Charley, eldest son of Alex Benford. of
this borough, died at tbe residence of his
father Wednesday morning, after a prolonged
sickneso. He had been engaged in the mer
cantile business at Holiidaysburg for several
years prior to his death, and was brought to
Nmer.-et about ten days proceeding his
d. alh. His wife and two children survive.

Mr. E. J. Sese, of Ule township, writes
ns in regard to an interview with Slate Or
nithologist Warren, which appeared in this
column several wetks ago concerning a new
species; of rabbit that has a:ia-eil in west
ern Pennsylvania, Mr. Seese fays that the
Secies re'erred to wearing a white coat in
winter and grey in summer is native of that
township ; that be has frequently heard his
grand father and father speak of them and
that he binilf ha" seen them every winter
during the past fifty years. He savs thev
are at least one-third larger than the com
mon grey rabbit a:id wear a very heavy coat
of fur.

morning were engaged in examining tbe ap-pli.-ations
and reference of the military gen
tlemen, of whom one is to be appointed to
succeed Lutenant Kilbourne. The war de
partment refused to extend the lieutenant's
tour of duty at that intitution on the theo
ry that it would be unjust lo other officers

receired information from the Stale Board
of Health of tonnecticut that smallpox now
exists at five different points in the central
pinion of the S'ate. The infected towns are
Vind-.r Imks, WooiL-tocks. Waterbury.
Vmsi. Viiid.r and Meriden. Many i-ersons
have been expeJ to the contagion, in con
sequence of the fact thut individuals suffer
ing from the disease have been allowed to
travel in public conveyances. It is, there
fore, recommended that all erxtis who
may have occasion to visit ttie region indi
cate! take the precaution to be vaccinated
before leaving home. The disease has also
been officially reported during ile past two
weeks from the State of CViio. Michigan, Illi
nois and Massachusetts. Health Osiers in
Pennsylvania, especially in the western part
ofiheSta'e. should, therefore be on the

Contrary to the usual high sUte of public
feeling annually ruani ferfed by the residents
of Somerset When applications for liquor
licenses are to acted upon by the court, the
Ijcal ball of justice was vertr spar-ely filled
when the question was c-l!ed up at Thurs
day afternoon's esion. Lawyer A. C. Hol
bert. representing fhe application of Mrs.
Jane Winters, of the Commercial Hotel, was
first to claim the attention of the court.
Considerable interest was experienced by
that gentleman's fel low -attorneys to hear
bow be would explain bit incongruous po
sitionhe having appeared in behalf of the
remonstrants last year. Mr. Holbert opened
with a quotation from the title page of
Alexander Stephens' history of the War
I t ween Tbe States: "Times change, and
men often change with them, but principle
never."' He then proceeded to discharge a
bomb that he had jealously guarded, which
when exploded struck the spectators with
amazement, and caused the learned gentle
men on th- Bench to elevate their brows
and prick up their ears in a startled man
ner. He charged tnat there was do remon
strance before the court against granting a
license to his client, inasmuch as the affida
vit required to be mad to the rem-jns'.rance

risburg two wea.ks from to day, Wednesday,
Febniary 18, when the application of Joseph

of last week. The examination of witnesses
was conducted by Messrs. Coffroth and
Koonlx on the part of tbe prisoners, and by
F. J . Kooser, Erq , on the part of tbe Com
monwealth. Tbe first tvitnesa to be examined was Mrs.
Mary Spiegle. She said that the lived in
Jenner township, about one mil from Vm
berger't ; that aba wat fifty-three years of
age and wat the wife of Jacob Bpeigle. Tbey
were in the habit of keeping stracgen at
their house. On tb 13th day of February,
ISO. man by tbe name of Showers came
there. She knew it was the 19th because it
was election day. A man came on Wed Dea
dly who said bit name wat Frisbee. Con
tinuing, tbe witness said : "Showers wat a
middling good-sized man, about as tall as
Mr. Kooser. He bad nice black hair and
mustache. He wasn't a

