One party would swear positively to one thing and another party swear just as positively to something directly opposite and contradic tory. Il is hardly possible that the jmrties are'laboring under a mistake at the time ot giving tlieir testimony, lor tbe very places and circumstances w h-re there should be least ditlerence between the parties which should be the most easily understood and remembered are usual ly the ones that produce the most contradictory swearing. That the par ties often commit perjury is a fact little to be doubted, but the CilBculties that lay in the way ot convicting a man of this crime, is what allows so many nf these scoundrels to go un whipped of justice, la order to convict a person of Ibis crime it must be clearly proven that he not only swore falsely but that be did it knowingly and w illfully. Tbe party must believe that what be is swearing ia fictitious. Again the asseilioa must be absolute. If a man, however, swears that he believes that to be true which he knows to be false, it is perjury. With all these difficulties lying in tbe way of conviction is it any wonder that prosecutions tor this crime are so few and that a conviction is so rarely attained.
