Sec. 2. That every dog kept or
staying . about any inuse shall be
deemed sufficient evidence of owner
ship to authorize the assessor to re
turu the person inhabiting said house
as tho owner of possesion of such dog ;
oud every dog not returned shall be
: deemed- to have no owner, and may he
'.lawfully killed hy auy person seeing

$jkc. 5. Thai', when any inhabitant
of the county aforesaid shall have any
sheep destroyed or injured by a dog
or dogs, the appraiser- Mentioned in
this act are hereby authorized and te
quired t view and' ascertain the
amount cf damage sustained hy the
ouerf suelr sheep destroyed or in
'jared, as" aforesaid; aud when they
shall have ascertained tho legality of
tne claim and the damages no sustain
ed, h,ey; or -auy two of them, shall
certify tho same under their hands
aridseals, to the commissioners of the
. sai county, who shall draw their war
. -rant on the county tieasurer for the
amount so certified, to be paid out of
the fund arising from the tax on dogs:
Provided, That this act shall not be so
construed as to repeal any law now in
force providing for the collection of
damages done to sheep by dogs, from
the owner or owners thereof: And pro
vided further, That the said appraisers
shall tiot certify an sppraisemeut of
damages to tne county commissioners
. for payment, as aforesaid, in any case
in whieh, in thciopinion, there" is suf
ficient proot to charge, the owner or
owners of dogs, who are solvent, with
the damages aforesaid, under existing
laws, until suit shall have been brought,
- tried, and judgment cutered against
the, plaintitf. .
Sec. 4. That when" any inhabitant
of the county aforesaid shall have auy
. sheep destroyed or injured hy a dog or
dogs, he may make cnjuplaiut to one
of the justices of tho peace of his or
her township or borough, who shall
thereupon appoint threo appraisers of
said yamago, who shall have full pnw
" cr and authority to exajuine, as wit
ncsses, any person or persons, who
shall apjwar before them, resKotin:
the premises, upon oath or affirmation,
to be by them administered ; and it
thai! ho the further duty of tho said
appraisers, ami they are hereby re
quired, to ascertain, whether-the owner
f the iheep so destroyed or injured
owns, possesses or keeps a dog or dogs
about his or hrr premises, and "hull
make report of ths fact, together with
the appraisnieuf of damages afore
said, to the commissioners of the said
county; and if it elmll appear to the
said -commissioners that the owner
aforesaid did. not make a true return
'. to the proper assessor, of tfie said dog
or dojis, the said owner shall not be
eutitled to receive uny part of the said
damages.
