CONSTITUTION A L CONVENTION.
At the same time and places, also, an elec
tion will be held for delegates to the conyen
tion to ameud the Constitution of the Slate, in
conformity with the Act, entitled "An Act to
provide for calling a eovention to amend the
Constitution," approved April 11, 1872. As
prescribed by said act, the following rules and
regulations shall apply to said election, and
the returns of the same :
Fint. At the general election to be held the
wcor.d Tuesday of October next, there shall be
elected by the qualified electors of this Com
monwealth, delegates to a convention to revise
ana amend the Constitution of this Mate : ttie
aid convention shall conhist of one hundred
nd thirty-three members, to be elected in the
manner following: Twent-eight members there
of ehall be elected in the State at large, as for
kwi; Each voter in the Stale shall vote for
not more than fourteen candidates, and the
lwenty-cjght highest in vote shall be declared
'ected; ninety-nine delegates shall be appoint
d to and eleeted from the different Senatorial
districts of the State, three delegates to be
!:ted for each Senator therefrom ; and in
choosing all district delegates, each voter shall
entitled to a vote for not more than two of
the members to be chosen from his district, and
the ihree condidates lushest in vote shall be
declared elected, except in the county of
Allegheny, forming the Twenty-third bena-
""lai Uistrict. where no voter shall vote lor
more than six candidates, and the nine highest
vote shall be elected, and in the counties of
""irne, Monroe and itce, forming tne inir

vote for more than four candidates, and the six

ixcond. The Judges and Inspectors fur each
ection distrtct shall provide two suitable
tox es for each poll, one in which to deposit the
uckeu voted for Delegates at large, and the
ther in which to deposit the tickets voted for
district Delegates ; which boxes ehall be label-
led respectively, "Delegate at large" and
District Delegates;" and in each district in
the city of Philadelphia an additional box
shall be provided for each poll, in which to
deposit the tickets voted for "City Delegates;"
and said last mentioned boxes must each te
labelled "City Delegates."
Third. The said election shall be held and
conducted by th proper election officers of the
eeveral election districts of the Commonwealth
and shall be governed and regulated in all re
spects by tho general election laws of the Com
monwealth, so far as the same Khali be applica
ble thereto, and not inconsistent with the
provisions of said act.
Fourth. The tickets to be voted for members
at large of the convention shall have on the
outside the words "Delegates at large," and on
the inside the names of the candidates to be
voted for, not exceeding fourteen in number.
Fifth. The tickets to be voted for district
members of the convention shall have on the
outside the words "District Delegates," and on
the inside the name or namesof the candidates
voted for, not exceeding the proper number
limited as aforesaid ; but any ticket which shall
contain a greater number "of names than the
number for which the voter shall be entitled
to vote, shall be rejected ; and in case of the
delegates to be chosen at large in Philadelphia,
the words, "City Delegates," shall be on the
outside of the ticket.
Sixth. In the city of Philadelphia the retnrn
judges shall meet at the State House, at ten

election, and make out the returns for said city,
of the votes cast therein for delegates at large
and city and district delegates, to be members
of the convention ; the return judges of the
several election districts within each county of
the State, excluding Philadelphia, shall meet
on Friday next following the election, at the
usual place for the meeting of the return judges
of their county, and make out full and accurate
returns for the county, of the votes cast therein
for members of the convention and for district
members of the same; and the proceedings of
the return judges of the said city of' Philadel
phia, and of the ne vera I counties of the Com
monwealth, in the making of their return, shall
be the same as those prescribed for return
judges in the case of an election for Governor,
except that ret urns transmitted to the Secretary
of the Commonwealth, shall be addressed to
that officer alone and not to the Speaker of the
Senate.
AMENDMENT TO THE CONSTITUTION.
Whereas, a joint resolution proposing amend
ment to the Constitution ot this Commonwealth
has been agreed to by a majority of the mem
bers elected to each House of the Legislature
at two successive sessions of the same, which is
as f nlows :
Joint Resolution proposing as Amemdmcnt to
the Constitution oi Pennsylvania:
Be it resolved, by the Senate and ITm-e of
Representatives of the Commonwealth of Penn&jl-
vani-3. in General Assembly met, That the follow
ing amendment to the Constitution of this
Commonwealth be proponed to the people for
their adoption or rejection, pursuant to the
provisions of the tenth article thereof, to wit:
AMENDMENT.
