In the Supreme Court of Cincinnati yes
terday, the case of King, Pennock dc King
vs. Thomson Dean, 'iB.‘l.

was decided in favor of defendants. The
claim-made by plaintiffs was forthe value
of twenty bales of totton=qB,ooo) Shipped
by them in 1863, under the 'following cir
cumstances: The L ady Franklin, owned
by . defendants, and the Sunny Side, were
lying side by side at Mempids. Defea
;dents shipped seventy-three bales cotton
for Which the Lady Franklin gave bill
lading. Only fifty-three bales were de
livered to plaintiff's at Cincinnati. It came
Out in testimony that twenty bales-bad
been hauled to the Sunny Side by-mistake,
which boat was burnt on that trip, and the
ootton lost. The Court held, that the mis
take being in uttal, - neither party 'could
claim advantage, and the decrepancy in the
bill lading being satisfactorily explained in
evidence, defendenta were riotlihbld:
The starboard boiler cf the ill-fated Mag
nolia was found Sunday on the bar• below
California, Ohio. It now lies in three feet
water. This is the second boiler found,
and wo must now conclude that :he re
maining or middle boiler was the one
which exploded. The water gauge and
somdilues were also secured; part of watch,

for Pittsburgh on the St. Charles last
evordng.
The C. W. Dorrande has returned to MO
bile from an unsuccessful attempt to raise
the Sallie List, sunk in the Alabama river.
She was raised about threb feet, and a diver
went through her hatchway. She was
found to be filled with sand, and parted
amidships. There is no possibility of rais
ing her to any advantage, but her ma
chinery will probably prove valuable, and
will be taken off her during the low water
season.
A deck hand on board of, the W. A
Caldwell fell overboard and wos"drowned
while she was lying at Fort Smith, on Sun
day last. -
A storm prevailed in the vicinity of
Evansville on Friday night, doing consid
erable - damage along the line of the rail—
road, and playing smash generally along
the - river, from Owensboro to Henderson.
Several buildings in course of construction
in both places, were blown down, while
shade and ornamental trees' were twisted
off and torn up by the roots in great num
bers.
The Louisville Courier, of Tuesday, says:
The Captain of the steamer Delaware t43le
graphed from Cincinnati yesterday to, one
of our steamboat agents to Icnow how much
freight there was here for Cumberland
river. The answer returned was very little
for Cumberland river, and it might have
been truthfully added; or any place else.

as the wants of the Company require.
