Mr. TELLER. This seems to me a strange
proceeding. If the Auditor General neglected
to give the proper notification, by which ne
glect these sureties suffered, that would be a
proper case for the consideration of the Courts.
It does not, as I think, constitute a good reason
for special relief, as contemplated by this bill.
To exhonorate the surety in this case would, I
consider, be a bad preeedent.
Mr. BARTHOLOMEW. In answer to the
gentleman from Erie (Mr. Tease) I would state
that the reason the surety cannot obtain relief
from the Courts is that no kicks operates to de
feat the claim of the Commonwealth. Not,
withstanding the lapse of time, the Cominee
wealth can.eue and recover. Mr. Strunk can
not have any remedy in a Court of law. But
the circumstances of the case are such as to raise
a strong.equity in his favor—an equity which
should induce the House to pass this bill. Had
the officer of the State given that notice which
the law required, Mr. Strunk could have, saved
himself to a great extent, because at that time
Mr. Zeigler and the co-sureties had property
which could have been made liable. I think
the circumstances are such as to commend, this
bill to our sense of justice and right.
Mr. WILSON. I would like to-enquire whe
ther some other of the sureties besides George
Strunk had not at the time real estate upon
which the bonds, when filled up, became liens
and are still liens.
GIBI3ONEY. This case has been fully
examined by the Committee on the Judiciary,
(general,) and they have reported it unanimous
ly with an fan - native recommendation. As the
questions involved are purely of a lega nature,
this affirmative recommendation would, I should
suppose, be almost sufficient ,to induce the im
mediate passage.of the bill.
In reply to the gentleman from Beaver (111 r.
Wrtsos) I would say that two of the sureties in
this case received some intimation that there
was a deficiency in the account of Mr. Ziegkr—
a balance of a large Umotmt due the boramon
wealth; and in consequence, they assigned their
property, so that they would not become re
sponsible for this defalcation.'
Mr. WILSON. What I wish to 'inquire is
whether Zechariah Rittenhouse and ;Ss? auel
Belford had not real estate it the - time the
bonds were entered up, upon which real estate
those bonds became hens.
Mr. GIBBONEY. Ido not know as to that
fact ; but the whole responsibility fOr the claim
fell upon Mr. Strunk, the other two sureties being
found to be worth nothing. The claim was
entered against the sureties of Daniel Ziegler ;
bus Mr. Strunk was.the only solvent party.
As has been stated, if the Auditor General 'had
promptly entered up the bond, it _would
have become a lien upon the property of
the Treasurer, Daniel Ziegler ; and it was
in evidence before the committee that
Daniel Ziegler put his poverty. .of his hands
between the time the settlement ivasinade with
him and the time when the notice was'. given
to the sureties. It was in evidence that 'the
property, thus assigned by Ur: Ziegler, would
have been sufficient to cover-the wholealaim of
the Commonwealth against MM. Thicis, if the
Auditor °metal had not fedleci to do his duty
the sureties' would not have become liable. It
appears to me a matter of justice and 'equity
that these sureties shordd be released from the
iponient.of this money. •
Mr. BARTHOLOMEW. In answer to the
gentleman from Beaver; (lifr. Wrisoar,) I would
state the Auditor General did not have the
transcript entered until 18156, when the other
sureties were insolvent.

Mr.-WILSON. If those sureties had real es
tate at the time these bonds were filed, are not ,
those kinds still a lien upon that real estate ?
They could mot dispose of that real estate ex

this bill would be for the relief of those persons

In the account of Mr. Ziegler, as published
for the year 1858, there appeared a balance . due
the Commonwealth of several thousand dollars ;
but the account, mblialied in 1864 shows .no
such balance..!By theactidEAssembly, it la made
the duty of the Auditor General to file,in the coun.
ty where the Treasurer resides, astatement of the
accounts, and the statement thus filed becomes
a lien upon the property of the Treasurer and
also of the sureties, and secures the Common
wealth.' By the neglect of the Commonwealth,
this statement was not filed in the county for
several yeers, and. consequently the lien was
not secured against the property of the Treasur
er, and the other sureties. So far as regards
the equities of this case, the Commonwealth,
by the neglect of her officer, has lost this
money. Were this,_ a case between, an indi
vidual debtor and the surety, the claim .
would unquestionably be lost ; because I take
it the principle of laW is'werlsettled that where a
creditor has amplecseettrity for the payment of
debt, and by his own. /gam' allows that security
to be lost, the , sureties'are relieved. This is a
principle in 'equity which I presume no lawyer
will dispute. In this case the sureties cannot
have the benefit of that principle because no
lathes will operate against the Commonwealth.
In equity I see, no reason whatever why the
Commonwealth and, an individual creditor
should ,not.be`.placed'upork precisely the same
footing., Had the creditor been an individual
the sureties World, hitlehintilar circumstances,
have been released, The principle of equity
which would apply in ° that case should, it
struck the ,Committee, apply in this. The Com
monwealth should not by reason of her . .

cases of individuals. It was in consequence of
the equitable consideration which recommends

this ease, that the Committee were unanimous
in reporting , this bill affirmatively.
Mr. TRACY. It seems to me, sir, that if the rea.:.
soning of the gentleman from Lycoming (Mr.
Aimsramin) becorrect, we should make a change
of the law in regard to , the liability of debtors to
the State. gis argument oes not furnish a good
reason why we should make-an exception in this
particular case. - If the interests of the Common
wealth are too, well protected-4f she has an Un
due advantage over individuals in regard to the
recovery of her chtt. srweshould, change the
law so as,to,put her ,upon the same footing as
the private We should not make indi
victual ex9eptions, as we are called upon to do
in this particular. case. I shall, therefore, •not
, withstanding what has been said, vote against
the bill.,