"Strike out the sixth section of the sixth
article of the Constitution, and insert in lieu
chcreof the following: 'A State Treasurer
nhall be chosen by the qualified electors of the
State, at such times and for such term of
service as shall be prescribed by law.' "
And, Whereas, John v. deary, uovernor
of the Commonwealth of Pennsylvania, in
obedience to the Act of Assembly approved
the 11th day of April, A. D. 1S72, for the pur
pose of ascertaining the sense of the people of
this Commonwealth in regard to the adoption
or rejection of said amendment, as provided in
the tenth article of the Constitution, has isued
tn me a writ of Election, given under his hand
and the great seal of the State, "Com mading
and requiring me to give notice in the usual
manner and as by law required, that an elec
tion will be held according to the terms of the
Constitution and the provisions of the -4ct of
the General Assembly aforesaid, for the pur
pose of deciding upon the approval and ratitic
ation or rejection of said amendment"; There
fore, I do hereby give notice, that at the same
time and places, also an election will be held
upon said amendment in conformity with the
act entitled "An Act proscribing the time and
manner of submitting to the people for their
approv! and ratification or rejection a propos
ed amendment to the Constitution, approved
April 11, A. D. 1S72.
As prescribed by said Act, the following
rules and regulations shall apply to said elec
tion, and the retuin.s of the rame :
First. Said election shall be opened, held
and cloKed, upon the day last aforesaid, at the
places and within the hours at and within
which the general elections of this Common
wealth are directed to be opened, held and
closed ; and it shall be the duty of the judges,
inspectors and clerks of each of said townships,
boroughs, wards, precincts and districts, to re
ceive at the said election tickets, either written
or printed, or partly written or partly printed,
from each of the qualified voters of thi3 State,
who may offer the same, and to deposit them
in a box or boxes to be, for the purpose, provid
ed by the proper officers ; which tickets shall
be labelled on the outside "Amendment to the
Constitution," and on the inside "For the
Amendment," or "'Against the AmendmeD."
Section II. That the election on the raid
proposed amendment shall, in all respect, be
conducted aa the general election of this Com
monwealth are cow conducted ; and it shall be
the duty of the return judges of the respective
counties and districts thereof, firet having care
fully ascertained the number of votes given for
or against such amendment, to make out
duplicate retnrns thereof, espressod in works
at length, and not in figures only ;one of which
returns, so made, ehall be lodged in the Por
thonotary's office of the Court of Common Pleas
of the proper county, and the other sealed and
directed to the Secretary cf the Commonwealth,
and by one of Eaid juefges deposited forthwith
in the most convenient post ollice, upon which
postage shall be paid at the expense of the
proper county.
IVoticc is Hereby ivcn,
That every person, excepting Justices of
the Peace, who shall hold an othce or ap
pointment of profit or trust under the United
States or of this State or any city or corpor
ated district, whether a commissioned officer
or otherwise, a subordinate officer, or agents
who is or shall be employed under the legis
lative, executive or judiciary department of
this State or the United States, or ot any
incorporated district; and also, that every
member of Congress, and of the State legis
lature and of the select or common council
of anacity, or commissioners or any incorpor
ated district is by law incapable of holding
or exercising at the same time, the appoint
ment of Judge, inspector, or clerk of any
election of this Commonwealth, and that no
Inspector, Judge or other officer of such elec
tion shall be eligible to be then voted for.
Also, that in tho fovrth section of the Act
of Assembly, entitled " An Act relation,' to
executions and for other purposes," approved
April 16, 1840, it is enacted that the afore
said 13th section, 4,6hall not be construed, to
prevent any military officer or borough offi
cer, from serving as Judge, Insdecior, or
Clerk, at any general or special election in
this Commonwealth."
And the said act of Asoembly, entitled "an
act relating to elections of this Common
weal th, passed July 2d, 1839, further provides
That the Inspectors and Judges 6hall meet
at the respective places appointed for hold
ing the election in the district to which they
respectively belong, before nine o'clock on
the niornin? of the secoj Tuesday of Oete-
ber, and each of said inspectors shall appoint
one clerk, who ehiU be a qualifies voter, or
such district.
