Ten Called but Three Chosen Som erset Uoes Dry. - When the Hfald went to press on Toes day evening last, the all absorbing license question was occupying the attention of the court and eloquent attorneys were making exhaustive arguments in fitvor of or against granting the prayer of the ten applicant who prayed to be authorized by the court to retail liquor to their 6 !Iow citizens from f H. 3,, u Janaary A. D. lsss , ,ho 2kh day of January A. D. The argu ing of the question was kept np till noon Wednesday when court was adjourned to half-past one o'clock r. when it was an nounced the court would render its decision in the matter.- Of course there was a great deal of speculating on all side as to what that decision would be. Promptly at the ringing of the bell in the afternoon a large and eager crowd of spectators rushed to the court room to hear the decision of the court announced- Quite a number ofladics. promi nent in tlie W. C. T. t. movemeut were in the audience. The full Bench was present. Alter court bail been duly opened Judge Baer read the rulings on the different appli cation. The applications of Scott Sterner, Confluence ; John II. Sliccr, Nathaniel Sli cer, Robert Guthrie and E. Kyle, all of Meyersdalc ; John Winters, of Somerset, and A. A. Miller, of Frsina were all refused. Aguinst all these there were large remon strances. The number of remonstrants being very far in excess of the petitioners. The applications of Charles A. Mitchell and Edward Xieklow. of Addison and Agust KiFhler, of fonemasigh, were granted, there having been no remonstrance filed against them. The derision of the Orart was received with very general satisfietion, much more so than last year when all applications were refused, without regard to petitions or re monstrance. Utcour many of tlie appli cants and friends of license were greatly dis appointed at the ruling of the Court and were very free in expressing their opinion of the same, but the general public w re sutis tieil that the decision was a just one. The apjilicstions of distillers and wholesale deal ers will come up at the April argument court, when the temperance eople will make a strong etlort to have the manufac turers shut off. Following is the ruling of tlie Court on tlie letail applications. In the case of the successful applicant., Mitchell, Nicklow and Kueuler it is as follows : i . 1,a' P'n necessity for a licensed house, and the fitness of the applicant and displace having been amrniatively establislied as required by the law passed May 1 !, ls-7, by more than the requisite number of certifiers in each case, and no remonstrance Iiuvini? been filed against tlie granting of the licenses, and nothing made toapirar to the Con rt that would warrant a refusal. Hie license to each of the said applicants is now granted as pray ed for, for the period of one vear from this date. I'eb O'Eiam. In the cases of the rejected applitions the opinioii of the Court was as follows : The petitions iu each of these case is in form and bond approved, except in one case. The fitness of lite applicant, and the houses I applied for, is conceded. But the necessity 01 the license to each 01 tlie applicants lias Ix-en vigorously availed. Petitions and ad ditional pctitiotis have been filed, as nave also remonstrances and supplemental re monstrances, all in time nnder the rules of Court. Tbe Court, after full bearing and careful examination, has carefully considered each case as presented, and lifts given that due re gard to Ihe number ami character of tlie J titiotiers for and renioiistrtince against grant ing license as liearing on the question of necessity (that being the only issue before the ourt) as nvpiind by the Act of Assem bly of i.'ith May, IvC, and. having judicially considered the several cases as they would any other question before them, and not by the exercise of a mere discretion, as nnder tlH'ir oaths they conceive it to lie their duly uinier the act of l.s-.7. they. do now, on the prejs itiderain-e of ev idenee made by remon straniTS as viewed in connection with the etition, anil a.lditi.mul petitions, refuse iich of said applications. PEB f't'BIAW. After the license question was disposeil of by the court Wednesday, the argument list was taken up and most of the cases on it were argued and ilisjHaed of. Court ad journed Friday noon to meet at half-xist one o'clock Monday afternoon to receivive the reiHirts of tiie county Auditors. Tiny were presenti-Uliy the Auditor's Attorney, F. J. Cornelius Berkley, an aged resident of Jef ferson Township, and one of the most widely-known men in the county, was found dead in a field on his farm, less than one half of a mile from his house, Mon.lay morn ing. Saturday morning he came to Somer set on a sled, iu company with his neighbor, Mr. John ltruner. After (pending the day in Somerset, they returned to Mr. Bruner's tlie same evening. Mr. Berkley got off the sled at Mr. Bruner's barn and started acroos the field to his own home, about one-half mile distant. He never reached his home alive. a. his dead body was found in the field a short distant: from the road, Monday morning. He was a minister of the (ierman Baptist Church, and his non-apvaranceSat-uniay evening did not alarm his good wife any, as she supposed he bail to -d at one of Ihe neighbors' close by the Kimmell church, where cotnmnnion was to be held Sunday. When Sumlay and Sunday night had assed around without her husband coming b.mie, or sending her any word, she began to become alarmed, and early Monday morning went to one of her nearest neighlwrs to inquire if they knew ought of his whereabouts. It was soon learned that he bad been with Mr. Bruuer Saiuniay night and had started through the terrible snow storm that was then raging across the fields to his home. Surmising that some accident had befallen their agnl friend, the ntighboi quickly organized a searching party who, some time towards noon, discovered the object of their search, lying face downward in the snow, in a field a short distance from the road. The weath er was bitter cold Saturday night and the snow was deep and whether the old gentle man was ovenvme by the cold and storm, or whether bis death was from some other cause, such as paralysisor heart disease, can only be conjectured. Rev Cornelius Berkley was aliout seventy years of age and enjoyed tlie respect and es teem of a very large circle of friends. ' His remain will be interred in (he ceme tery at Ihe Middlecn-ck church at 10, o'clock, Wolncsiiay morning.
