CAPITOL WITNESS IN EUROPE His Absence Will Be a Distinct Loss to State In Trials This Week. Harrisburg, May 12. Charles D. Montague, a metal furniture expert of Brooklyn, and who was to have been the chief witness for the common wealth In the second Capitol trial, is said to be In Europe, beyond the reach of the subpoena servers of the prose cution. Montague was employed by the Capitol probers last year because he had formerly been connected with the Art Metal Construction company of Jamestown, N. Y.. which manufac tured all the metallic furniture put into the Capitol, the Pennsylvania Construction company being merely the agent in this state. The commonwealth had counted much on Montague's testimony, be cause of his thorough familiarity with everything Involved in the 12,000,000 metallic furniture contract, and his ab sence will be a distinct loss to the prosecution. "There will be no motion for a sev erance for Mr. Huston," said Attorney George S. Graham, who, with the other counsel for the architect, A. S. U Shields and Samuel M. Clement, Jr., arrived Sunday evening. That evidently eliminates the pos sibility of a separate trial for the architect, or of his turning "state's evidence," the only condition on which the commonwealth would consent to excusing him from standing trial this time. There are persistent rumors that Huston's plan of defense Is Bitch as to put responsibility up to the other de fendants and to Involve a clash at the very outstart of the trial, but coun sel are making a determined effort to avoid a serious split In the defense If It can be done. That it is a hard task is not seriously denied. "Mr. Huston is not a conspirator," said Mr. Graham. "He knows of no conspiracy. All he knows he has told to Attorney General Todd, Mr. Scar let and Mr. Cunningham. They thought it sulliclent to grant him a severance In the first case. Since then they have seen fit to change their minds. Mr. Huston Is In precisely the same position as heretofore. So far as he is able he is willing to tell all he knows. Turning back to the north at the end of these two lines, the Yorktown traversed the lane formed on the star board by the battleships of tho Atlan tic squadron and on the port by the grim little destroyers. The people of the bay cities, who again made black the hillsides, had their second splendid water pageant within three days.
