Section 1. lie it enacted by the Senate and House if Representatives of the Com monwealth of Pennsylvania in (ieneral As sembly met, and it is hereby enacted by the authority of the same, That the qualified voters of the several counties of this Com monwealth, at all general, township, borough and special elections, arc hereby, hereafter, authorized and required ta vote, by tickets, printed, or written, or partly printed and partly written, severally classified asfol'ows: One ticket shall embrace the names of all judges of courts voted lur, and to be labelled, outside, "judiciary;" one ticket shall em brace the names of all state officers voted for, and bo labelled, "state;" one ticket shall embrace the names of all county officers vo ted for, including office of senator, member, and members of assembly, if voted for, and members of congress, if voted for, and be la belled, "county;" one ticket shall embrace the names of till township officers voted "for, and be labelled, 'township;' one ticket shall 'embrace the names of all borou "di offi cers voted for, and bo labelled, borough ;" and each class shall be deposited in separate ballot-boxes. m JAMES R. Whereas, By the act of the Congress of tho United States, entitled "An Act to a mend the several acts heretofore passed, and for other purposes," and approved March thirJ, one thousand eight hundred and sixty Sive, all persons who have deserted the mili tary or naval service of the United States, and who have not been discharged, or reliev ed from the penalty, or disability therein pro vided, are deemed, aud taken. M havevolun tarily relinquished, and forfeited, their rights of citizenship, and their rights to become citi zens, and are deprived of exercisins any rights of citizens thereof : And whereas. Persons, not citizens of the United States, arc not, unJer the constitu tion and laws of Pennsylvania, qualified elec tors of the commonwealth : Section 1. lie it enacted by the Senate and House of Representatives of the Com monwealth of Pennsylvania in (ieneral As sembly met, and it is hereby enacted by au thority of the same, 1 fiat in all elections hcreatter to be held m tins commonwealth, it shall be unlawful for the judge or inspec tors of any such election to receive any bal lot, or ballots, from any person, or persons, embraced in the provisions, and subject to he disability, imposed by said act of Con gress, approved March third, one thousand eight hundred smd sixty-five, and it shall be unlawful for any euch person to vote any ballot, or ballots. Section 2. That if any such judge or in spectors of election, or any one of them shall receive, or consent to receive, any such un lawful ballot, or ballots, from any such dis qualified person, he, or they, so eflending, shall be guilty of a misdemeanor, and, upon conviction thereof, in any court of quarter sessions of this commonwealth, he shall, for each offence, be tentenceJ to pay a fine of not less than one hundred dollars, and to un dergo an imprisonment, in the jtil of the proper county, for not less than sixty days. Section li. That if any person deprived of citizenship, and disqualified as aforesaid, shall, at any elec:ian, hereafter to be he'd in this commonwealth, vote, or tender to tne officers thereof, and offer To vote, a bal'ot, or ballots, any person, so efTending, shall be guilty of a misdemeanor, and on conviction thereof in any court of quarter sessions of this commonwealth, shall, for each' offence, be punished in like manner as is provided in tho preceding section of this act, in the case of officers of election receiving such unlaw ful ballot, or ballots. Section 4. That if any person shall here after persuade, or advie, any person, or per sons, deprived of citizenship, and disqualified as aforesaid, to ofTer any billot, or ballots, to the officers of any e'cciion, hereafter to bo held in this commonwealth, or shall persuade, or advise, a: y such officer to receive any bal lot, or ballots, from any person deprived of citizenship, and disqualified as aforc.-aid, such person, to ofi: tiding, shull be guiliy of a misdemeanor, and upon co:ivic:io:i thereof, in anv court o! cuarler sessions of this com- mon wealth, siiiuue punished in has man ner as is provided in tin second section of this act, in the c .se o! officers of such elec tion receiving such unlawful taiiot, or Lai lots. Section 8. That it sua!! be the duty of the sheriffs, in the several com. ties of this com monwealth, to insert in their proclamations of elections, he rr after tj Le held, the first four sections of this act, with the preamble thereof, and uyon conviction of any violation of the requirement of this sect ion, any sher iff shall be guilty of a -misdemeanor iu office, and be punished iu like manner as the of fences prohibited by the second, third and fourth sections of this act are punishable. The law regulating the election of Presi dential electors, provides as follows: IVoSEcc s ESt'rcSay ;iveij, That every person, excepting Justices of the Peace, who shull hold an office or ap jxjintment of profit or trust under the United States or of this State or an) city or corpo rated district, whether a commissioned officer or otherwise, a subordinate officer, or agents who is or shall be employed under the legis lative, executive or judiciary department of this State or the United States, or of ai.y incorporatetl dittrict ; and el so, that every mer.iber of Congress, and of the state legis lature and of the select or common council cf any city, or commissioner of any incorpo rated district is by law incapable of holding or exorcising at tho same time, the appoint ment of Judge, inspector, or clerk of any c lection of this commonwealth, and that no inspector, Judge or other officer of such elec tion siull be eligible to be then voted for. And the. said act of Assembly, entitled "an act relating to elections of this common wealth, passed J uly 2d. 139, further provides That the Inspectors and Judges shall meet at the respective places appointed for hold ing the election in the district to which they respectively belong, before nine o'clock in the morning of the second Tuesday of Oc tober, and each of said inspectors shall ap point one clerk, who shr.ll be a qualified vo ter 4lIt shall be the duty of said asessors re spectively to attend at the places of holding every general, special or towsaip election during the whole time said election is kept open, for the purpose of giving information to the inspectors and judges, when called on in relation to the right of anv person assess ed by them to vote at such election, and such other matters in relation to the assess ments of votes as the said inspectors or judg es, or either of them, shall from time to time require. Agreeably to the provisions of the sixty first section of said act every General and Special election shall be opened between the hours of eight and ten in the forenoon, and shall continue without interruption or adjournment until seven in the evening, when the polls shall be closed. "No person shall be admitted to vote whose name is not contained in the list of taxable inhabitants furnished by the Com missioners, unless first he produce a receipt for payment within two years, of a State ot county tax assessed agreeably to the Consti tution, and give satisfactory evidence either on his own oath or the affirmation of another that he has paid such tax, or on failure to produce a receipt, thall .make oath to the payment thereof; or, second if he claims a right to vote by being an elector between the ages of 21 and 22 years he shall depose on oath or affirmation that he has resided in the State at least one year next before hU application and make such proof of residence iu the district as is required by this act, ami that he does verily believe, from the accounts given him, that he is of the age aforesaid, and give such other evidence as is required by this act, whereupon the name of the per son so admitted to vote shall be inserted in the alphabetical list by the inspectors and a note made opposite thereto, by writing the word 4tax, lie shall be admitted to vote by reason of having paid tax, or the word 'age,' if he shall be admitted to vote by reason cf such age ; shall bo called out to the clerks, who shall make the like notes in the list of voters kept by them. "In all cases where the name of person claiming to vote is found on the list furnish ed by the Commissioners and Assessors, or his right to vote whether thereon or not is ob jected to by any qualified citizen it shall be the duty of the inspector to examine such person on oath as to his qualifications, and if he claims to have resided within the dis trict for one year or more his oath shall be sufficient proof thereof, but shall make proof at least by one competent witness who shall be a qualified elector that he has resided with in the district for more thau ton days next preceding such election and shall also hiiu- r