Mn case the person who shall have re
ceived the second highest number of votps
tor inspector, shall not attend on the dcy of
any election men the person who shall have
received the eecond highest number of votes
for judge at the next preceding election shall
act as inspector in his place. And in case
the person who shall have received he high
est number of votes for inspector thall not
attend, the person elected judge shall ap
point an inspector in his place and in case
the person elected, as judge shall not attend,
then the inspector who received the highest
number ot votes shall appoint a judge in his
place; or if any vacancy shall continue in
the board lor the space of one hour after the
time fixed by law for the opening of the
election, the qualified voters of the town
ship, ward or district for which such officers
Bhnll have been elected, present at such
election, thall elect one of the number to
fill such vacancy.
"It Khali be the duty of eaid assessors re
spectively to attend at the places of holding
every general, special or township election
during the whole time said election is kept
open, lor the purpose of giving information
to the Inspectors and Judges, when called on
in relation to the right of any perou assess
ed by them to vote at such election, and
such other matters in relation to the assess
ments of votes as the said inspector or judg
es, or either of them, shall from time to time
require.
No person shall be permitted to vote at
any election as aforesaid, than a white free
man or the age of twenty-one years or more
who shall have resided in this State at least
one year, and in the election district where
he offers to vote at least ten days immediate
ly preceding such election, and within two
years paid a State or County Tax which
shall have been assessed at least ten days
before the election. But a citizen of the
United States who has previously been a
qualified voter of this State and removed
therefrom and returned and who shall have
resided in the election district and paid tax
es aforesaid, shall be entitled to vote after
residing in this State six months. Provided,
That the white freemen citizens of the Uni
ted States between the ages of twenty-one
and twenty-two years who had resided in
the election district ten days as aforesaid,
shall be entitled to vote, although they shall
not have pit id said taxes.
"No person thall be admitted to vote
whose name is not contained in the list of
taxable inhabitants furnished by the Com
missioners, unless first he produces a receipt
for payment within two years, of a State or
County tax assessed agreeably to the Consti
tution, and give satisfactory evidence either
on his own oath or the affirmation of another
that he has paid such tax, or on failure to
produce a receipt, sh'tli make oath to the
payment thereof; or, second if he claims a
right to vote by being an elector between
the ages of 21 and 22 years he shall depose
on oath or affirmation that he has resided in
the State at least one year next before his
application and make such proof of residence
in the district as is required by this act, and
that he does verily believe, from the accounts
given him, that he is of the age aforesaid,
and gives such other evidence as is required
by this act, whereupon the name of the per
son so admitted to vote shall be inserted in
the alphabetical list by the inspectors and a
note made opposite thereto, by writing the
word 'tax,' if he shall be admitted to his vote
by reason of such age, and in such case the
name shall be called to the clerks who shall
make the like notes in the list of voters kept
by them.
If any person shall prevent or attempt to
prevent any officer of any election under
this act from holding such election or use
or threaten any violence to any such officer
or shall interrupt or improperly interfere
with him in the execution of his duty, or
shall block up the window or avenue to any
window where the same may be holding, or
shall riotous'y disturb the peace at such
election, or shall use or practice any intimi
dating threats force or violence, with design
to influence unduly or overawe any eleoior
or to prevent him from voting or restrain the
freedom of choice, such persons, on convic
tion shall be fined in any sum not less than
live hundred dollars and be imprisoned for
any time not less than three nor more than
twelve months, and if it 6hall be shown to
the Court where the trial of such offence
shall be had that the person so offending was
not a resident of the city, ward, district or
township where the said offence was com
mitted and not entitled to vote therein, then
on conviction he slinll be sentenced to pay a
fine of not less than one hundred or more
than on thousand dollars, and be imprisoned
not less than six months, nor more than two
years.
If any person shall makeany bet or wager
upon the result of any election in this Com
monwealth, or ehall offer to make any such
bet or wager, either hy verbal proclamation
thereof, or by any written or printed adver
tisement, or challenge or invite any persons
to make such bet or wager, upon conviction
hereof, he or they shall forfeit and pay three
times the amount so bet or to be bet.
