property exposed to public sale accord

not bring two-thirds of the valuation, on
the debtor complying with the terms

to be seized and taken in exeaution.by

then, we find 'the legislattire for the
first time, making express provision for
the vep case which the gentleman un
dertakes to deduce from the act at pre
sent in force- The section quoted, is
not a mere legislative construction of a

former act; it s a new enactment, to
allintents and purposes. . The inten
tion.of ihe legislature of that day, then,
appears to be clear; else why would a
clause of this character have been,in
serted in a subseqUent act? If the for- , ,,
mei act met a case of that kind, it is
most probable that the legislature would
'halm declared, as has been done'in ma
ny. Other instances, that such should be
et:instruction put upon it.
If, then, such was • the intention' of
'the legislature of that day, it is fair to
filler, that the legislature of 1842, hav
ing both the former as before them,
must have placed the same construction
on the act which they merely re-enact
ed. That they were ignorant of the
'existence of the former acts, cannot for
a moment be admitted ; for we have
shown, that they copied the one passed
March 28th, 1820 ; and it is not at all
probable, that a bill containing the
same phraseology, was dram 4 up and
