUMMA, ESQ. :—BASIJCCiaI air:—At a stated meeting of the Hope Fire company, No. 2, of Harrisburg, held in their hall on Friday evening, Nov. 18th, the following preamble and resolutions were unanimously adopted : Wrorases, David Mumma, Esq., has been charged before this company (as a member of said company) for using the following language ata political meeting heldlU - Gratztown during . the late political campaign: "The firemen, of Harrisburg were a fancy set of men, and that they paid little or no tax, and that they itaie, of little or no account; and in the erection of a. new Courthouse the people of the county would have to bear theburden ;" and to which charge we have, as a company, abundant proof outside of Mr. Mumma's own statement that the charge is false and malicious. Therefore be it Resolved, That the charge brought against Major Mumma being totally groundless and unfounded, that he be hereby honorably exhon orated from the charges preferred against him. Resolved, That David Mumma, Esq., be unan• imously elected an honorary member of this company. Extract from the minutes. JACOB M. BAHR, Secretary of the Hope Company,,No. 2. INTERBSTING DECISTON.-A few days ago the Supreme Court rendered a decision in the case Hutchmaker vs. the administiators of Elisha Harris, deceased, a detailed report of which re• coney appeared in the columns of the TEE *Lim. Huchmaker, it will be recollected, purchased, at the sale of the personal effects of Mr. Harris, an old drill machine, for which he paid fifteen cents. On taking it home and breaking it up for kindling wood, some $3,000 were found coritealed within it, and the dispute was as to who should take the money, the ad ministrators of Mr. Harris or Mr. Huchtnaker, the purchaser. In deciding the case, Judge Woodward said The machine itself, and every essential part and constituent element wore well sold. The consideration paid, though , fifteen cents, was in law a quid pro quo, and the sale, unaffected by fraud or misrepresentation, passed to- the purchas'er an indefeasible right to the machine, and all the uses and purposes to which it could be applied. But the contents of the machine are to be distinguished from its constituent parts. They were unknown to the administra tors, were not inventoried, were not exposed to auction, were not sold. Of course they were not bought. • All that was sold was fairly bought and may be held by thapurchaser. The title to what was not sold remains unchanged. A sale of a coat does not give title to the pock et book which may happen to be temporarily deposited in it, nor the sale of a chest of draw ers a title to the deposits therein. In these cases, and many others that are 'easily imagined, the contents are not essential to the , existenceor usefulness of the thing Contracted for, and riot being within the contemplation or intention of the contracting parties, do iipt pass by the sale. The judgment of the Court below, awarding the money to the administrators, is therefore confirmed.
