to layout and construct *railway, anti for that pirr
pose to enter upon and occupy the following streets
—viz: Starting at the center of Sandusky etre. t. on
the South side of Ohio street; thence , along Sandus
ky-street to• Lasock street,• thence along Laeock
street to Anderson street; thence along Anderson
street to the Allegheny bridge, (known as Hand
street - bridge); the same to oe constructed with
double trick and to traverse said streets with their
horses and cars, subject to the regulations and re
strictions hereinafter mentioned and described.

time to time by ordinance, to establish such . regu
lations. In regard to said rallwny, as may be re
qiilred for the paving, repeving, kt ailing or culvert

cent. epos all dividends declared: and thereafter
the sum of forty dollars per ear and nye per
coat. of the dividends declared. _The payments
or the sum assesied 'upon each ear to be - made
one month after the beginning of the first period of
Ave years, and at the same date annually thereafter,
and the said ears shall be numbered underthe or
dinances of said city regulating licenses of. said
vehicles. The Preside:nor said Company shall an
nually, on the first Monday of July In each year,
make. a iAltten return ender oath to the Controller
of said city, of the number of ears , which may,
at any time dnring_the year , run upon said road, and
the books of said Company shallot all times be open
to the inipbction of the Finanee Committee or any
other flosendteee, appointed for that purpose by
Councils.
That said Company stipulate to construct
their railway and run cars upon the route within
three months from their acceptance of the provis.

Sze. 8. That the said Companj shall use In the
construction of their said railway, rails of a pattern
to be approved by the City Engineer and the Com -
mittee on Streets, and shall lay down the same to a
gauge of five feet two and , one-half inches. :The
same to be done uaderthe supervision and direction
of the City Engineer, who shall be paid for his set,
vices by the Company while employed by them.

gutters crossed by said railway. Iron culverts of a
pattern to be approved by said Engineer and Street
Committee, and said enlyertirehall be the entire
width of tke streets between the line ofproperty,
and the rails shall not be laid until the said culverts

Sac. 8. That this ordinance, and any contract en
tered into by virtue of it, shall be subject to modi
fication or change any time after the expiration of
ten years from the time of its acceptance hereof by
said COMpILITC, by the city giving said Company
three months ' notice of the intention so to do. •
Sze. 9. The city reserves the right at any time
after t t e expiration of twenty years from the date
- hereof, by giving mid Company one ear ' s notice of
such intention, to possess said road and Reek,. by .

terested appraisers, to be appointed at the request
of said city by the President Judge of the Quarter
Sessions Court of Allegheny county.
Sze. 10. This ordinance shall not go Into effect,
neither be published nor recorded, until said Com
pany shall file In thepflice of the City Controller an
agreement, under the seal of the Company, accept
ing ordinance., with all its provisions and con
ditions, sad covenanting that any failure to comply
with the terms hereof shall, at the option of said
city, work a revocation of the privileges herein
granted; and should the said. Company fall to give
the city notice of their acceptance of the ordinance
within ten days alter its passage, said neglect will
work , . a forfeiture of all the priyileges herein
granted.
Sze. 11. That nothing in this ordinance `shall be
construed to give the said Railway Company the
privilege of running any other than passenger ears
on said - road. a
Sze. 18. 'As a farther condittrizeof this grant by
.Gout, ells, the in. mbers of Councils, and the Messen
ger of Councils shall be allowed the unreserved
-privilege of riding on any of the can of said Com
pany free of charge.
Sae. 13. The said Pleasant Talley Railway Com
pany is authorized to make an ,rdrangement with
the President and Directors of the Pituburgh,Alle
gheny and Manchester Railway Company topass
over that portion of their track lying oetween ked
eral street and Sandusky street on Ohio' street.
