contract with a farmer to transport 800
tons of wheat from Paradise City to

The defendant proved that there were
more grain at Paradise than steamers
could carry away that the plaintiff
could get all the freight he could carry

the boat to run, and that for part of the
season the plaintiff had freight at 12,10
per ton from points below Paradise. The
Supreme Court held that the plaintiff
can recover only the actual pecuniary
toes which he suffered under the con-
tract, and if he could get as much or
more from others. It follows that he
suffered no damage. In such case the
carrier is riot authorised by law to re.
