At the last Institute held here, the ques
tion "should the rod be used in our public
schools" frequently came up. The major
ity of those who discussed it, we believe,
took the negative side, and claimed that by
the exercise ot judgment, firmness, pa
tience and love the most reltellious boys
could l brought under discipline and
made as oledient as their teachers could
desire. The city of New York furnishes
an argument against that theory which
impresses us very forcibly. The board of
Education adopted a by-law in 1870, pro
hibiting the use of the rod in the public
school within its limits. In that town
there were 1,200 teachers in the public
schools, and maDV of these were in hearty
accord with the Board of Education when
the order against whipping was given.
Under these circumstances it is fair to pre
sume that, governing by kindnets, was
given a lair trial. After three years expe
rience, hear as the result: Everv teacher
in the public schools of New York, has
appended his or her name to a petition
asking the Board of education to repeal
the by-law above refered to, and allow the
use ot the rod again. They alledge that
they have given the "new tangled,' theory
a tailbful trial, and find it without a single
redeeming trait.

Hon. S. M. Quay Sterttary of tht Com

In answer to letters of inquiry addressed
to you snd referred to me, sa to whether
section thirty of the schedule, new Constitu
tion, viz : "All State and judicial officers
heretofore elected, sworn, affirmed, or in
office when this Constitution shall take
effect, shall severally, within one month
after such adoption, take and subscribe sn
oath or affirmation to support this Consti
tution, embraces Justices ot the Peace.
It applies to sll State and judicial officers
in office at the time ot its adoption who
must necessarily have letn elected or ap
pointed under the old Constitution, or laws
enacted in pursuance threto.
Article , Section I, of the Constitution,
title "Judiciary," provides that "the ju
dicial power of this Commonwealth, shall
tie vested in certain courts therin nsmed,
snd in Justices of the Peac and in such
other courts as the Legislature may from
time to time establish."
The Supreme court has decided that Jus
tices of the Peace are Judicial officers.
They sre clearly embraced within the
officers designated in section 30, Schedule,
new Constitution, w ho shall, within one
month alter its adoption, take and subscribe
an oalh or affirmation to support the new
Constitution.
The act of June 29, 1839, provides that
justices of the iesce shall be sworn or at
finned before the recorders of the proper
counties. It would, perhaps, be proper
that the oath required under the new Con
stitution should be taken before the same
officer.
Very respeifully.

Samiel E Dimmk b,
Attonney General.

Mr. Editor : A great deal ol confusion
excitement and discord is manifest at this
time in this township, and the small villages
within its territory, on the subject of the
sale and removal of the old Lutheran and
Ketormed Church property, situate in the
borough of New Centrevillc.
Both congregations built new houses of
worship and nave abandoned the old prop
erty ; both, under the dog in the manger
policy, hve appointed committees author
izing them to sell, and they have posted
their notices throughout the neighborhood.
offering the house, bell, and church furni

Yt e contend this committee is acting on
very doubtful authority, and have no right
to dispose ot the properly advertised. 1 he

purposes, none of which authorizes them
to sell it ;' but s'i given as a boon and a

years ago the house was wcatherboarded

shall we, who can hold this building for

name of our dead sires whose dust is in
the keeping of the church! In the name
of the dead mothers of Israel, who wor
shipped under its friendly roof ! In the
name of the dead saints who gave the
ground as a religious patrimonial inheri
tance to their children, for all time ! In
the name ot the dead ministers who have
made the thunder of their eloquence echo
on its trembling walls ! In the name of
the cross, and the story of salvation by
grace, told from its sacred desk for three
quarters of a century ! In the name of its
glorious history, written on the tablets of
human hearts, and stamped upon the minds
of living men ! In the name of Sunday
Schools past and present, and the moral
instruction to the youth of the land ! In
the name of God ! In the name of all the
churches as they now stand and hope for
preservation and perpetuity ! and in the
name of the neople we do now enter our
protest against the sale or demolition of
this graud old house. The site on which
it stands is one of the most beautiful and
picturesque to be found in the great val
ley between the Laurel Hill and Allegheny
mountain', commanding extensive views
of landscape for many miles in every di
rection. Many citizens can stand in the
doors of their rural homes and look
with pleasure on the sacred house, with
its old-fashioned spire pointing upward to
that home, where fathers, mothers and!
children, who received the sanctifying in
fluences of christian fellowship within
its blessed walls do now rexie in the
bosom of God ; where they first learned
the truths of righteousness, and under the
drippings of its sanctuary prepared their
immortal spirits ior an abundant entrance
through the gates of pearl to the golden
sireeisoi ineir eternal rest. Considerations
like these should make us pause before we
strike out of existence sn ancient land
mark. Those who have lived here for
half a century, who received the seal of
righteousness at the baptismal font of the
old church, and faithfully attended its
ministry all their lives do painfully re
gret the sale and extirpation of this house;
and the younger portion of the communi
ty, in their ardor and zeal for the preser
vation of its history and glorious records.
will oppose Its destruction and cling to its
many memories. IS.

