had been empannelled. _

The case was opened on the part of the

on the night of the murder, at a saloon on
Third avenue and found the man dead. lie
described the wounds on the body of the de
ceased and said that the man had been dead
but a few minutes, when he arrived: the body

mitted from an Injury over the right eye,
which aptienred to have been produced by
a dull or blunt Instrument.

concussion from the blows which produced
the wounds., He thought the wounds had been
produced by some heavy instrument having
considerable length, something liken poker or

George Beek. sworn—This witness testified
to haring been in the saloon on the night of
the murder.) Collins left the saloon about half
past nine o'clock. About half an hour after
wards witness heard a retooling noise an if
some one was falling down stain. McCarron.
the proprietor of the saloon, went out and
brought Collins Id, and he died a few minutes
uftertrard.
Mrs. 3loroont MTornil, sworn—Mc husband
kept the saloon when this affair occuired: Pat
rick Collins was my brother-in-law; saw him
when he came to the saloon that night; while
she was In .her room up stairs she heard a
scuffle at Atm head of the stairs outside of her

Nicholson and Kerr. came through her room
and passed down the back stairway to the sa
loon below; shortly afterward she and Carrie
Jones went to the head of the stairs and look
ed down and saw at the bottoMthe form of a
Joan lying.
Bridprt (Manna, sworn—Was at the boase
on Third street the night of the murder. De
ceased was witness' brother-in-law. lier
testimony was In substance as to material
facts the same as that of the preceding wit
ness.
tlfflerr George Garrison, sworn—Witness Is
a member of the police forcl. He testified
to arresting Nicholson, but nothing further
of any Importance was elicited.
"Curly" limp was called and testified to
what occurred In the house. Witness was in
Carrie Jones , room when Nicholson came in;
after taking a smote of drinks together,
Nicholson shored him out of the door. Into .
the bark room; a few moments afterward he
heard a noise at the head of the stairs; Kerr
and Nicholson then came out of the front.

testimony did not elicit anything new.
Lbuic Edwards. sworn—Was going to Carrie
Jones' room to stay all night., between ten
and eleten o'clock: was lust going up the
steps when I beard a noise at the head of the
stairs: went up toward market street and re
turned and saw a Min lying at the foot of the
stairs.
Carrie Jones, sworn—Before the witness
was examined Mr. Marshall, her counsel.
asked the Court to Instruct her that she was
not bound to tell anything that would Impli
cate her In the affair. The Court rase the de
sired instruction. The witness then testified
ns follows:

Kerr came to toy boom that evening: Hays
came arid; after the others came they or
dered me to bring up drinks: I bronght up
wine 'for the party; afterwards Nicholson
honed Hays out of the room; shoved him
against the door, and then went out, going
down the back war I then got a light and
looked down stain and saw a man lying at
the foot of the stairs; came back and called
Maggie Carroll to come and seethe man.
Donlel tierrodartned—The witness was in
stracted by the Court that he would not be
reqUiredto answer any questions tending to
criminate himself. The witness testified as
follows: Live on Fleet avenne; was atildic-
Carroll's saloon on the night of this occur
renee; we then went t he npi and took
drink or two; Johnny pushed Hays out
of the room, shut the door and commenced
abusing Carrie Jones. He shoved her on the
bed and was abusing n I heard a
noise on the stairs, as if some one falling down
fit nits. I then got up and started to go down
stairs the way I came np, when Nicholson
spoke up and said see would go down the
back stairs and get a drink in the bar room.
The Commonwealth here rest their case.
Air. Marshall asked the Commonwealth to
state trl the jury that they would not ask a
verdict of guilty.
The District Attorney stated that he would
not ask for a conviction on the testimony. •
The case was submitted without argument
oat the court charged the jury that there
vas no evidence to warrant a conviction of