If any person not by law qualified shall
fraudulently voto at unv election in this
commonwealth, or being otherwise qualified,
shall vote out of his proper district, or if any
tpersou knowing tho want of tuch qualifica
tion, shall aid or procure such person to vote,
the person offending shall on conviction, be
fined in any eum not exceeding two hundred
dollars, and be imprisoned for any term not
exceeding three months.
" In all cases where the name of a person
claiming lo vote is found on the list furnish
ed by the Commissioners and Assessors, or his
right to vote whether thereon or not is ob
jected to by any qualified citizen it shall be
the duty of the inspector to examine such
person on oath as to his qualifications, and if
he claims to have resided witnin ire district
for one year or more his oath shaJJ be sufh
cient proof thereof, but he shall make proofat
east hv one competent witness who shall bo
a qualified elector that he has resided within
the district for more than ten days next pre
ceding 6uch election and shall also himself

swear, that his bona nde residence in pur
suance of his lawful calling is within the
district, and that ho did not remove In said
district for the purpose cf voting therein.
Every person qualified as aforesaid, and
who shall make due proof, if required of his
residence and payment oi taxes aforesaid,
shall be admitted to vote in the township,
ward or district in which he shall reside.
If any person shall vote at more than one
election district or otherwise fraudulently
vote more than once on the ame day, or
shall fraudulently fold and deliver to the in
spector two tickets together with the intent
illegally to vote or advise and procure an
other so to do. he or they so offending shall
on conviction, be fined in any sum not less
than fifty nor more than five hundred dol
lars, and be imprisoned for any term uot less
than three nor more than twelve months.
If any person not qualified to vote in this

sons of qualified citizens), Ehall appear at any
place of election for tne purpose oi ns-na
tickets or influencing the citizens qualified
to vote, he shall on conviction forfeit and pay
any eum not exceeding one hundred dollars,
for every such offence, and be imprisoned for
any term not exceeding three months.
Pursuant to the provision contained in the
6lh section of the act aforesaid, the Judges
of the aforesaid district shall take charge of
the certificate or return of the election ot
their respective districts and produce them at
a meeting of the judges from each district at
the Court House in the Borough of Strouds
bur, on the third day after the day of elec
tion, being for the present year on FRIDA Y
the 11th day of OCTOBER next, then and
there to do, and perform the duties required
by law of said judges. Also, that where a
judge by sickness or unavoidable circumstan
ces, is unable to attend said meeting of Judges
then the certificate or return as aforesaid
ehall be taken charge of by one of the ln
rtictors or clerks or the election of said dis
spect, who (dull do and perform the duties
required of said judge unable to attend.
.ACT, April 17, I860.
Section 3. After the as-c6sment9 have
been completed on the tenth day preceding
the second Tuesday in October of each year,
the assessor shall, on the Monday immediate
ly following, make a return to the county
Commissioners of the names of all persons
assessed by him aince the return required
lo be uiade by him by the second section of
this act, noting opposite each name the ob
servations and explanations required to be
noted as aforesaid; aud the county Commis
sioners shall thereupon cause the same to be
added to the return required by the second
section of this act, and a full and oorrcct
copy thereof to be made, containing the
names of all persons so returned as resident
taxables in eaid ward, borough, township or
precinct, and furnish the same together with
the necessary election blanks, to the officers
of the election in said ward, borough, town
ship or precinct, on or before tix o'clock in
the morning of the eecond Tuesday of Oc
tober: and no man ehall be permitted to vote
at the election on that day whose name is
not on the list, unless he shtll make proof
ol his right to vote, as hereinafter required.
