Schley Was Condemned on All
Point:.
Washington, Jan. 31. The "com
ment" cf Judge Advocate General
Lemley and Si licitor llanna upon the
appeal cf Aiiaiiral Schley, as sub
mitted to the president by Secretary
I.nug, If less than a third as long as
the apical Itself. The commentators
begin with the statement that Ad
miral Schley and his counsel hava
shitted their grcund. They say the
chief features of the case were "the
retn grade movement"; "disobedience
of ordsrs"; "Inaccurate and mislead
ing official reoorts"; "failure to de
srrcy vessels of the enemy lying with
in sight"; and ' Injustice to a brother
officer." These matters are all grave.
The first was that the finest aggrega
tion of American vessels under one
commaud was by Schley's direction
tnrnec about and headed for Key
West, r. rre than 7o0 miles distant,
when v.-i.hln 22 miles of Santiago,
where the enemy's ships were. The
second was that Schley deliberately
and knowinjly disobeyed the secre
tary's orders overtaking him In his
retrograde movement. The third was
thst Prhley's reason officially given
for the rttrogiade movement and dis
obedience of orders, I. e., "that tho
flying squadron was short of coal,''
was t.ot true. The fourth was that
for throe- days some of the Spanish
ships lay within teach of the flying

as compared with the grave matters
above referred lo.
The commentators say they recog
nize the fact that Admiral Schley de
voted by far the larmr part of his
appeal to the quest inn of command,
and ronnnnnlly give that question a
preimrtionRto space In their com
ment. They declare that the ques
tion Is between Sampson and Schley,
both p'ike Interested, and to Investi
gate it fairlv Iw in should be heard.
Such Incidental testimony on thin
point as cairn before the court was
on Sibley's side only and the doors
were entirely closed to Sampson.

portant question of this nature under
such conditions Is contrary to the
underlying principle of Anglo-Saxon
Justice.

effect that the commodore controlled
the movements of his flagship the
Brooklyn well, with the exception of

Miss Stone Not Released.
Washington, Jan. 31. Uuless Miss
Stone's captors have abandoned her,
despairing of being able to surrender
her safely to the agents who have
been trying to ransom her, she Is not
yet at liberty. It Is quite certain that
the ransom money has not been paid,
and that the agents referred to have
completely lost touch with the brig
ands, who have been frightened off by
the apeparance of Turkish soldiery In
their neighborhood. The efforts to
secure the woman's release will not
be abandoned, but It 1b feared that
they must be renewed In another di
rection, the present line having been
broken.
Sampson and Cromwell to Be Retired.
Washington, Jan. 31. The navy de
partment has issued an order announc
ing that Uear Admiral W. T. Sampson
and 13. J. Cromwell will be placed on
the retired list on the 9th proximo on
account of age. Admiral Sampson la
now in this city on waiting orders, bis
health having compelled his relin
quishment of active duties several
months ago. Admiral Cromwell 1 in
command of the European station.
