The tinding of the dead Ikh! of irant
Zufall in the canal in the southern limits
of the city adds another weird incident to
the dark history of that mysterious local
ity. At this uriting it is impossible to
speak with an' degree of certainty as to
the manner in which Mr. Zufall ci:n to
his death, but there are certain facts, not
yet made public, which strongly justify
the suspicion of fml play. The theory
that in attempting to 1-oard a train he
was thrown over the cmUiiikment is
must improbable. There was no necessi
ty for him to go to such a place in order
to get on a train, as he lnd Indh money
and a pass iu his iMskit. Two fails
strongly support the theory of foul play.
Life was evidently extinct when the laxly
reached the water, and tho ice around the
hole in which the body was found seems
to le of a later and newer formation than
that in the immctliuta vicinity.
Tho fact that the losly was not robbed
of everything valuable does not altogeth
er lissise of the suspicion of violence.
The perpetrators of the awful crime 11 -iy
have left the watch and money upon the
person with the design of creating the
impression of accidental death, and it
will Im? advisable for thejury to keep this
in view during their investigati in.
One great dillieulty.in the way of a so
lution of tli3 mystery is tint Mr. Zufall
wa a stranger in this locality, and two
months have passed Mtiee ho disappear
ed. Under these c rcumstunces it is very
difficult to find any tine who retuenih'.-r
having seen him tin orabuit the time in
w hich he is supposed to huvo been iu the
city.
Hut whether the mystery of Mr. Zu
falrs tleath is ever unravelled or not, it is
well enough to call the attention of the
railroad and can. il authorities to th' im
portance of erecting a guard rail along
this dangerous embaukmei.t. It is dd
that no less th in six violent deaths have
occurred in this locality, t'.ie bidics t.f
live having been found iti'lbe canal.
Death of Charley Sim -non.
Charley Simpson died at 11 o'clock
Monday night at his home on West Pa
triot Street, itged thirty liine years.
AKitit two years ago tho deceased was at
tacked by softening of the brain and, not
withstanding he had the benefit of emi
nent medical attention, nothing c iiild lie
done to check the course of the disease.
Recently he submitted to a delicate surgi
cal operation which promised b give per
manent relief, hut tho hopes aroused by
the operation were s hiu to be dissipated.
Mr. Simpson was married abut eighteen
years ago to Maggie, daughter of Mr. and
Mrs. John A. Walter of this pluevj. One
son, Frank, resulted from this marriage.
Mrs. Simpson died shortly after tiie birth

The hearing iu the Milford township
coutesied clei-iioii c tse, a statement of
which was published iu these columns
hist week, was had Friday evening, be
fore President Judge Longemt-ker, A .
ciatc Judg'-s Hiistv ker and Homer :i!s
lieiigon th" lo.'in-h. The large crowd in
atteudali.-e at the hearing e ideii.s-d the
interest that was taken iu tho matter.
About one-third of the voters of Milf ird
township were present, all anxious to
hear the decision of tlie Court in a matter
that they iiad diseuvsel and argu-sl
uniting themselves to the exclusion of al
most every other subject f.,r days preced
ing. After tlisjHising of several oilier matters
that were brought to bis attention by dif
ferent incmiiors of the Har, Judge Iyn
enecker announced that he was ready to
take up the election cases. Messrs.
lvister V Kooscr, Kooutz and Herkey,
attorneys for ieo. F. Kimmel, at once
tiled objections to the Court taking cog
nizance of and hetiring tho question
raised by the objections for the reason
that the proceedings were begun liefoie
Assts-iate Judge Horner, at ohamliers,
and, therefore, the Court as now consti.
tuted has no jurisdiction In the matter,
la other words, they made the remarka
ble request that President Judge Lotigc
neckcr ami Associate Judge Hieseekt r
retire from the licneh and Associate J:nli,e
Horner Is? allowed to hear and decide tiie
matter liefore the Court. The novelty i f
this motion and the object in view wet e
so apparent that its reading caused an al
most audible smile to pass over the coun
tenance of all who heard it. Judge I. uig
eneckcr overruled tho motion, likewise
the objections filed to Markle's ccrtini-a:e
of nomination, and ordered the costs oi
the proceedings to be paid by the peti
tioner, He.). F. Kimmel.
Among other things. Judge Hongeneek
er said that if only 0:10 of th? ballots cast
f ir Markle had cmtaiiie.l the two year
designation, and none of the ballots cast
for any of the other candidates designated
the term for which they were candidates,
Markle would I the legal nominee for
the two-year term. In dividing this tho
Court simply applied the law governing,
general ejections (so well laid down in
hc Meyersdale hcIkmiI oontust a few years
since) to primary elections. In this ca-c
Markle received :CJ votes for school direct-;
or and Kimmel VA. There were two dirts-tors
to Ik? nominated for a term of
three years and one for two years. All
but four of Markle's billots contained
the two ypir designation. Kiniiiicl's
baliots did not designate for hit h term
he was a candidate; therefore Markle
was the only candidate voted for for the
twt-vear term.
In the matter of the objections filed by
Markle to the ticket of tho "Citizens Ite
puhlicsn Party"' being printe I on the of
ficial I allots, the Court dismissed the pe
tition at the costs of the ietitioner.
The division that Markle was the legal
nominee was very gratifj-ing to him and
his friends, a it sustained the position
taken by his attorneys. Mtsrs. Scott,
ISiosttcker and Scull, ami pluvd his name
regularly upon the lb-publican ticket. It
was thought the decision of the Court
would end the controversy and that Mr.
Kimmel would withdraw his "Citizens
Republican Party" ticket, but such was
not the cast?. The "Citizens' HepuMi.-au
Party' ticket, containing the nameof Mr.
Kimmel and several titheis, was printed
on the official tail lots and the contest was
carried on at the polls Tuesday, with
w h:it result we Jiave not yet learned.
Fnder tho circumstances Markle's elec
tion ought to In assured, as the Re
publican of Milford township are
not much given to Wilting regular
nominations, although the fact that
the lH.-moer.its only nominated one
candidate for school director, thua
leaving the way open for an alliance
with the ineinl)frs of the "Citizens' Ite
publicau Party," place an element of
uncertainty aa to the result of the coc test. '