Section 4. On the day of election any
person whose name is not on the list, and
claiming the right to vote at said election,
shall produce at least one qualified voter of
the district es a witness lo the residence of
the claimant in the district in which he
claims to be a voter, for the period of at least
ten d.ys next preceding said election, which
witness shall take and subscribe a written,
or partly written and parti v printed, affidavit
lo the fucts stated by him. which affidavit
shall defino clearly where the residence is
of the person so claimining to be a voter . and
the person so claiming the right to vote shall
also take and subscribe a written, or partly
written and partly printed affidavit, stating,
to the best of his knowledge and belief,
where and when he was born; that he is a
citizen of the commonwealth of Pennsylva
nia and of the United States: that he has re
sided in the commonwealth one year, or if
formerly a citizen therein and has moved
therefrom, that he has resided therein six
months next preceding said election ; that he
has not moved into the district for the pur
pose of voting therein ; that he has paid
state or county tax within two years, winch
was assessed at leust ten days before said
election; and, if a naturalized citizen, dial
also state when, where and by what court
he was naturalized, and shall also produce
his certificate of naturalization, for examin
ation ; the said affidavit shall also state when
and where the tax claimed to be paid by the
affiant was a.snessed, and when, where and
to whom paid ; and the tax receipt therefor
shall be produced for examination, unless the
affiant shall state in his affidavit that it has
been lost or deetyed, or that he never re
cei ved any : but if the person so claiming
the right to vote shall take and subscribe an
affidavit, that he is a native born citizen o
the United States, for if born elsewhere
shall state that fact in his affidavit, and sha!
produce evidence that he has been natural
ized, or that he is entitled to citizenship by
reason of his father's naturalization ;) and
shall further Ftale in his affidavit tint he is
at the lime of taking the affidavit, between
the ages of twenty-one and twenty-two years
that he has resided in the state one year and
in the election district ten clays next prece
ditur such election, he shall be entitled to
vote, although he shall not have paid taxes
the said affidavits of all persons making sue!
claims, and the affidavits of the witnesses to
their residence, shall be preserved by ihe
election board, and at the close of the elec
tion they shall be enclosed with the list of
voters, tally list and other papers require
by law to be tiled by the return judge with
the nrothonotarv. and shall remain on file
therewith in the prothonotory's office, sub
ject to examination, as other election papers
are; if the election officers shall find that
the applicant or applicants possens all ihe
legal qualifications of voters, he or they shaP
be permitted to vote, and the name or names
shall be added Jo the list ot taxablca by I lie
election officers, the word ''tax" being added
where the claimant claims to vote on lax
and the word "age" where he claims to vote
on age; the same words being added by the
clerks in each case respectively, on the list
of persona voting at such election.
Section o. It fchall be lawful lor anv
qualified citizen of the district, notwithstand
ing the name of the proposed voter is con
tamed on the list of resident taxables, to
challenge the vote of euch person ; where
upon thu same proof of the right of suffrage
as is now required by law shall be publicly
made and acted on by the election board, and
the vote admitted or rejected, according to
the evidence ; every person claiming to be a
naturalized citizen shall be required to pro
duce his naturalisation certificate at the elec
tion before voting, except where he has been
for ten years, consecutively, a voter in the
district in which ho otlers his vote; and on
the vote of such person being received, i
shall be the duty of the election officers to
write or stamp on such certificate the word
'voted," with the month and year; and i
any election officer or officers shall rcceivea
second vole on the same day, uy virtue oi
the same certificate, excepting where son
are entitled lo vote by virtue of the natural
ization of their fathers, they and the person
who shall ofi'er such second vote, upon so ot
fcndiii" shall be guilty of a high misdemean
or, and on conviction thereof, be fined or
imprisoned, or both, at the discretion of the
court; but tho fine 6lia!l not exceed one hun
dred dollars in each case, nor the imprison
meut one vear ; iho like punishment shal
he inflicted on conviction, on the officers of
election who shall neglect or refuse to make
qr cause to be made, the indorsement requir
ed as aforesaid on ejid naturalization certi
ficate.
See. 6. If any election ofiicer6hall refuse
or neglect to require such proof of the right
of sufferage as is prescribed by this law, or
the laws to which this is a supplement, from
any person offering to vote whose name i
not on tha'Iist of assessed voters, or whose
right to vote is challenged by any qualifie
voter present, and shall admit such person
to vote without requiring such proof, every
person so offending, shall upon conviction,
be sentenced, for every such offence, to pay
a fine not exceeding one hundred dollars, or
to undergo an imprisonment not more than
one year, or either or hotu, at me uiscreuon
of the court.