Dear Herald : The neat and lieauti
ful little church, which for some time past
lias been building at this place, was, w ith
appropriate services consecrated to the wor
ship of God on hist Sabbath.
It is to I known as , "the I'nion Church
of Kennel's Mills." The services beiran
on Saturday night with a sermon by Rev.
It F. Bishop ot "the M. E. Church. "
On Sabbath morninir the house was
crowded to iu utmost capacity with atten
tive hearers. The sermon was by-Rev. Mr.
Lepley of the Lutheran Church, a former
pastor in this vicinity, but now rcsidin; at
Hampstead, Md. Mr. Lenlv thousrh sep
arated from our people for many years, has
a numlier of virm friends who mil survive
and to whom bis earnest kindly utteran
ces brought back vividly the scenes of
other days, when in the prime of man
hood he stood liefore them as one "sent for
the defence of the gospel."
on one occasion during Ins pustoral here,
his pointed rebukes ot prevailing vices
arroused the resentment of "the baser sort"
and he was shut out of the school house
here divine service was held.
Animated by the spirit which possessed
Martin Luther on going to the Diet of
Worms, he mounted a grassy tiank in the
presence of the people and exclaimed, "I'll
pnach the gospel in this place even if
there be as many devils here as stones in
tiladden's Run."
The eveninr sermons was bv Rev. Mr.
Neal pastor ot the M. E. Church at Ml
Savage. This gentleman is a delightful
speaker, and his sermon on "The spirit
uality of true worship, was listened too
with rapt attention. The finances were
managed by Her. Mr. Bishop, who at the
close of the morning sermon obtained sub
scriptions and cash to the amount of nearly
$230.
The house is a substantial frame build
ing, with carved doors. 1 he inside walls
are covered with paper of so neat a pattern
that many suppose the building to be fres
coed. The actual cost in cash is little over
$700, having been largely reduced by con
tributions of labor and material. There
is still a balance of $100 to Iw raised but
this will be speedily provided for. An in
teresting revival meeting is now in prog
ress.
A Friend.
Our tourists visit the old world, forget'

is as superior to theirs as our mountains
rise above the pigmy hills of the Khine.
Perhaps there are few localities so impres
sive in their character as is Meunt Lincoln,
covered w ith an eternal diadem ol snow,
and rising 14,700 feet above the level of the
sea. This is emphatically the dome of
our continent. At its elevated summit.
within a circle ol 10 feet, three great
streams have a common source. Ihe
Plattee and the Arkanses, together lo car
ry thcis waters to the Atlantic, whilst the
Colorado as if conscious of her powers
wends her solitary course for 1000 miles
to the Pacific, standing at this divsrging
point, the strange spectacle is presented of
clouds rolling beneath your leet, lit up by
the automatic flashes ot lightning and ac
companied by the loud thunders roar,
whilst alove is seen the sun shining out in
uiaenifice nt splendor. Descending a few
thousand feet, tbe limit of the growth ol
timber is indicated by its well defined
lines, this is aliout 12,000 feet alKive the
level ot the sea. Here the strawberry is
seen struggling into lite; a tew thousand
feet ol a lurther descent these are found
fully developed, when descending a9 many
more they are fully ripened and falling
from the stem. Beautiful flowers, in lull
bloom, reared there modest heads within a
few feet of the melting snow, in so close
proximity that with one hand (without
changing your position) you can make a
snow ball with one and with the oth
er pluck a flower. It was at the head wat
ers of the Colorado that Capt. Samuel
Adams organized his expedition of 12 men.
built his tour boats and descended in the
same, through cannons tiirec tnousand
feet in depth, 8 beautiful Parks or valleys
lrom ten to 65 miles in length, covered
ith the most nutritious grasses, traversed
by clear cool streams filled with the finest
bull, and surrounuea by inexnaiisiiuie
mines of precious metals. In his letters
written to Judges Agncw of the supreme
Court of this State, and others, the Captain
stated that it was his opinion that the great
fall of the Colorado would be found within
400 miles ot the main divide of the Hocky
mountains, and not in the exagerated can
nons of the same below. The correctness
of his statements were fully verified by his
descent of the river. Previous to this he
had demonstrated that steamers could as
cend the Colorado atoll teatont to Callville,
650 miles from its mouth, going far beyond,
where by Govermcnt reports it was official
ly said to be iinjiossible to ascend, demon
strating that tbere was a natural outlet to
a sea coast larger lhan all Europe, and pas
sing through mines ol gold, silver, copper
snd lead, richer apd mure accessible than
in any other portion of the United States.
Many ot these are now partially worked,
whilst the fabulous richness ot others is
evinced by the abandoned shafts and the
rude arrasta where thousands have mined,
and lived in the cities now reaching for
miles and presenting tbe imassive spec
tacle of a chain of unbroken ruins.
The report of Capt Adams to Secretary
Stanton, (under whose oiders be prosecu
ted his difficult and unsupported explora
tions) was published three times by Con
gress tiyhtetn months before Major Poitell
erer tate the Colorado. The Major de
scended the Green Itiver, lrom the Rail
road crossing, about six thousand one
hundred upd, twenty fret above the level ol
the sea, at a distance ot about 1200 miles
from the mouth of the Colorado, having

saying that sooner or later, a just decision
will be pronounced by a grateful and dis

and geographical position of the vast coun

and one half years explorations, can be
SAtisfactorally understood. That we have
known so little of this "Urea incognita"

been demonstrated by Capt. Adams, to
