To Mr. William Tayman, of Lnvans ville, is due the credit for constructing the first and only genuine race track iu Somerset county. The track was survey ed and staked off bust fall by a competent engineer on the most approved plans, after which it was graded at great ex? peusc. Tl)is spring Mr, Tayman hr.s exK-nled oonsJdorahlo money and lalsir in improving tho track and to-day rests satisfied that he has a oourso for speeding ami training horses second to none in this section of tho Stato. Tho track w ill permit six horses to Ik) driven abreast at any jsiint on it, w hilo tho curves are turned with a grade that ii.urcs the greatest speed and least discomfort to horses Mr. Tayman lias employed a professional trainer from Baltimore an I has an efficient corps of stable lxys. Iast week he had alsiut twenty-five horses in his barns, all of which will bo trained on his track this summer, and it is more than probable that he will arrange a series of trotting and running races to come off In-fore the close of theseason. James McFaiden- Ueaders of the Hkkai.d will recall that an oflbrt was made ab:it two years ago by tho lsirough of Itcllcfoiite, Centre count, to compel the Poor IirH-t;rs of Somers'-t county to pay for the mainte nance of James McFaddeii, a i.ior person mi i lined fir lhe past eight years in the Stato Asylum for tlie Insane, ut Iianville, Pa. The eiVort was vigorously resisted by t!io Poor Birectora of Somerset county. through their attorney, lu ('. As the suit involves a point of law never before raised in this county, we publish the decree of the Court in full: I iversoers of the Poor I ). S. Centre Co. of Borough of Belle- I No. 71. January finite, Apts. I Term Is!,, vs. .Somerset Co., Ixr Bistriet. Filed May 3Kh, Stkkisktt, C. J.: This contention involves tho construct ion of clause V. of Section 9 ofthe poor law of Juno l't, IS-'li, prescribing the man ner in which "any unmarried person, not having a chiid," may gain a settle ment in any district, viz: that he or she "shall be lawfully hound or hired as a servant, within such district, and shall continue in such service during ono whole year"; Bright. Purdou 17u5 pi. .ii. The bah Section of same Act provides that "Oil complaint made by the Over seer of any district to one of tho magis trates of the same county, it shall lie law fill for said magistrate, w ith any oth er magistrate of tiie county, whore any person bus or is likely to become charge able to such district into hieh be shall come, by their warrant or order, directed to such overseers, to remove s-j-h person. at the expense of the dis'.ri- t, to the j!y, district or place w here be was la.-1 legally settled, whether in or out of Pennsylva nia," etc. Purd. 17mi, pi. is. Pursuant to these provisions, the ovcrstsr-rs of Itcllcfoiite Imrough, alleging ihat James McFadden, Hi' smr pei-s.ui in question, WM last legally settled in Somerset coun ty p-..or district, and on April Pith, K'Z, obtained an order to remove him to that district, and nine days thereafter the overseers, of Somerset, by leave ofthe Court ls-low, apiiealed from said order of removal. At the heal ing il was conclusively shown and virtual'- conceded th.it McFad den, "an unmarried person, not having a child," had acquired a legal settlement iu Somerset county by having scr ol there in, from the spring of 1S--I to tho fall of lss."i, in rmrs-iunea of a hiring with Messrs. Collins A Shoemaker; bat. it was contended by the overseers i;f said district that he subsequently gained a sctlicmonl in another poor district by hiring as a servant therein and continu ing "in surh service during ono whole year," as ruptured by clause V. above quoted. They thus assumed the burden of proof and introduced testimony from which the Court was fully warranted in finding facts establishing a su'.iseijneiit legal settlement in another imor district, and consequently tho order of removal was rightly quashed. As liearing on the fu-t of a siiliseqitcntly a -quir d settle ment the Court found s-.ib-tj::tially the following facts: Thai, from February l-v, until September Isxl, McFad-Ien was hired by the Beliufonle Ftirua- Compa ny, owner of a large furnace in Spring township. Centre county, adjoining the borough of Bcllefontc; and, during that period, continued i-.i the service of said company, iu said township, under the same contract of hiring; that while said service whs thus lieing performed in Spring township, McFadden lmardcd and lodged with his mother in the Imr ough of Bcllefontc, paying his lx..,nl!i;g to her as he would h ive d ine to a stran ger. These findings cf fact were fully warranted by the testimony, and not lie ing excepted to, must lie ayn p?od as con ulusively establishoL Wo thin have a contract of hiring for service iu Spring t-iw nship by an "unmarrie-.l person n t having a child,'' and his continuance "in such service during one whole year," thus fulfilling, in bull letter ami spirit, every requirement of tho clause above quoted. There Is no merit in the suggetion that there must lie both resident and servicu in the same poor district. V(-hile in oth er clauses of Ue ;KU Sol-lion ofthe Act, icsidiait in the district is made a condi tion of gaining a legal settlement therein, clause V., under consideration, coutojns ns we have seen no such requirement. The construction sugjjes.ted would re quiro us to read Into tho clause some thing that is neither there nor over in tended to I there. While, uiHin the established facts of the ease, tho learned Judge was mistaken in locating McFadden's sulisequently ac quired s ttlet.ient in Bellefonte, instead of in Spring township, ho was neverthe less clearly right in his general conclu sion that the order of removal shoald ls quashed on Cue soIj ground that S.imcr set PMir Ifistrict was not his last place of legal settlement. The so'to controlling fact was that he had gained a legal settle ment in another pior district after he lea S imerset county. That definitely deter mined, tho only issue between tho two parties then and now in Court. To that issue, tho overseers of Spring township were not parties, and, or course, cannot Ikj affected by the decree therein. Decree olfinned and appeal dismissed, w ith costs to lie paid by appellant. Nature's Dealings Wtth. Kan. From New York Tribune.
