The Wrongs of the Patent Office.
Everybody is familiar with the term Paten t
rights. To the mechanical genius it pose( sees
a charm which draws golden pictures of the
future. We all admit the righteousness of pat
ent-rights, for= they reward those patient and
busy minds who have already signalized the
present century as the age of mechanical and
scientific invention. Every American knoirs
what a patent-right is. It is a staple article,
one of the leading prodbets of the land, a sort
of institution much respected, and very much
dealt in. Familiar,. however, as we may all
be with patent-rights, we know verflittle of
patent wrongs. By these we mean the wrongs
of the Patent Office. This department seems
to be about the most corruptible of the General
Government, or, at least, is guilty of an unwise
discrimination, in favor of fortunate inventors,
that warrant' trong suspicion of corruption.—
We will. explain.
The law of patents is founded upon the idea,
that the inventor of a useful article or meritori
ous michine ought to be rewarded for the men
tal labor expended on the invention, and for
that purpose, the inventor is granted the sole
right to manufacture or cause to be manufac
tured the article patented. These patent rights,
however, are issued only for a term of years,
during which, the inventor is expected to re
munerate himself through the monopoly gran
ted him by the Government. The limitation
of the patent-right, is a matter of sheer justice
to the people, for were it otherwise, useful and
important inventions; forever monopolized by
the inventors or their heirs would not become
common property as they ought.
There is, however, a still further proviso' is
behalf of the inventor. Should he not, in the
opinion of the Patent Office, receive sufficient
remuneration through the original patent-right;
the patent may be extended. It is under this
extension proviso that we have patent wrongs
to counterballtume patent rights. Extensions
are' frequently granted to inventors , who have
become independently rich through the monop
oly of the original patent. If the invention be
useful, as it must be to enrich the inventor,
the public has a right to its free, use after the
patent right has been well paid for
Many, no doubt, remember the monopoly of
the original planing-machine, and how exten•
don after -extension was granted, after the
original proprietors and others had. accumula
ted great fortunes from the use of thie great
labor-saving machine. These exterudeniswere
universally condenmed-at the; time, and were
deemed tin outrage upon the secnredby
a free use:of ;private funds in and the
Patent Office. A similar caze but one of more
importance to all classes of peeple, his just oc
curred.. • Mr.-Elias HoWa, patented-several
portantpartsof the sewing-machine. Through
these patents, Machines Which cost between
ten and tWerity; dollars are wild; fer eighty.and
(me hundred dollars. - Remove the,patents and,
the price of, the sewing-inaciiinei would be re!
duced from-fifty to seventy per cent.
It is positively stated that Mr. Howe has per
sonally realiZed over half' &Million of : donate

vention, the extension of his articles is a fraud
on the industry of the country. The sewing
machine is to be a monopoly seven years longer,
and those who use it daring that time must
rai tribute to an inventor now rolling in
wealth. Honesty or justice never dictated the
extension of Mr. Howe's patents. It is a specu
lation In which officials,_nodoebt, axe interest
ted. It is one of the many patent wrongs to