Was pretty fair. Tbe man wbo came on
Wednesday wts tall and heavy set. Hit
hair was black, but not as black as Showers', i
He had a brownish mustache and wore a
derby hat. He only stayed about three
quarters of an bonr. Shower left Wednea-
morning ; said he was going to Haines'. I
never saw either of them afterwards. Show
ers said he wat a phrenologist. I saw him
examine heads at the school house."
On croM examination, the witness said
Showers lectured on Tuesday and Wednea
day nights at the school house, and that
Kris! drove awav in bis sled towards tbe
pike.
Ross F. Hammer was the next witness
called. He said : " I live in Jenner town
shic. one half mile from Vroherger't. Am
Hi veara old. Showers met me on the lfnh
of February at Speigle's. At supper he an
nounced that he would lecture Tuesday and
Wednesday evenings'. He came to my
house Wednesday evening and announced
a lecture for Friday evening. On the Klh
I met a man coming down whom I took to
be Frisbee. He was a magic-lantern show
man. I met him on the pike above For-
wardstoa n. He was about as tall as General
Kooutz; bad dark hair and dark mustache;
was dark complextonei!. and was not red
faced. Showers left my place Tuesday
morning, and I never saw him afterwards.
I saw J. and lave Nicely when they were
being tried. These men did not look like
the Nicely t."
Cross-examined "There were from 15 to
39 people in tbe audience at the lecture;
Showers had jet black hair aud mustache ;
his bair was long and curly ; I met tbe man
I tot k to be Frisbee about three miles from
I'mberirer sou the 13th. going north, towards
Johnstown and aaay from Cmberger's. It
is a common thing to meet psiple on the
pike and to have entertainments at the
school house."
The next witness called was Perry I'm
berger ; lie said "I know Charles and Lewis
Vaneer ; I received a letter from them since
the trial of the Nicely t in court. They did
not demand part of tbe reward or claim it
I destroyed or lost tbe letters. They wrote
me that if they were to have part of the re
ward I wis to notify them or bold back part
of it" - 1

A. C. Holbert, E--q., next took the stand;
he said, am jng other things, I am an At
torney and was present at May sessions of
court l-9. I thought there was a consider
b'.e amount of excitemen', or interest, at
least, caused by tue murder trial and tbe
trial of the Yoder robbery case. Tbe Yoder
case. Com. vs. L" is aud others, was tried
first. I was concerned in it and was present
during most of the trial of the murder case
There was a strong feeling so far as my
knowlege went that the Nicely 'a were the
guilty men and ought to be convicted ; I
heard parties nuke the remark, the com
monwealth were making out a case and that
the defendants ought to be convicted. There
was a strong feeling against these men."
J lestion Was there not such excitement
in the popular mind at that lime against
tejrsons cbarg-d with these higher crimes at
court, as to render it unlikely that a fair and
impartial trial could be bad
Answer I considered that I could not get
a fair trial for my men.
j What do you say in tlte case of the
commonwealth vs. Joseph and David Nice
ly? A. It was a higher crime, than the other
and probably there would be more difficulty
in that than in the other.
Cross-examined "I was admitted to the
bar in lv7 ; was a law student of General
"offroth;I was in the court room all the
time the Lewis case was on trial, and most
of tbe time of the Nicely trial.
John H. I'hl. was the next witnessed to
be examined. He said : "I am an attorney
and have been at t lie bar since I was
present at May sessions when lwi tf a!
were tried ani when the Xicely's were
tried; there were a gx! rainy people
in town ; there was considerable talk against
these people for having committed these
crimes; Mr. H 'lbert tnd I defended Lewis
flal.l can t say that the excitement got into
the jury box or effected the jurors."
The last witter to be examined was M.
D. Humbert. He said : "i iiveon the I'm

remember tbe time of the appraisement of
the real estate; Perry l'.n j.Tger was pres
ent ; afier the appraisement he turned to
Mrs. I'ruherger and said there was more
trouhleover there, that tbe Vaneers had come
in and notified him not to pay over tbe re
ward ; that they had promised them to pay
them one-half if they would come over and
reveal on these parties ; I know Retioen
Horner; be was at my borne before the trial;
be told me none of them, except Adam
Frirdline, could identify the pocket-book.
On cross examination the witness said :
' I am a tenant ; the rent is not due. I was
notified to leave; the appraisement was held
on 2nd. December; John A. Waller and Wm
Rink were p'esent ; the conversation occur

We were entertained by Prof. J. M. Berk
ey and Rev. Zinn. tbe former speaking on
" The missions of our public schools," the
latter giving an " Address to directors and
teachers." The evening session was inter
spersed with music, by I. S. Pile, Miss Min
nie Moure, Miss Louise Moore, Miss Pile
and Mr. Pile.

Through the Creensburg Arjta we learn
of a most distressing occurrence that took
place on tbe McLaughlin farm, near Trees'
mill, Salem township, Westmoreland coun
ty, Sunday evening. EJward Black, ton of
Jamet Black, started on horseback on tbe
evening named, to a distant part of the iarm
to drive home the cows. Soon afterwards the
horse, riderleae, came galloping back, and
Mr. Black started out at once to find his ton.

School Saving Banka.
The savinpi bank feature it to be engraft
ed in the public school system of Philadel
phia. At every school building in the city
tbe children in attendance will make their
despuaita, and will be given a receipt for tbe
same- Provision will also be made fjr tbe
withdrawal of funds, but every inducement
will be offered to the youthful depositors to
incline them to allow their mites to draw
interest in the savings fund strong box. Tbe
rtte of interest to accumulate on tbe deposits
bas not yet been decided, bnt it will be about
what is paid in tbe savings fund of tbe city.