o verdict of not guilty and the prisoner, one

for injuries allayed to have been sustained in

gence of the agents of the company. Plaintiff
Is a resident of W ashington county. nod for a
number of years past has been engaged as
stock dealer and farmer. On or about No
vember 17th.18613, plaintiff took on a train on
defendant's railway from Durgettstown to
Pittsburgh, having a car toed of hogs In the
toils. 'Near Temperancesille the train won
run Into by a following train unit the caboose
car, In which plaintiff anti several others were
riding, was considerably damaged. anti plain
tiff had one leg broken at the ankle, and watt
severely welded by escaping steam from the
locomotive which run into the caboose. He

company to .persons shipping stock fore of
charge, as it Is a rule of the company that
shippers must accompany their stock or send
ome one to look after them. Plaintiff's In
juries, His alleged, prevented him from at
tending to his ordinary business in conse
uence of the injuries received since the acci
dent. Messrs. Gibson, Weir and Acheson
appear for the plaintiff and Messrs. Hampton
and Dairen for the defense.

The great oil fire of Tnesdar still excites
attention, and is the t nettle of genernl discus
sion. Such a calamity. to terrible In Its pro

the fire was visited by hundreds of people,

The alarm yesterday morning about two •
o'clock was occasioned by the bursting of a
benzine tank at the Citizens' works, the end
of the lite, which exploded with a loud noise..
The flames from IF set fire to the agitating
house. which, together with its contents, five
. hundred barrels of oil, was burned. The ben
zine in the tank continued to blare all day,
and last evening at six o'clock was still entit
ling flame anti smoke, bat no danger from it
won apprehended. The lire in all the other,
works raged Until yesterday morning, when,
they slowly died out for want of fuel.
So tar as Is known no death save the latnent-
able case of Mr. Foster, marked the cond.,
gratinn. The three persons injured by Jump
ing out of the Eclipse barrel house are doing
well. and It is thought will be about again in
short tittle. The employes Ma tar as known
. have all reported unhurt, with the exceptions
named.
Woirkmen were engaged all Tuesday night
nail yesterday repairing the Allegheny t al-,
Icy Railroad track. In the evening shortly.
before nix o'clock their work was finished.
and after being put to the test, trains begun
to ran over the road regularly again.
Tile managers of the Citizen's Refinery
Peet to have their works in running order
again In about n week_or ten days.
The work of clearing away the rubbish at
the National commenced in the afternoon,
PreliartitorY, it was understood, to rebuilding
inintedintely. The other refineries Della mud
Dr. Tweddle's, were a heap of smoking ruins,l
and could nut. be worked at for the heat. IT

The owners of the bridge have as yet taken
no definite action, although they say the
bridge will be replaced as last as workmen
can do it..

Forsythe's and Dilworth's refineries were
running yesterday as usual. The fire at these
only burned a Wilt in each and did not interi
tern with the works.

companies state that their loss will not ex

the circumstances attending the death of Mr.
Henry B. Foster; who lost his life at the
Eclipse 011 Refin . EV. re-assembled at Deputy
Mayor Nichols °dice.' Butler street. Law
renceville, where the following testimony
was taken.
John Morland, sworn —At about three
..,,clock the fire originated; I won some five
hundred feet from the tank of the Eclipse re- '
finery when it wan struck. next went to Dr.
Tweddle'a house to look after the family; saw
the whole piece in flames. oil flowing over the •
ground abont three feet deep; there were two
flashes of lightning; the Citizens' and eclipse
refineries were struck at the same thne, the
oil flowed intwo . current., one towards Dr.
Tweddle's residence iced. the other towards
the office and bridge; had not seen Mr. Foster
yesterday; believe that to be Mr. Foster from
what I since heard. The shock was distinct
ly felt by nil parties nn the ground. • I helped
to carry the remains of the deceased out of
the front office;:when we found him his bead
was lying towards the door; Ind apparently
been trying to get not when he was overtaken
by the names.
The tank of the F.clipse, when struck by
lightning, was Cut from top to bottom. unit
the burning oil poured out a perfect sea of
fire down the street toward the bridge.
