the same; and it is in the . Cottrth section
of each, that the provisions relative to
personal property are found; The act
of March:2Bth; 1820, was continued in
force for another year, by an act pested
March 27th s , 1821, (do. page : 422,) end

The second section of the act of 27th
Maich, 1821, entitled "An act to con
tinue in force,. An act for theappraise
ment of estates taken• in execution,"
is in the following:words :
" -- . l lnd be it further enacted,by the
authority aforesaid, That all personal
property exposed to public sale accord
ing to the provisions oldie act to which
this * is a supplement, if the same. does
not bring two-thirds of the valuation, on
the debtor complying with the terms
required by said 'eel, shall not be liable
to be seized and taken in exeaution.by
virtue of any subsequent execution du
ring the stay entitled by law Provided,

the preceding levy or levies:" Here,
then, we find 'the legislattire for the
first time, making express provision for
the vep case which the gentleman un
dertakes to deduce from the act at pre
sent in force- The section quoted, is
not a mere legislative construction of a
i
former act; it s a new enactment, to
allintents and purposes. . The inten
tion.of ihe legislature of that day, then,
appears to be clear; else why would a
clause of this character have been,in
serted in a subseqUent act? If the for- , ,,
mei act met a case of that kind, it is
most probable that the legislature would
'halm declared, as has been done'in ma
ny. Other instances, that such should be
et:instruction put upon it.
If, then, such was • the intention' of
'the legislature of that day, it is fair to
filler, that the legislature of 1842, hav
ing both the former as before them,
must have placed the same construction
on the act which they merely re-enact
ed. That they were ignorant of the
'existence of the former acts, cannot for
a moment be admitted ; for we have
shown, that they copied the one passed
March 28th, 1820 ; and it is not at all
probable, that a bill containing the
same phraseology, was dram 4 up and

west 'side of River Btreet between a lot owned
by Jesse Woodruff and ittiot owned by. the
heirs of James P. Bull deceased in the borough
of Towanda' in said County of Bradford, con
taining in front on said

-and in depth thirty feet and the lot or piece of
ground and curtilage appurtenant to said build
, ing. And' whereas it is alleged that the said
-sum remains due and unpaid to the said Nelson
P. Brown and Henry' N. Carey ; now we com-.
mand you, that you make known to the said
Amos Pennypacker and to' all such persons as
may hold or occupy, the said building, that
they be and appear before the Judges of our

held at Towanda, on the first Monday of May
