of the defendant. They all tweed that his
reputation up until the commencement of this
suit had beetinnexceptlonable.
Bernard Burns had known defendant for
over twenty years; wan on Intimate term*
with his father's family. and had never heard
his character as a law abiditur citizen called
in question until the commencement of this
prosecution.
John Mellon. Exp., was also acetiainted with
defendant; have known him for a number of
yearn and never heard his character called in
question.

District Attorney Pearson opened the argu
ment on behalf of the Commonwealth. Alter.
reciting the act under which the Indictment
was drawn and rending the indictment to the
jury, he called the attention of the jury to the
dculties under which the Commonwealth
labored to make out a case. The witnesses
who knew anything about the facts' in the
case were all gamblers and consequently , ur
lime witnesses. en commented ht
ength upon the testimony. after which he
closed by asking the jury Li they were satis
fied that the Commonwealth had made out a

monwealth vs. Barbara Broody against whom
there Were three indictment for selling liquor
on Sunday, and without license. The bills
were found at the June term, Ilid&siace which
time the prosecutor has failed to appear. The
Jury were directed to return a verdict of not
guilty. and find who should pay the caste.

Louis Kauffman. sworn—l Was in the car
riage which deceased eras driving. We cross
ed the Mechanics street bridge to Pittsburgh.
Just as we got out of the bridge I beard a

I lumped out-of the carriage and found the
torses down. and saw the deceased lying back'
the ant of the carriage, with his arms ele
vated above his head. He was gasping at the
time. We got him off, but be died in a few
minutes afterwards.
Edwin Lewis, sworn —I was coming down
Sixteenth street, factor the bridge, and burgle
distely saw a hash of lightning which struck
down the horses, and the deceased fell

A purchase of one thousand acres of vales
ble coal laud on the South side of the Youghi
ogheny river, a short distance from West
Newton, was made within a few day. by Col.
H. P. Olieru and Joseph H. Maddox. Esq.,
men knoWn for their extensive Mining opera
clans In the Cumberland coal district. These
gentlemen contemplate opening several coal
mines on these lands and connecting theta
with the Pittsburgh and Connellsville Hallway
by a bridge over the river about one mile
West of West Newton. The coal depositlis
unsurpassed by any in the whole country fur
gas and coke purpose.. 'e project of these
enterprising Baltimorean i s au earnest that
that city Is waking up to the great Importance
of the mineral district with which the Con
nellsville road is so soon to bring her into di
rect communication. With the great advan
tage of greater proximity than any other tide
water city and-by easier grades, we doubt
whether the most sanguine friends of the
Pittsburgh and Connellsville Hallway so long
wished and waited for, have any adequate
pre-conception of the vastness of the trartic It
Is destined to enjoy, or of the wealth to be
developed by the facilities for tninsportatiotr
shortly to be provided. Wealth that but fur
these facilities might remain dormant for
ages.