Sec. 7. Ten days preceding every elec
tion for electors of President and Vice Presi
dent of the United States, it shall be the
duty of the Assessor to attend at the place
fixed by law for holding the election in each
election district, and then and there hear all
applications of persons whose names have
been omitted from the list of assessed voters
nd who claim the right to vote or whose
ight have originated since the same was
made out, and shall add the names ot such
persons thereto as shall show that they are
ntilled lo the right or suffrage in such dis
trict, on the personal application of the
climant only, and forthwith assess them with
the tax. After completing ihe list, a copy
thereof shall be placed on the door of or on
the house where the election is to be held.
at least eight days belbr the election; and
at the election the same course shall be pur-
ued, in all respects, as is required by this
ct, and the acts to which it is a supplement
at the general elections in October. The
Assessor shall also make the same returns to
the county commissioners of all assessments
made by virtue of this section; and the coun
ty commissioner shall furnish copies thereof
to the election officers in each district, in like
manner, in all respects, as is required at the
general electiou in October.
Sec. c. I he same rules and regulations
shall apply at every speciul election, and
t every seperate city, borough or ward elec-
ion, in all respects its at the general elections
n October.
Sec. 0. The respective assessors, inspec
tors and judges of the elections shall each
lave the power to administer, oaths to an'
persons claiming the right to be assessed or
the right of suffrage, or in regard to any oth
er matter or thing required to be done or in
quired into by unv of said officers under this
act; and any willful false swearing by any
person in relation to any matter or thing
concerning which they shall be lawfully in
terrogatcd by any of baid officers shall be
punished as perjury.
Sec. 10. The assessors shall each receive
the same compensation for the time neces
sarily spent in performing the duties hereby
enjoined as is provided by law lor the per
formance ot their other duties, lo be paid
by the couny commissioners as in other caees;
nd it shall not be lawful for any assessor
to assess a tax against any person whatever
within ten days next preceding tloe election
to be held on the second Tuesday of Octo
ber, in any year, or within ten days next be
fore any election tor electors ot President
and Vice President of the United States ;
any violation of this provision shall be a mis
demeanor, and subject the officers so offend
ing to a fine, on conviction, not exceeding
onU hundred dollars, or to imprisonment not
exceeding three months, or both at the dis
cretion of the court.
Sec. 11. On the petition of five or more
citizens of the county, stating under oath
that they verily believe that frauds will be
practiced at the election about to be held in
any district, it shall be the duty of the court
of common pleas of said county, if in session
or if rrot a judge thereot in vacation, to ap
point two judicious, sober and intelligent cit
izens of the county to act as overseers at said
election; said overseers shall be selected from
different political parlies, where the inppec
tors belong to different parties, and where
both of said inspectors belong to the same
political party, both of the overseers shall
be taken from the opposite political party
said overseers shall have the right to be pre
sent with the officers of the election, during
the whole time ihe same is held, the votes
counted and the returns made out and sign
ed by the election officers; to keep a list of
voters, if they see proper; to challenge any
person offering to vote, interrogate him and
his witness under oath, in regard lo his right
of suffrage at said election, and to examine
his papers produced ; ami the onicers of said
election are required to afford to said over
seers so selected and appointed every con
venience and facility for the discharge of
their duties ; and if said election otl;cers shal
refuse to permit said overseers be present
and pcrlorm their duties as aforesaid, or if
they shal! be driven away from the polls by
violence or intimidation, all the votes polled
at such election district may be rejected by
any tribunal trying a contest under said elec
tion : Provided, That no person signing the
petition shall be appointed an overseer.
Sec. 12. If any prothonotary, clerk, or the
deputy of either, or any other person, shal
affix the seal of office to any naturalization
paper, or permit tho same to be affixed, or
give out, or cause or permit the same to be
given out, in blank, whereby it may be
fraudlently used, or furnish a naturalization
certificate, to any person who shall not have
been duly examined and sworn in open court,
in the presence of some of the judges there
of, according to the act of Congress, or shall
aid in, connive at, or in any way permit the
issue of any fraudulent naturalization certi
ficate, ho shall be guilty of a high
misdemeanor ; or if any one shall fraudulently
use any such certificate of naturalization,
knowing that it was fraudulently issued, or
shall vote, or attempt to vote thereon, ifany
one shall vote, or attempt to vote, on any
certificate ot naturalization not issued to him,
he shall be guilty of a high misdemeanor;
and either or any of the persons, their aiders
of abettors, guilly of either of the misdemea
nors aforesaid, shall, on conviction, be fined
in a sum not exceeding one thousand dollars,
and imprisoned in the proper penitentiary
for a period not exceeding three years.
