BATUDDAY, December 11.—A number of motions were heard, among others that fora new trial In the cue of James Brown, convicted of robbing 11. S. Overholt,' of Westmerelaud county, in Liberty street, in thin city, in filly last, of a large sum of money. The motion was argued by H. C. llarkrell, Esq., Counsel for the prisoner, at considerable length and with much earnestness. The question in two case was one of identity, no other evidence being adduced by the Commonwealth than the fart that the money was taken from the person of Mr. Overholt, and that the man who took it and ran away with it looked like Brown, who aim arrested a short time after at a drinking saloon, where be was employ ed,. bar-keeper. None of the stolen money wan found upon hie person. The defense 'attempted an alibi, and covered 'all the necessary time except about half an hour. It also appeared that Brown was In that portion of the city where - the robbery took place, and , that he might have :been the robber.' Mr. Mackrell based his application uprin affidavits pro muted, explematory of the eircumatancus which a tracted suspicion to Brown, and pointingto another persim—now a fugi- tive from Justice—as the guilty party. , At•the time of the trial the endear who I made the arrest—one of the Mayor'e police—testified that he arrested Brown on the strength of a description given by Overholt. This statement is controver ted by S.A. Vetter, who deposes that his brother,hearing of the robbery and the circumstances attending, ft, suggested that it might have lxien-simmitted by ono of the "Neptune engine boys" and mentioned Brown as being tine of them. This "clue" was taken up by the phllce man, who straightway wont and arres ted Brown-at his place of erninoyment. Thus the shrewdness the police oaf. cer claimed for himself, 'ly giving , out that ho made the arrest on the:strength of a description given by the prosecutor, terns out to be nothing ,leas than "tall swearing." To sum sip the whole matter, Mr. Mackrell said there was nothing more in the ma than that three or four parsons testiff e<l.l.laat Brown "looked like the man" who Committed the robbery, and that the'defense, in en deavoring to provetua alibi, had placed him in a lomfity near to the scene of the deed,. while on an errand for his em ployer, thus showing it possible for him to have committed it. But undertheod ditional, "after discovered," testimony, he contended there was sufficient •to create such a doubt of guilt as would in duce the Court to grant anew trial.
