A cargo of wheat was shipped from Chicago and consigned to the defend ant at Oswego. On the arrival of the vessel at that place, the cargo fell short about 80 bushels from they amount called for in the bills of lading. The defendant refused pay ment of the freight -inless the plaintiffs would pay for the shortage, which they re fused to 'to.