Sec. 13. Any person who on oath or
affirmation, in or before any court in this
State, or officer authorized to administer
oatiis, shall, to procure a certificate of
naturalization, tor himself or any other per
son, wilfully depose, dcclore or affirm any
matter to be fact, knowing the same to be
false, or shall in like manner deny any mat
ter to be fact, knowing the same to be true,
shall bo deemed guilly of perjury ; and any
certificate of naturalization issued in pursur
ance of any such deposition, delaration or
affirmation, shall be null and void; and it
shall be the duty of the court issuing the
same, upon proof being made before is that
it was fraudlently obtanined, to take im
mediate measures for re-calling the same for
cancelation ; and any person who shall vote,
cr attempt lo vote, on nny paper so obtained
or who shall in any way aid in, connive at,
or have any agency whatever hi the issue,
circulation or use of any fruudleut naturaliza
tion cerificate, shall be deemed guilty of a
misdemeanor, and, upon conviction thereof,
ehall undergo an imprisonment in the
penitentiary for not more than rwo years,
and pay a tine, not more than one thousand
dollars, for eveytuch offence, or both, at the
discretion of the court.
Sec. 1 1. Any assessor, election officer or
or person appointed as an overseer, who shall
negUct or refuse to perform any duty en
joined by this act, without reasonable or
legal cause, shaM be rubject to a penalty of
one hundred qo'Ure, and ii an aEseesor shall
assess any person as a voter who is not qualifi
ed ; or thall refuse to assess any one who ia '
qualified, he shall be gailty of a misdemeanor
in office, and on conviction be punished by
fine or imprisonment, and also be subject to
an action for damages by the party aggriev
ed ; and if any pernon shall fraudulently
alter, add to, deface or destroy any list of
voters made out as directed by this act, or
tear down or remove the same from the placo
where it has been fixed, with fraudulent or
mischievous intent, or for any improper pur
pose, the person so offending shall be guilty
ot a I112I1 misdemaanor, and on conviction
shall be punished by a fine not exceeding
five hundred dollars, or imprisonment not
exceeding two years, or both, at tho discre
tion of the court.
Sec. 16. At all elections herafler held un
der the laws of this commonwealth, the polls
shall be opened between the hours of six and
seven o'clock, a. m., and closed at seven
o'clock, p. m.
Sec. J 7. It shall be the duty of the Secre
tary of the Commonwealth to prepare forms
for all the blanks mde necessary by this act.
and furnish copies of the same to the county
commissioners of the several counties of tho
commonwealth; and the county commis
sioners of each county shall, as soon as may
be necessary after receipt of tho sarot at the
proper expense of the county, procure and
furnish to all theelcetieo officers of the elec
tion diiticts of the respective oouaties copies
of such blanks in such quantities & may be
rendered necessary for the discharge of their
duties under this act.
Sec. 19. That citizens of this State
temporally in the service ot the State or of
the United States governmcnte.ou clerical or
other duty, and who do not vote where thus
employed, thall not be thereby deprived of
the right to vote in their several election dis
tricts if otherwise duly qualified.
Sec. 20. The act, entitled "A further
supplement to the act regulating to the elec
tions of this commonwealth," approved April
fourth. Anno Domini one thousand eight
hundred and sixty-eight, and all other laws
altered or supplied by this act, be and the
same are hereby repealed.
And the Judges of Ihe respective Districts
aforesaid, are by the said act required to
meet at the Court House in the Borough of
Stroudsburg. cm the third day afther the
said day of election, being FRIDAY, the
ELEVENTH day of OCTOBER, then and
there to perform the things required of them
by law.

Be it resolved by the Senate and JIovm of
Representatives of the Commonwealth of Pennsyl
vania in General Assembly met, That the follow
ing amendment of the Conhtitnlion of this
Commonwealth be proponed to the peoplo for
their adoption or rejection, pursuant to the
provisions of the tenth article thereof, to wit ;
