Assembly of the Commonwealth of Penn
svlvanio,' entitled 'An Art ti rogulate the

Is hereby given. That any person
excepting Justicos of the Peace who shall
hold any oflice or appointment of profit or
trust under the United States, or this State
or any city or corporated district, whether
commissioned officer or otherwise, a
subordinate officer or agent who is or shall
be employed under tho legislature, execu
tive or judiciary department of this State,
or of any city, or of any incorporated dis
trict, and also, that every member of Con
gress and of the State Legislature, or of
theaoloct or common council of any city,
or commissioners of any incorporated dis
trict, is by law incapable of holding or ex
ercising at the time, the office or appoint
ment of judge, inspector or clerk of any
election of this Commonwealth, and that
no inspector. Judge or other officer of such
election shall bo eligible to bo then voted
for.
Also, that in tlio 4th section of tho act of
Assembly entitled "An act relating to
elections and for other purposes." appro
ved April 16th 18o9, it is enacted that the
13th section shall not be so construed as to
prevent any militia or borough officer
from serving as Judge, Inspector or Clerk,
at any general or special election in this
Commonwealth. .
A further supplement to tho election
laws of this Commonwealth :
Whereas, by an act of tho Congress
of the United States, entitled "An
act .to amend the several acts hereto
fore passed to provido for the enrollins
and calling out of the national forces, and
for other purposes," and approved March
Sd, 1865. All persons who have deserted
the military or naval services of the Uni
ted btates, and who have been discharged
or relieved from tho penalty or disability
therein provided, are deemed and takeii
to have voluntarily relinquished and for
feited their rights to become citizens, and 1
are deprived of exercising any tighta of
citizenship hereof:
And whereas, persons not citizens of
the United suites, are under the constitu
tion and laws of Pennsylvania qualilied
elections of this Commonwealth
Sue. 1. Ho it enacted by the Senate and
House of Representative's of the Common
wealth of I'ennsvlvaniuiii General Assem
bly met, and it is hereby euucte.l by the
same and in all election's hereafter to be
held in this Commonwealth ; it shall bo
unlawful for the Judges or Inspectors of
any such election to receive any ballot or
ballots from any persons embraced in the
provisions, and subject to the disabilities
imposed by said act of Congress, approved
March 3d, 1.SC5. And it shall be unlawful
for any such person to offer to voto any
such ballot or ballots.
Sbo. 2. That if any such j udge or inspec
tors of election or any of them shall receive
or consent to receive any such unlawful
ballot or ballots fioniany such disqualified
person, he or they so offending shall be
guilty of misdemeanor, and uxn convic
tion thereof in any Court of Quarter Ses
sions of this Commonwealth, he shall for
each offence be sentenced to pay a tine of
noi less man one Hundred oculars, and to
undergo imprisonment in the jail of the
proper county for not less thansixty days.
Kku. 3. That if any person deprived of
citizenship and disqualified as aforesaid
shall at any election hereafter to be held
in this Commonwealth voto or tender to
the officers thereof, and offer to vote a bal
lot or ballots, any person so offending
ball be guilty of a misdemeanor, and on
couviction thereof in any Court of Quarter
(Sessions of this Commonwealth, shall for
each offence be punished in a like manner
as provided iu the preceding section of
ims act, iu me ease oi oiucerB or elections
receiving such unlawful ballot or ballots.
Bkc. 4. That if any person shall hereafter
persuade or advise any person or persons
deprived of citizenship and disqualified as
aforesaid, to offer any ballot or ballots to
the officers of any election hereafter to bo
nam in una uoinuionweultn, or shaft per
uade or advise any such officer to receive
any ballot or ballots from anv person de
prived of citizenship and disqualified as
aforesaid, such persons so offending shall
be guilty of a inisdeuieanor. and noon con
viction thereof iu any Court of Quarter
(Sessions of this Commonwealth, shall be
punished in like manner as provided in
the second section of this act, in the case of
omcers or such etectiou receiving such un
lawful ballot or ballots.
I also give official notice of the following
provisions of an act approved tlio 3nth of
March, lWifl, entitled "An Act regulating
the mode of voting at all the elections iu
this Commonwealth."
8ko. 1. lie it enacted bv the Senate and
House of Representatives of the Common
wealth of Pennsylvania in General Assein
bly met, and it is hereby enacted by tlio
authority of the same. That the qualilied
voters of the several counties of this Com
monwealth, at all general, township, .hor
ougu and special election are herchv here
after authorized and required to vote bv
ticket printed or written, or partly print
ed and partly written, severally classified
lis follows: One ticket shall embrace the
names of all judges of courts voted tor,
and be labeled "Judiciary," one ticket
shall embrace the namos of all the Suite
officers voter tor and be labeled "State,"
oue ticket shall embrace the names of all
the county officer voted for, including
office of Senator and member of Assem
bly, if voted for, and member of Congress,
if votd for, and be labeled "County," one
tickot shall embrace the names of all the
township otlioers voted for, and be labeled
"Tewnsliip," one ticket shall embrace the
name of all the liorough officers voted for,
and be Jalx-lcd "Borough," und each cluss
shall be deposited Iu cpcrate ballot boxes.
Tho Judge of the aforesaid districts shall
representatively take charge of the certifi
cates of return of tho election of thoir re
spective districts, and produoe them at the
l'rothonotarv's office in the Borough of
Tinnesta, as' follows: "All Judges living
within twelve mile of the prof honorary'
office, or within twenty-four mil, if their
resilience be in a town, village or city upon
tho line of a railroad leading to tho county
seat, anall, before two oeloek, p. ?n., on
W KDN E PAY, NOV KM BEK FOURTH,
1874, and all other Judges shall, before
twelve o'clock, in., on THURSDAY, NO
VEMBER KIKT1I. 1874, deliver said re
turns, togothcr with the return sheets, to
the protlionotary of the court of common
pleas of Forest county, which said return
sheets shall be tiled, and the dav and hour
of filing marked thereon, and alin.il be pre
served by the protlionotary for public In
