Does It Coma Under the Law ? One of the many interesting minor points )iich have arisen in connection with the !I gh I.ieuiiii-law has been passnl u;o:i by the Supreme Caurt. In an opinion filed by Justice Williams in tbe case of the Common wealth against Ileyliurg, which cam? up from the (Quarter Siswlon-i of Warren county, the ilef. ml nit was indicted for selling aider without a iiieire, and tlis oounty court dis missed the pntsecittion on the ground that cider w.i a non-iiifoxicating liquor which mirbt be rs-ild without a license. Tiie Supreme C:urt declares that this was an error, holding 'hat the question was not whether ci'T was intoxicating, but whether il was Tnrio, brewed, spirituous or vinous liquor, these being the four kinds for the i sale of wiiicii a license is requisite. Tbe I ourt further holds that this is a question of fact lo be decided by a jury and not one of law to be sett Us by the court, Tbe case is therefore sent b3ck for re trial on that point. "In common acceptation," says Judge Williams. cid?r is nM mi.icrstood to be ei ther a vinous or spirituous beverage, and yet when fermented it doubtless contains a perccutaire of alcohol sulhYieiit to bring it wi'.bin the fair meaning of tbe term 'vinous' and although not the product of distillation, it may when mixed with spirituous liquor and fid in that condition under the name of cider, lie regarded as spirituous within tbe meaning of the prohibition. There in always a calm ul'ter a storm ; tbe reaction is some'imes more effective than the jar itself; Ibis would seem to be true of tbe legislature. The recent general strangefreak in tbe organixation of l-oth the House and Senate has bad a reaction, and it is now said by those high in authority that if the scene were to be re enacted it would result quite differently. There are those who say Senator Quay found it harder work than he bad any idea of to bring about tbe change, especially in tbe Senate. However, tbe jugglery of the reve nue bill, and tbe bad legislation enacted but session is said to bare disgusted tbe Senator, and reform seemed necessary in bis opinion; and to bring it about, a change of sane of tbe oQcers in both branches was necessary. In connection witbthe question, Can Quay be a reformer?"' the reply comes, " Can a leop ard change its spots?" with significance. There seem to be a figbt in earnest be tween Senator Quay and that prince of boss es, Chris. Magee, of Pittsburgh, inasmuch as tbe Chief Clerk of both tbe Senate and the House are both Irom the city of the latter, but not of his selection or friends. The si lence of the wily politician from Pittsburgh is in keeping with bis methods. Those who are closest to him say he will be heard from in the near future. As some daily remarked at the time " be is young, handsome, and has a goodi memory." Time only can tell what tbe result will be. but that some grave errors were committed, now seems patent. These reflections come to the sober-minded legislator, as he sits in bis seat and looks about him and sees the changes made since last Bcssiou. There is an exceptional numlier of good young men in the lower House who are now servun: their first term. The Judiciary Gen eral Committee is composed of a numlier of the best young lawyers in the State, and they are doing some good work. Both Houses are now under fair headway, with plenty of work to do; a large number of bills have been rend iu plate and referred to the proper committees, and they' are hold ing daily taieetiugs, and quite a number of bills have been reported and are now being printed. Ou Monday the electors of the State met and formally cast the vote of Pennsylvania for Harrison and Morton, and appointed tbe Hon. Porter S. Xewmeyer, of Connellsville, messenger to carry the returns to Washing ton. Vr. J- K. Miller, of Berlin, elector from your Congressional district was pres ent. The House met Monday evening, but did yery lit tle business of importance. The Sen ate did not meet until Tuesday evening. On Wednesday evening a joint cauens of the Senate and House was held in the hall uf the House, when it was resolved to pass tbe Constitutional Prohibitory Amendment resolution. There was some little discussion as lo the pror wording i the resolution, but with a large majority of the H"publican members it was dis'iu-sl unnecessary to cau cus upon it, but to pass it and redeem the party pledges. The fixing nf June l-tti next as the time for holding the special election was opposed by some, who doubted the wis dom of holding a special election, but mcrt of the members are in favor of the same. There is much speculation as to whether the State will vote in favor of the amendment or not, and if the same is carried, whether the Governor wiil not call a stiecial session of the Legislature for the pur-iose nf enacting prop- ! er legislation to carry the amendment into I etft-ct. On motion, at Friday morning's ses- I sion a siecial order was made to passthe res- ; olation finally on next Tuesday at 12 o'clock j ni , when it will be sent to the Senate for I I passage and concurrence. I The resolution abolishing is, II tax has also t been presented, and will pass. It will likely j be vited upon at the same time The old k'nee Jaw of A. L. lino it sii.rn9i must go. There have bteu a iiutuiier of bills tiiTered to reH'iil the old horse high, bull strong and hog tight, fence, made of rails or logs. Tiiere are some of the former which favor enacting a new fence luw, but a majoriiy seem to think no law is needed. Tticru arc two contested rases tietore trie Committees, one in the U-nale that of Oj born vs, Dcvl'n. and one in the House Finley vs. Nichols, both from the city of Philadelphia, and both of which will c-wt the State a large sum, and will !ik!y rsult in both mcmliers drawing their salary. The boundary line act pissed last session will likely he amended, as there are several bills pending before tiie Judiriary dein ral Committee looking to that end. The scalp act may be amended by putting foxes in, but it is doubtful, as it imvij with much opp osition. It is favored by Repri'sen tative Pugh, of your county. Philip. Terrible Fight With a Mob. The re sult of the contest for the (iovcrnorsbip in this Slate will bj du;tl Government, for brief space at least, alter the 4lh of March. The Federal Adiuinislration will have to be called upon to settle the difficulty. This is the opiuioit of the leading politicians of the Stale. Xo sooner bad tbe Democrats been de feated in the courts in their efforts to pre vent tbe delivery of the returns of Kanawha county to the Legislature, with which Goff has a majority of tbe votes cast for Govern or in the State, than they began to search the Constitaiion for technical pretexts for with holding a declaration of the result in tbe presence of the tw j Housai in joint assem bly, as provided by tbe Constitution.
